NBCC registers 25% growth in FY 2013-14 (UPDATED)
National Buildings Construction Corporation Ltd. (NBCC), a Schedule 'A' Mini Ratna, CPSU under the Ministry of Urban Development, Govt. of India, has posted a Net Profit of Rs.257 Crore, an increase of more than 24% as compared to the last FY 2012-13. While the total income rose to Rs.4098 Crore, a growth of 25.71%, Net Worth of the Company has touched Rs.1141 Crore for the current fiscal. The announced performance is based on the Audited Financial Results of the Company that were taken on record at the meeting of the Board of Directors held on May 26, 2014 in New Delhi. Anoop Kumar Mittal, CMD, NBCC, while reading out the audited results, said that Board of Directors of NBCC at its meeting have also recommended dividend of Rs.5/- per equity share amounting to Rs. 60.00 crore for the FY 2013-14 against Rs.45 Crore last year. This equity share excludes dividend distribution tax of Rs.10.20 Crore. Talking to the media at a Press Meet held on June 6, 2014, Dr Mittal revealed that NBCC's future road map envisaged a quantum jump in Real Estate revenue as it planned to vigorously pursue execution of quite a number of Real Estate projects, capitalizing on its already existing huge land reserves pan India. Dr Mittal also informed that with the huge success of NBCC's initiatives in the Re-development of Government Properties such as New Moti Bagh, GPRA Complex in New Delhi, many State Governments of the country had approached NBCC for implementation of similar such re-development projects in their states and a few of these are at an advance stage of finalization. Dwelling upon other areas of operation with regard to multiplying the top line and bottom line of the company in the coming years, Dr Mittal said that NBCC was extensively exploring the possibilities of project exports in countries like Oman, Botswana & their neighbouring countries. In this context, he mentioned about the recent signing of an MoU by NBCC with Al Naba Services LLC of the Sultanate of Oman, in order to grab infrastructure projects in those countries.

Conforming to our recently published list names as 'brain behind Modi's mega campaign' new name to be taken on board with PMO is Jagdish Thakkar. Popularly known as Jagdhish Bhai Thakkar, is a former officer of Gujarat Information Service who had been serving as PRO to ythe then Chief Minister Narendra Modi. Thakkar was the only officer who could be seen accompanying Modi all the time during the election campaign. He kept Modi briefed of each and every development much in advance.

India strategic meet on 'Made-in-India" civil aircraft held at HAL Bangalore (UPDATED)
A strategic meet on Regional Civil Aircraft with an aim to kick-start the process of building first "made-in-India" civil aircraft was held here today. Speaking on the occasion, Ajay Shankar, Member Secretary, National Manufacturing Competitiveness Council (NMCC) said given the skills-set and the cost advantage the country has the dream project should turn into realty by 2020-22. He called upon over 100 potential business partners who were present on the occasion to actively participate in the brain-storming session and discuss challenges and risks involved. "We can surprise ourselves and the world by rolling-out a medium-range civil aircraft", he added. Dr R K Tyagi, Chairman, HAL, in his address, pointed out that India must have such an aircraft considering the fact that it is world's ninth largest market and will be third by 2020. "It is therefore important to have our own aircraft. HAL and NAL have taken the lead to build this aircraft on PPP model where you all will be contributing", he said. "A Special Purpose Vehicle (SPV) is being formed by HAL and NAL to steer this project. The purpose of this strategic partners meet is to ensure inclusive involvement of all the potential business entities right from the beginning", he added. A team of experts drawn from Government agencies, private industries and research organizations participated s at the panel discussion and deliberated on the challenges on various fronts including technology, time scales, conceptual design issues, manufacturing skills needed and commercial viability. Several senior executives from leading Indian and overseas companies such as GE Aviation, Pratt & Whitney, Eaton, Mahendra, Titan and others shared their views and evinced confidence in the success of this program.

Extending work hour ?


The Babudom is worried about the latest unconfirmed reports on the extending work hour. This really needs discussion. Whether the argument of extending work hours has emerged from a necessity or its a political choice? Whether the existing mechanism (like bio-metric attendance system, etc) has been implemented fully and yielded the desired results? Before adopting a new policy, the Government may consider review of the existing mechanism and its strict implementation.

No case for FDI in e-commerce


I feel that the proposal to recommend FDI in e-commerce has emanated from the DIPP at the initiative of previous government. There is absolutely no case for any FDI in this sector which can very well be developed by the domestic entrepreneurs who have enterprise, technical and managerial skills as well as finances. Foreign companies cannot offer anything that we do not have. It seems there are well entrenched elements in concerned ministry who are working for FDI in every sector at the behest of certain lobbies. Hope the new Govt. will identify them and not succumb to ridiculous proposals.

Is the Information which cannot be denied to Parliament to be provided to the RTI applicant?

The appellant sought copies of file in which the loan of M/s Kingfisher Airlines was processed by the Bank, the copy of remittance made to Air bus Industries or any other entity by bank being the advance / booking amount for purchase of Aircraft by M/s King Fisher Airlines India, the initiatives taken by bank to recover this loan etc. The PIO informed that the Kingfisher Airlines is a customer of the bank and any information provided by the company for availing loan and copies of remittances made to Airbus Industries as advance/booking amount, is of commercial confidence and held by the bank in fiduciary capacity which is exempt under section 8(1)(d). With regard to the contention of the Appellant that information which cannot be denied to Parliament has to be provided to the RTI applicant, the FAA stated that the above proviso is sub section specific and not a general proviso under Section 8 of the RTI Act. The appellant argued that information regarding loans going 'bad/bust/NPA' has to be disclosed as 'public interest' is involved. The CIC held that the proviso below Section 8(1)(j) of the RTI Act which reads "Provided that the information which cannot be denied to the Parliament or a State Legislature shall not be denied to any person" is applicable only to section 8(1)(j) and not the whole of section 8(1).

Comments


The Bombay High Court in Surup Singh Hryanaik versus State of Maharashtra AIR 2007 Bom. 121 had held that it is proviso to the said subsection and not to the entire Section 8(1). This interpretation has been based on the use of punctuation marks. The exemptions contained in the clauses (a) to (i) of section 8(1) end with a semi colon ";" after each such clause which indicate that they are independent clauses. However, sub section Clause (j) however, ends with a colon ":" followed by the proviso. Immediately following the colon mark is the proviso in question which ends with a full stop ".".
