"Attention of NERAMAC Officers' Association (NOA) is drawn to the comments of VH Kalbande, appeared in Whispers of 4/7/14, stating that he was forced to resign as Managing Director of NERAMAC due to the corrupt officials of NERAMAC and others related. The NOA desires to bring it to the notice of readers of Whispers that the NOA had provided about 100 documents to Ministry of DoNER in support of suspected corrupt activities, acts of intellectual dishonesty, acts that brought disrepute to organisation, nepotism, violation of official norms, promoting indiscipline, ignoring official hierarchy, harassing business associates, lack of professionalism and basic administrative knowledge, pressurising officials to carry out misdeeds, arbitrary and whimsical decisions, unstable mind, misguiding the Board of Directors, Ministry of DoNER, State Governments, misbehaving with employees etc. by Kalbande. The matter was enquired by the DoNER Ministry. It appears that Kalbande smelt that the enquiry report was not in his favour and fearing termination from service, he escaped by submitting his resignation even before completing the initial one year probation period, after which his service would have been confirmed after assessing his performance, as a face saving exercise. His present comment itself is a proof of incompetency and display of gracelessness. The NOA is contemplating taking legal action against Kalbande, besides taking up the matter with DoNER Ministry for appropriate action."

CGHS services should be overhauled completely keeping in view the plight of pensioners.

Plight of CGHS beneficiaries

I would like to add few points about the plight of CGHS beneficiaries. After so much pain to see the doctors/specialists, dispensaries issue only substitute medicines for the medicine prescribed by the specialists. How can a doctor at the dispensary change the medicine that was prescribed by the specialist? There are serious issues of fraud involved in this health sector. I hope the government will take steps to stop such malpractices.

Great expectations

All honest and unbiased government employees have great expectations from new government. There are two issues which have to be highlighted:

1. It appears that in many key ministries, high level bureaucrats (Jt.Secy/Secy) still have soft spot for the previous government may be because they got handsome rewards in form of preferred postings, stable tenure and other things. They need to be immediately shifted to avoid embarrassment to the new government.

2. It is indeed the time now for Whistle Blowers to come forward and expose various corrupt practices and corrupt officials. There has been a long wait for broom cleaning. Honest officers must come forward.

DATE WITH RTI

What is substantial financing under the RTI Act?

The Delhi High Court had remitted the case to the CIC for consideration whether the Population Services International (NGO) received any indirect substantial funding from the appropriate Government or not. The NGO contended that they are not a public authority for the purpose of section 2(h)(d)(ii) of the RTI Act as they are not being "substantially financed" by the appropriate government and hence are not covered under the Act. The appellant argued that the NGO should be considered as public authority for the purpose of RTI Act as it has received some amount of funding from the government. The two member bench of CIC held that an amount of 18% to 20% cannot be construed as substantial financing. Further, only 8% was contributed from Central and State Government in the year 2013 and hence, the amount contributed by the Central and State Government cannot qualify as "substantial financing".

Comments


The term "substantial finance" has not been defined under the RTI Act. Unless it can be shown that the funding was so substantial to the body which practically runs by such funding and but for such funding, it would struggle to exist, the same cannot be termed as "substantial".
