Let us not get tense
It is high time for the Government of India to introduce flexi timings and make a six day week keeping the total number of working hours as 42.

5- Days week must continue
Going back to 6-days week will be a retrograde step considering the poor working conditions in Central govt offices. The officers and staff need to be given more time to spend with their families and rejuvenate themselves. This is a welfare measure acknowledged by successive Pay commissions. More emphasis should be given to "quality of working hours".The babus must be advised to break their comfort zones. The non-functional employees must be shown the door. Despite instructions on chopping off the "dead wood", not a single babu has been prematurely retired in the past on grounds of in-efficiency and incompetence . They are treated like ornamental showpieces. "Peter principle" is in full command.

Emulate MHA Model of Governance
Minister of Defence should overcome the problem of shortage of staff & vehicles by emulating the MHA Model of Governance where more than 2000 personnel from CPOs are working at the residences & offices with any number of vehicles, though official list of Division will indicate only around 250 staff and around 100 vehicles but actual figure is much higher. Who is bothered about working conditions at borders. Both CPO personnel and officials are happy in a situation where you scratch mine and I will scratch yours. CPOs staff will be working in a cool and static environment for life long and a pool of vehicles being round the clock for family even to a large number of non entitled class, though all entitled officers are using Department vehicle plus many other from CPOs even in length & breadth of the country.

DATE WITH RTI

Is the Information which cannot be denied to Parliament to be provided to the RTI applicant?

The appellant sought copies of file in which the loan of M/s Kingfisher Airlines was processed by the Bank, the copy of remittance made to Air bus Industries or any other entity by bank being the advance / booking amount for purchase of Aircraft by M/s King Fisher Airlines India, the initiatives taken by bank to recover this loan etc. The PIO informed that the Kingfisher Airlines is a customer of the bank and any information provided by the company for availing loan and copies of remittances made to Airbus Industries as advance/booking amount, is of commercial confidence and held by the bank in fiduciary capacity which is exempt under section 8(1)(d). With regard to the contention of the Appellant that information which cannot be denied to Parliament has to be provided to the RTI applicant, the FAA stated that the above proviso is sub section specific and not a general proviso under Section 8 of the RTI Act. The appellant argued that information regarding loans going 'bad/bust/NPA' has to be disclosed as 'public interest' is involved. The CIC held that the proviso below Section 8(1)(j) of the RTI Act which reads "Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person" is applicable only to section 8(1)(j) and not the whole of section 8(1).

The Bombay High Court in Surup Singh Hryanaik versus State of Maharashtra AIR 2007 Bom. 121 had held that it is proviso to the said subsection and not to the entire Section 8(1). This interpretation has been based on the use of punctuation marks. The exemptions contained in the clauses (a) to (i) of section 8(1) end with a semi colon ";" after each such clause which indicate that they are independent clauses. However, sub section Clause (j) however, ends with a colon ":" followed by the proviso. Immediately following the colon mark is the proviso in question which ends with a full stop ".".
