The file of Gautam Roy, ED, IOCL, who was selected for the post of Managing

being put up before new Government. The sources said that his appointment
is expected to be delayed. The vacancy has arisen on June 1, 2014.

The resignation of Dr Arup Roy Choudhary, CMD of NTPC Limited, from
the additional charge of Chairman, Damodar Valley Corporation (DVC),

It has been known that however after been promoted as Joint Secretary,
he has been currently posted against vacancy of Director.

G Sai Prasad, who is holding an additional charge of CMD, NHPC Limited,
is whispered to be willing to quit the charge. He is a 1991 batch IAS
officer of Andhra Pradesh.
Three names in race of Chief Secretary Govt of Punjab
With the prospects getting brighter for Rakesh Singh's new stint at
the centre the whispers have been doing rounds as who would win the
race as new Chief Secretary to the Govt of Punjab. As many as three
names are in the race: Sarvesh Kaushal, Navreet Singh Kang and Suresh
Kumar. Kaushal is a 1982 IAS officer whereas Kang & Kumar are 1983
batch IAS officers. The most prospective name is clear to those few
who know the affairs well. But one has to wait and watch till the incumbent
makes his fortune in a top slot assignment at North Block.

The Union Ministry of Statistics has advertised for engaging 5 Consultants
in the National Accounts Division on a consolidated salary of Rs.40000.
The maximum age limit is 30 years. No experience of working in national
accounts has been prescribed. Prima facie it looks that the posts have
been advertised and essential qualifications prescribed to suit certain
specific people. They already has some people in mind. May be the New
Minister should look into it and put a stop to this malpractice.

New Finance Minister
Congratulations and welcome New Finance Minister. CBDT and CBEC have
given their presentation but no innovations and vision to increase tax
net of higher income group. There has always been emphasis on lower
income group. 80% energy and man power is wasted to chase small tax
payers. If these two organizations are watchful then chances of generation
of black money gets reduced. CBDT is too much concerned and wastes energy
in innovating things like that if tax exempt income is more than Rs.5000/-
tax payers cannot fill ITR-1. CBDT does not think about the people whose
taxable income is more than 100 lakhs. It is perception that no notice,
no innovations to find out the complete details of such people, they
remain free bird. There is no data base available, people owning cars
value of 20 lakhs and above, people travel abroad more than two times
in a FY, owning house more than 100 lakhs, stayed in five star deluxe
hotel in last three years, have acquired property/land more than 100
lakhs in last three years etc. Good data mining is required to stop
the tax evasion. I request FM to make small tax payers free from these
hassles. All the best to New FM.

The Indian P&T Accounts and Finance Service needs immediate Cadre
Review as the Cadre Controlling Authority is under compulsion to send
their SAG officers on deputation or on Training or on study leave. The

Transport allowance should be exempted from Income Tax
As per existing guidelines, the Transport Allowance to the extent of
Rs.800/- (old TPA) only is exempted from Income Tax. After implementation
of 6th Pay Commission Report on 01.1.2006, the amount of TPA has been
increased to Rs.3200+DA. The Ministry of Finance may kindly issue necessary
instructions for exemption of the entire amount of Transport Allowance,
which is given in performance of duty.

etc. Those buying degree with money -are they meritorious? all talk
about merit is meaningless when we look at the qualification of those
governing the country.

MCA should relook draconian of new companies Act 2013
The new MCA minister should have an urgent relook at some of the draconian
provisions of new companies act 2013. Some of them are anti-growth,
for example the provision relating to raising of unsecured loans by
a private limited company, which are mainly family owned enterprises
in small and medium scale . As per the earlier provisions these companies
were allowed to raise unsecured loans from its shareholders only , and
accordingly the businesses were run with loans from family members/close
associates who were shareholders in the company. However now as per
new companies act, 2013 and rules notified therein, the private companies
are not allowed to raise loans from its shareholders beyond 25% of its
paid up capital. this will hamper the functioning of these companies
as they will have to unnecessarily incur extra costs to raise funds
from banks and FI's and may also not be able to do so in absence of
securities insisted upon by banks. The rationale for this change is
not understandable as these loans are only from shareholders of the
companies who are mainly family members or close associates whose loans
in spite of being unsecured remain within the family owned and run business
and they are not worried about their investments going bad. The new
provisions require all such companies to repay all these loans before
31-03-15 and this will lead to closure/disruption of business activity
and growth of all such small and medium scale enterprises. it cannot
be presumed that such was the legislative intent when it is not a case
of raising funds from public. the penalty for violation is a hefty sum
of Rs.1 crore and it seems to be a case of laws and regulations being
made without application of mind and without having the pulse of the
ground realities. Let us pray to god that the new government understands
this and exempts private limited companies from such draconian law and
ensure the growth and continuity of business of small and medium scale
companies.

Dr Ashwani Kumar an eminent forest scientist and educationist
Apropos to the comments of Ashok Sharma regarding posting of Dr Ashwani
Kumar to the post of DG ICFRE, let me add that besides he being senior
IFS he is the first and perhaps the only D Sc Forestry degree holder
in the service. There is always heartburn amongst the scientist that
Indian Council of Forestry Research and Education is generally headed
by a forest bureaucrat. Dr Ashwani Kumar is an eminent Forest Scientist
as well as educationist. With these qualifications it is quite sure
that he would take the Scientists along with to further the cause of
Forest and Environmental developments and restore the pristine glory
of this world famous organisation.

Penalty for delay in supply of information
An RTI application was filed on 27.8.2013 which the Public Information
Officer (PIO) which he marked to Shri Sarvana Kumar (clerk) on
30.8.2013 to give it a distinct number for being forwarded to
the concerned officer for providing the information. The dealing
clerk, who was working directly under the PIO, put it up to him
on 18.9.2013 and the application was forwarded to the concerned
officer, Shri Sandeep Bedi, Pharmacist on 18.9.2013, with the
request to provide the required information. Shri Bedi responded
on 27.11.2013, where after the PIO forwarded the information to
the Complainant on 9.12.2013. A complaint was filed with the CIC
for delay in providing the information. The PIO stated that the
delay in provision of information was on account of non cooperation
of the deemed APIOs, S/Shri Sandeep Bedi, Pharmacist and Saravana
Kumar. Shri Sandeep Bedi submitted that the file containing the
information was under movement from one office to the other which
led to delay. The CIC observed that the responsibility cast upon
PIO would be seriously eroded if they were to simply mark RTI
applications to other officials, particularly officials under
their direct charge, and then put the entire blame for delayed
action on such other officials. The CIC further observed that
Shri Sandeep Bedi, Pharmacist cannot be absolved of the responsibility
of locating the file and providing the information within the
stipulated time frame. For a delay of 23 days, the CIC imposed
a penalty of Rs. 5,750/ on the PIO and Shri Sarvana Kumar, to
be shared equally between them. Further, a penalty of Rs. Rs.
12,500/ was imposed on Shri Sandeep Bedi, Pharmacist for a delay
of 50 days.
Comments
It is imperative that every PIO should put in place an effective
monitoring system to keep a check on the RTI applications received
by him.
