UD Minister hands-over NBCC's re-development project surplus fund to FM (UPDATED)
M Venkaiah Naidu, Minister of Urban Development, seen handing over a cheque of Rs. 330.61 crore, a surplus fund, generated out of the re-development work of Netaji Nagar (Part) and New Moti Bagh (East) GPRA complex implemented by National Buildings Construction Corporation Ltd. (NBCC), to Arun Jaitley, Minster of Finance, Govt. of India. The money was saved after completion of redevelopment of the New Moti Bagh project in the capital. NBCC, a Schedule 'A' Mini Ratna CPSE of Ministry of Urban Development, Govt of India, implemented the New Moti Bagh eco-friendly Complex instilling all possible green features. This is India's first and largest Green Home Campus of its kind. The project was developed by NBCC on a novel concept of commercially utilising a small part of the government land to generate resources to finance the housing project to mitigate the acute shortage of General Pool Residential Accommodation. A total of 3 acres of land was commercially utilised as a source to finance the project and the land was e-auctioned for Rs 611 crore by NBCC on free hold basis to Leela Hotel.

PESB withholds selection of CMD, BDL (UPDATED)

Spare retd PSU' employees from IT


First of all, Congratulations to the Prime Minister of India and his team in a grand victory in the General election in2014. Secondly, thanks to whispersinthecorridors.com team in bringing factual information to all.
We the retired PSU officials wish to bring the following facts to the knowledge of Finance Minister and Prime Minister of India ...............that at the time of retirement, we the officials of PSUs, get the lump sum amount of provident fund, gratuity etc from their respective organisations. Besides that a meager amount of Rs. 1500/- to Rs. 2000/- per month as pension which is not sufficient for livelihood because of inflation and high cost of medicines and hospitalisation charges. It is next to impossible to live with this pension amount. Lot of PSU s do not provide post retirement medical facilities to their employees. Officials of such PSUs, as explained above, meet their livelihood/or expenditure from the interest earned from the lumpsum amount they get from their respective organisation after serving their whole life service of 35 - 40 years. After a year, we have to pay a lot of amount as Income Tax on the amount we get from our office which put us in hard condition. Therefore we earnestly request the Finance Minister and the Prime Minister to give relief to such retired officials in Income Tax and also provide post retirement medical facilities to all retired PSU employees.
We will be indebted for this. I shall be grateful to Dr. Suresh Mehrotra to publish this request in their column for two-three days for getting the attention of govt. as your web site reaches to all.

Entire personal staff be changed

Not only the personal staff of the previous Ministers, the staff of the Secretaries, Spl/Addl Secretaries should also be transferred out to other departments and Ministries. Otherwise there is all the likelihood of same formation going out to those Ministers and Secretaries.

"Curbs on publicity expenditure of Government"

When the Congress came to power in 2004, its first step was to enhance the "publicity budget" of DAVP, several times over. Justification : awareness campaign for public. The result was disastrous. Half and full-page advertisements in all English and Vernacular dailies started appearing with photographs of Sonia Gandhi, Prime Minister and Minister-n-Charge. It was concealed subsidy to big and influential Media houses for gaining control over them. The game continued unabated for 10 years. Lakhs of crores of rupees were wasted. The inflation was at its peak. M/Finance added to confusion by announcing austerity measures. The public felt frustrated, suffocated and helpless with excessive visibility of Sonia Gandhi . Let this not happen again. Following steps need be taken.

(a)Let the present govt drastically slash the publicity budget of GoI.
(b) Let it put embargo on ministries/ autonomous organisations/ Constitutional bodies etc on resorting to such flattering advertising practices at cost of public exchequer.
(c) Let I& B ministry order a special audit of publicity expenditure incurred by the UPA government during the past decade.

DATE WITH RTI

Is the Information which cannot be denied to Parliament to be provided to the RTI applicant?

The appellant sought copies of file in which the loan of M/s Kingfisher Airlines was processed by the Bank, the copy of remittance made to Air bus Industries or any other entity by bank being the advance / booking amount for purchase of Aircraft by M/s King Fisher Airlines India, the initiatives taken by bank to recover this loan etc. The PIO informed that the Kingfisher Airlines is a customer of the bank and any information provided by the company for availing loan and copies of remittances made to Airbus Industries as advance/booking amount, is of commercial confidence and held by the bank in fiduciary capacity which is exempt under section 8(1)(d). With regard to the contention of the Appellant that information which cannot be denied to Parliament has to be provided to the RTI applicant, the FAA stated that the above proviso is sub section specific and not a general proviso under Section 8 of the RTI Act. The appellant argued that information regarding loans going 'bad/bust/NPA' has to be disclosed as 'public interest' is involved. The CIC held that the proviso below Section 8(1)(j) of the RTI Act which reads "Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person" is applicable only to section 8(1)(j) and not the whole of section 8(1).

Comments


The Bombay High Court in Surup Singh Hryanaik versus State of Maharashtra AIR 2007 Bom. 121 had held that it is proviso to the said subsection and not to the entire Section 8(1). This interpretation has been based on the use of punctuation marks. The exemptions contained in the clauses (a) to (i) of section 8(1) end with a semi colon ";" after each such clause which indicate that they are independent clauses. However, sub section Clause (j) however, ends with a colon ":" followed by the proviso. Immediately following the colon mark is the proviso in question which ends with a full stop ".".
