Gupta in race for GM NR on lateral basis?
Whispers in the corridors of power have it that R K Gupta, GM North
Eastern Railway, have been trying for lateral shift as GM, Northern
Railway. Presently he has been carrying out the additional charge of
Dedicated Freight Corridor Corporation of India (DFCCIL) with the HQ
at Delhi. The post of GM, NR has fallen vacant after V K Gupta made
it as Member Engineering, Railway Board.

As the grapevine has it orders of B B Mishra (DDG, Narcotics Control
Bureau) may soon be issued by the MHA placing his services at the disposal
of the Justice Mudgal Committee. Former CBI Chief R K Raghawan &
former IPS officer M L Sharma were expected for the task but the Supreme
Court had finally chose Mishra to assist Justice B B Mudgal Mudgal in
its probe on betting and spot-fixing scandal in IPL 2013. Mystry shrouds
over the same as report has to be submitted by August 31 whereas the
orders of 1983 batch IPS officer are yet to be issued by the MHA.

Constitutional scheme ensures Independence to the CAG
It would be befitting to mention that it is the Constitutional scheme
which ensures independence to the CAG not only regarding its own functioning
but regarding all matters pertaining to his organization. The CAG heads
the IA&AS cadre and He decides all matters relating to the cadre.
The C&AG is very well aware of his onerous responsibilities. In
most establishment related matters the organization follows the GOI
orders of the DOPT, though the CAG can decide not to follow them. The
Promotions of the Dy.CAG level officers go to the ACC for approval.
The HAG and SAG level posts in the Dept. are by and large identified
posts and downgradation is done only for administrative exigencies or
if officers are temporarily not available. It is therefore meaningless
to compare the promotions/postings of the Indian Audit and Accounts
Officers with the Central Secretariat promotions and postings.

Structural changes
Today, there is problem in every area. We do not find any area where
there is no problem - whether it is the functioning of the Executive,
the Legislature or the Judiciary, corruption, crime, spiraling prices
of essential commodities etc. We have a strong stable BJP Government
at the Centre now under the charismatic leadership of Narendra Modi.
This strong Government can bring robust structural changes in our system
of governance. Unless and until these changes are brought into place,
the strong Government has no meaning. It is the appropriate time that
the Government should bring legislative, electoral, judicial and administrative
reforms, major ones are - bench mark of eligibility in the educational
qualification of Ministers and Members of Parliament, absolute ban on
persons entering legislatures having criminal background, and appointment
of clean and honest persons in the Executive and Judiciary. If we make
these institutions strong enough, the problems will automatically subside,
like if we maintain our body healthy, our internal organs will function
well. Cosmetics changes will not last any longer.

Regarding Six day Week
All Government employees should welcome the idea of six weeks. Basically,
we are to serve the people of India for which we are well paid from
the tax payers money. Gone are the days, when Government jobs were taken
as the right. Now we must deliver and it is the right of the master
i.e. GoI.

Rebate in Income Tax to retired employees
Most retired people have no source of income. Those retiring from
public and private sector do not even have pensions. All retirees have
to mainly depend on their hard earned savings in Provident Fund etc.
Purchase value of these savings keeps diminishing with inflation. Interest
on bank term deposits mainly is compensation for erosion of purchase
value of these deposits. Thus there is hardly any real income for these
senior citizens. To mitigate the sufferings of retired senior citizens,
it is necessary that only that portion of bank interest on deposits
is taxed which is over and above the inflation rate. This concession
should be given to all retired personnel whether from Govt., PSU or
Private for term deposits from their retirement funds.

Is the Information which cannot be denied to Parliament to
be provided to the RTI applicant?
The appellant sought copies of file in which the loan of M/s Kingfisher
Airlines was processed by the Bank, the copy of remittance made
to Air bus Industries or any other entity by bank being the advance
/ booking amount for purchase of Aircraft by M/s King Fisher Airlines
India, the initiatives taken by bank to recover this loan etc.
The PIO informed that the Kingfisher Airlines is a customer of
the bank and any information provided by the company for availing
loan and copies of remittances made to Airbus Industries as advance/booking
amount, is of commercial confidence and held by the bank in fiduciary
capacity which is exempt under section 8(1)(d). With regard to
the contention of the Appellant that information which cannot
be denied to Parliament has to be provided to the RTI applicant,
the FAA stated that the above proviso is sub section specific
and not a general proviso under Section 8 of the RTI Act. The
appellant argued that information regarding loans going 'bad/bust/NPA'
has to be disclosed as 'public interest' is involved. The CIC
held that the proviso below Section 8(1)(j) of the RTI Act which
reads "Provided that the information which cannot be denied
to the Parliament or a State Legislature shall not be denied to
any person" is applicable only to section 8(1)(j) and not
the whole of section 8(1).
Comments
The Bombay High Court in Surup Singh Hryanaik versus State of
Maharashtra AIR 2007 Bom. 121 had held that it is proviso to the
said subsection and not to the entire Section 8(1). This interpretation
has been based on the use of punctuation marks. The exemptions
contained in the clauses (a) to (i) of section 8(1) end with a
semi colon ";" after each such clause which indicate
that they are independent clauses. However, sub section Clause
(j) however, ends with a colon ":" followed by the proviso.
Immediately following the colon mark is the proviso in question
which ends with a full stop ".".
