CBI and Director Anil Sinha


The CBI has been targeted for being tool of the NDA Government and the Delhi CM Arvind Kejariwal has gone to the extent of saying that the CBI has been asked to finish those who don't fall in line. Infact, the CBI Chief Anil Sinha has publicly said that he was never pressurised by the political bosses to act. Those who know Sinha from close quarters say that he is the one official who has no personal or vested interest and it was he who used to cook food himself after attending office as ADG, Vigilance in Bihar. He was appointed CBI Director without any political Godfather ,only on the basis of merit and experience by this Government.

CBSE on low priority of NDA Government


Central Board of Secondary Education (CBSE) seems to be in low priority of the NDA Government. This is evident of the fact that the post of Chairman CBSE has been lying vacant for the last one year. There is no full time Chairman and the government is not in a hurry to fill up the post.

F: But what is all the hullabaloo about ...in my Country too high and mighty appear in Court ..all that you get to see is a huge Media presence ...this is so wrong ... don't Indians have anything better to do ??

M: I think India is transitioning to the true form of Democracy....we are transitioning from a Autocracy running a Democracy to a real Democracy...

F: My Driver mentioned a name ....R.....Ra....yes Rani and Yuv...cannot recall more that this....what's the meaning ...

M: Rani is Queen and Yuvraj is Prince ...and they are the high and mighty in Court...

F: So India is a Monarchy Democracy like UK....

M: No no... assumed titles...their family was in power in India for a good sixty years and sadly they transformed into Royalty..

F: I was stuck in traffic for an hour...first there was a kind of procession going into the Court and then after some time delirious celebrations ....did these high and mighty lot escape a very stiff sentence ...

M: No ..they got bail...

F: Whaaa.... these guys are celebrating because they got bail.... or maybe in India Bail has another meaning ...does it mean cleared of all charges. ..
M: No .... same meaning ...temporary reprieve from Jail...

F: I must say other than this experience of being stuck in traffic....I like the India of today ....my first trip... had heard so much from my predecessor who travelled often to India about dirt ...corruption ...what I see is the Government is serious about cleaning India...and the two Ministries I went to were just like back home ... yes red tape but no 'demands'... my predecessor had warned me ...from doorman to Minister money opened doors. . and lack of it kept doors closed...

M: Yup this Government is cleaning India literally and notionally too..

F: Whose this guy whose pics are on all the posters here ..

M: That's Sharukh Khan.. King of Bollywood....

F: Okay ...India's Hollywood ...but did not know India's Hollywood is a Monarchy ...

M: No ..no...its an assumed title ..

F: Wow you guys suffered and conitune to suffer from a severe case of Stockholm Syndrome when it came to Raj.... Raj went but Queens...Yuv whatever you call him..and Kings took over India ...hope you too don't have an assumed title ...

Joint Secretary Justice Praveen Garg has moved to the North Block as Joint Secretary Department of Economic Affairs. 1988 batch IAS officer of Madhya Pradesh cadre Garg will look after the desk of Capital Market in the DEA. He was the officer who worked full time for reforms in appointments of Judges by means of National Jdicial Appointments Commission and had eventful tenure in Department of Justice.

Delay in appointment of Judges

There has been much delay in the appointment of Judges in the SC and High Court which is very harmful for justice delivery system.

Judiciary as service delivery organisation


The overwhelmingly overburdened Judiciary at all levels and consequently the delays the cases the large pendency entails makes a sad story for dispensation of justice. However, whenever the Judiciary asserts, it gets whatever it wants, for making it a better organisation. In Punjab, the recruitment of lower judiciary is done by the High Court. Similarly it had its Infrastructure Committee in place to tremendously improve the Judicial complexes in the two states. The idea of All India judicial Service and setting up of Union Judicial Service Commission has been in circulation for half a century.The All India services i.e IAS, IPS, IFS, have hardly any inspiring record, though some geniuses brought them glory occasionally. The setting up of All India Judicial cadre has limited scope to accelerate the qualitative and quantitative delivery of justice and not a panacea for its ever increasing ills. Unless and until quality of human beings is improved, the judiciary in isolation stands little chance of improvement and that seems not possible with the type of governance ,we have had for a long time.

I agree that CHS officers should also be empanelled as Joint Secretary/AS, at least in health ministry or similar work places to start with. There working conditions in government hospitals is very pathetic. I have seen very senior surgeon (SAG scale) in RML hospital sitting in 5'*3' box. No vehicle, no peon, no water these senior doctors have to manage everything themselves.

As a humble student of government, let us examine a few propositions:

Proposition: The CBI cannot search an officer without informing politicians.

Fact: Incorrect. The CBI has inherent jurisdiction over AGMUT cadre officers, it does not need to inform politicians. The Delhi Special Police Establishment (the CBI's correct name) has jurisdiction over the Central Government, Public Sector and Banks and the Delhi Government. In cases of most other state governments, the CBI does not have original jurisdiction over those governments and so, cannot investigate cases there unless the State government requests it do so by due notification or the Courts order CBI probe(s). So, while politicians elsewhere can be presumed to be ignorant of this fact, politicians of Delhi are unlikely to be (more so if politicians has spent time in the service of the Government).

Proposition: The CBI should not carry out searches, it should inform politicians, who will then, themselves, take action.
Fact: Is that the new Lokpal scheme? Or have the politicians been appointed Lokpal? Or is it that the law is different for the politicians and officers close to them?

Proposition: Searching an officer is vendetta against politicians.

Fact: How? In case that proposition is taken to be valid, it will render all officers close to politicians immune from investigation!

Proposition: A counter claim is sufficient to drown out criticism.
Fact: In a war of perception, maybe a diversionary tactic could work for a while. However, it is quite surprising (and touching) that a politician stands by his close(?) officers to such an extent.

Juvenile Justice: India & USA

in India the law has yet to evolve. The SC must step in to save other girls from this criminal and others like him who will be inspired by his freedom to act alike. The SC must see the rulings given by the Supreme Court of America, which has awarded both life imprisonment as well as death penalty in heinous & beastial crimes committed by juveniles before they attained age 18 years, as reflected in this extract:

Coordinating Council on Juvenile Justice and Delinquency Prevention

Currently, 38 States authorize the death penalty; 23 of these permit the execution of offenders who committed capital offenses prior to their 18th birthdays.1 However, the laws governing application of the death penalty in those 23 States vary, and the variation is not necessarily tied to rates of juvenile crime. Since 1973, when the death penalty was reinstated, 17 men have been executed for crimes they committed as juveniles (see table 1), and 74 people in the United States currently sit on death row for crimes they committed as juveniles (Streib, 2000).2

Information about the selection process

An applicant sought information regarding allotment of an LPG agency in Noida, allotment of land concerning the same and related issues. The information was denied by the PIO but the FAA informed the applicant that he could inspect the relevant documents at the office of the Respondents. However, it was not done. The CIC observed that the selection processes should be completely transparent, so that there is no doubt whatsoever regarding the selections that are made. The CIC directed to facilitate inspection of all the relevant documents by the applicant excluding the information of a personal nature concerning the selected candidate.

Comments

A comment of some personal dispute between the families of the applicant and the selected candidate was brushed aside by the CIC with the remark that it would have no impact on the issue of disclosure. Further, such selection processes should be completely transparent and any citizen should have access to the documents concerning the same.
