In a circular released on June 6, 2014 by the Training Division of the
DOPT, a total of 8 training programmes under DFFT scheme has been cancelled
for year 2014-2015. The reason for cancellation has been listed as "budgetary
constraints and bad economy."

AAI's Kolkata Airport bags best improved ASQ
Award (UPDATED)
The Airport Service Quality (ASQ) Awards are presented in four categories
by Airport Council International (ACI): Best Airport by Region, Best
Airport by Size, Best Small Airport and Best Improvement. In the Best
Improvement Category in Asia Pacific Region "Kolkata Airport"
has won. This category includes airports which have experienced the
biggest improvement in ASQ rating between 2012 and 2013 in their region.
Kolkata Airport is being managed by Airports Authority of India. The
award was received by Dr B P Sharma, Airport Director, Kolkata in the
9th ACI Asia Pacific Regional Assembly meeting in Seoul, Korea on May
27, 2014. B P Sharma handed over the award to Alok Sinha, IAS, Joint
Secretary, MoCA & Chairman, AAI in presence of G K Chaukiyal, Member
(Operations) on May 29, 2014 at New Delhi. Airport Service Quality survey
is conducted at 11 major airports of AAI by Airport Council International.
11 airports are Ahmedabad, Calicut, Chennai, Goa, Guwahati, Jaipur,
Kolkata, Lucknow, Pune, Srinagar, Trivandrum. In respect of customer
satisfaction Airports Authority of India airports scored average ASQ
rating of 4.14 which is above world average of 4.04 as per 1st quarter
report i.e January 1 to March 31, 2014.

UPSC type body for all appointment
The government should immediately initiate the process for re-organization
of Scientific ministries. It should also consider making a UPSC type
of body for all appointment, promotions in such ministries. The presently
FCS is rather an arbitrary process with lots of opacity and discretion.

No case for FDI in e-commerce
I agree that some of the bureaucrats may have developed certain 'pet'
ideas (even if they are not influenced by outsiders) which they may
be pushing. There are at least two key ministries Commerce and Agriculture
where the top officer has been in the same ministry for 8 and 5 years
respectively. There is need for the new government to bring in new blood
and ideas by changing those who have "managed" to stay in
same ministry for long.

Some are more equal than others
It was amusing to read about delay in promotion of Dy CAG accusing Cabinet
Secretariat & PMO. It appears it is written by the contenders for
the posts. Just because CAG can create posts and make promotion upto
the level of Special Secretary, the department is promoting persons
without the rigorous exercise stipulated by DoPT as faced by other central
service officers. All Posts including equivalent of Jt Secy, Addl Secy
to Sp Secy level are created, upgraded, downgraded without any check
from anybody & without financial concurrence as is required for
other central services. Finance Ministry also does not mind additional
expenditure as CAG will not object being his own expenditure. It is
true that all are equal but some are more equal than others.

Plight of honest officers
Certain files were moved to the PMO for ACC clearance during previous
regime. Those who were crooked or manipulative got their files cleared.
Those file which were moved on merit and belonged to the officer who
were not sycophant are either still pending with the PMO or returned
to start from the scratch. These file took 7-9 months to get ready for
ACC. Now when the matter is to start afresh, it is going to take another
six months. Till that time the work will suffer. Is there someone to
see the plight of honest and non sycophant officers. There are great
hopes from the Present Govt.

Is the Information which cannot be denied to Parliament to
be provided to the RTI applicant?
The appellant sought copies of file in which the loan of M/s Kingfisher
Airlines was processed by the Bank, the copy of remittance made
to Air bus Industries or any other entity by bank being the advance
/ booking amount for purchase of Aircraft by M/s King Fisher Airlines
India, the initiatives taken by bank to recover this loan etc.
The PIO informed that the Kingfisher Airlines is a customer of
the bank and any information provided by the company for availing
loan and copies of remittances made to Airbus Industries as advance/booking
amount, is of commercial confidence and held by the bank in fiduciary
capacity which is exempt under section 8(1)(d). With regard to
the contention of the Appellant that information which cannot
be denied to Parliament has to be provided to the RTI applicant,
the FAA stated that the above proviso is sub section specific
and not a general proviso under Section 8 of the RTI Act. The
appellant argued that information regarding loans going 'bad/bust/NPA'
has to be disclosed as 'public interest' is involved. The CIC
held that the proviso below Section 8(1)(j) of the RTI Act which
reads "Provided that the information which cannot be denied
to the Parliament or a State Legislature shall not be denied to
any person" is applicable only to section 8(1)(j) and not
the whole of section 8(1).
Comments
The Bombay High Court in Surup Singh Hryanaik versus State of
Maharashtra AIR 2007 Bom. 121 had held that it is proviso to the
said subsection and not to the entire Section 8(1). This interpretation
has been based on the use of punctuation marks. The exemptions
contained in the clauses (a) to (i) of section 8(1) end with a
semi colon ";" after each such clause which indicate
that they are independent clauses. However, sub section Clause
(j) however, ends with a colon ":" followed by the proviso.
Immediately following the colon mark is the proviso in question
which ends with a full stop ".".
