position of Justice, Delhi High Court. Presently he is serving as District

H U Khan poised for JS empanelment
Whispers in the corridors of power have it that H U Khan may soon be
empanelled to be posted as Joint Secretary or equivalent with Govt of
India. Reportedly, the 1989 batch Indian Forest Service officer of MP
cadre has got the CVC clearance.

As the grapevine has it, Ram Prakash Sisodia is all set to repatriate

Chief of Air Staff shows keen interest in
Unique Iron Bird Facility at HAL
Air Chief Marshal, Arup Raha, Chief of the Air Staff visited HAL's state-of-the-art
Iron Bird facility at Aircraft Research and Design Centre (ARDC) the
other day. He appreciated the joint team efforts of HAL and other agencies
that has resulted in completion of more than 14,370 hours of rigorous
software testing of LCA -Tejas till date. "It is a unique facility
and an asset to the LCA Tejas program. Using this facility, tests can
be carried out under normal and failure modes for complex aircraft systems",
says Dr R K Tyagi, Chairman, HAL who accompanied the Air Chief. The
facility allows for an integrity test for the flight control system
for statically unstable aircraft such as LCA and very few countries
in the world have access to such testing platform, he adds. Iron Bird
is the final platform where all the issues of LCA Tejas flight control
systems are resolved to ensure safety of the flight. It is a test rig
that facilitates ground testing of flight control system (FCS), components
and software for LCA in open loop and closed loop modes. Other associated
aircraft systems like LCA standard cockpit with necessary controls and
displays, hydraulic system, landing gear retraction/extension systems,
FCS related Utility Services Management System (USMS) and nose wheel
steering systems are also evaluated at the Iron Bird.

Poetic justice
It will be poetic justice indeed, if one of the members of Prime
Minister Narendra Modis official delegation to America is Devyani Khobragade.This
will put America in its place and show to the world that India will
no longer take any more nonsense from foreigners.

Health Minister is insensitive
The present Health Minister is insensitive to the problems of pensioners.
More we write in this column about the problems of CGHS beneficiary
pensioners more trouble we invite. He has stopped issuing of medicines
for more than a month. Thereby we all have to rub shoulders with the
crowd in the CGHS dispensary at least twice a month and spend hours
together in the infectious dispensaries. Moreover, if our children are
abroad we cannot visit them for more than 3 months as maximum medicines
issued in that case also would be for three months only. Literally we
have to be back before completion of three months so that we have enough
time in hand to see the specialists and get those medicines issued/indented
by our respective dispensaries before we exhaust the medicines issued
to us. What a good Health Minister we have ? Achhe Din Aagaye.

CGHS and Health Minister
It seems all ministers in the present government is too much in hurry
to do something, wrong or right probably wants to come in the limelight.
It is apparent how the present health minister has taken decision for
CGHS beneficiaries. I don't know where are we heading for ? They have
five years , and should have serious thought processes in place before
taking decisions and take input from the effected employees, specially
the pensioners or stop CGHS facility ? Need very serious thought before
it goes beyond repair.

Can a PIO file an appeal before the CIC?
The Public Information Officer (PIO) partly denied the information
which was allowed by the First Appellate Authority. The PIO filed
an appeal before the Central Information Commission (CIC) against
the order of disclosure of FAA. The CIC ruled that first appeal
may be filed before FAA not only by the person who is seeking
the information, but also the Public Authority. Thus, it may be
inferred that Second Appeal may also be filed before this Commission
not only by the information seeker but even by Public Authority.
Comments
As per section 19(1) of the RTI Act, 'any person' who is aggrieved
by the decision of a PIO can file an appeal to FAA, and the power
of filing an appeal is not restricted to the individual seeking
information. However, under Section 19(3) of the RTI Act which
describes the filing of second appeal, no such expression has
been used. The larger Bench of CIC in Decision dated 02.08.2007
in file no. CIC/AT/A/2006/00074 & CIC/WB/A/07/00679 too, the
CIC had taken a similar decision.
