An application was filed under the Right to Information Act on seeking medical documents relating to the treatment done by Dr. Sunil, of a patient namely Late Nani Gopal Biswas, from 1.1.1989 to 27.5.2010. The Public Information Officer (PIO) denied the information under Section 8(1)(h) of the RTI Act claiming that it is a medico-legal case. The Respondents submitted that they were not in a position to accept a death certificate issued by a Tehsildar and such a certificate ought to be issued by the Registrar of Births and Deaths. The CIC directed the CPIO to provide the information sought by the Appellant if she submits the death certificate of Shri Nani Gopal Biswas, issued by the Registrar of Births and Deaths, and documentary proof that the Appellant was his widow.
