" Odd-Even Car Conundrum in Delhi "
Delhi govt has demonstrated puerility by issuing executive orders without
consulting the principal stake-holders-- the public, Delhi Police and
GoI. It has merely copied the Chinese model. India is a democracy where
consultation is respected except during national emergency. The Delhiites
would be the first to support any anti-pollution measure provided it
is even-handed. The rule was partially enforced in China due to autocracy
and an effective transport network. Both are missing in Delhi. Orders
of NCT, Delhi ,are considered discriminatory for not covering Delhi
legislators, Ministers, MPs, Union ministers, top bureaucrats and their
equivalents in Constitutional and statutory bodies and Judges.
The statement by India's new CJI that " he could travel by buses
or car-pooling" was a trailblazer. Other Supreme Court judges are
equally modest. How could the politicians, ministers, top bureaucrats
etc lag behind? When public health is at stake, all should lead by examples
by resorting to car pooling, car sharing and travelling by public transport.
The argument of security cover, should not be over-played except for
the President, Vice President, PM and other dignitaries. Public and
private sector executives must travel by hiring buses. The fleet of
Delhi metros and buses must be re-inforced.At present, these are packed
like sardines with commuters. Delhi Police is ill-equipped to catch
the offenders. If the police goes on stopping vehicles, there'll be
massive jams, arguments and chaos on roads. Delhi Police will get blame
for no fault. There is a danger of commercial vehicles changing their
number plates every day. A kid's job in NCR that takes pride in selling
urea as milk and milk products along with fake medicines.
Against this background, CM, Delhi is advised to defer the implementation,
say by a month and review his unilateral decision by consulting all
stakeholders. There should be application of mind.

Slap on the face of BJP
It is felt that it will be a crying shame if this man is taken as Secretary.
Bureaucrats are seeing this as slap on the face of BJP and beginning
of the downfall and end of BJP.

Flag Day
Every year on December 7, Armed Forces Flag day is being observed since
1949, as dedicated to India, towards collection of funds from the people
of India for the welfare of the Indian Armed Forces personnel. The noble
cause was well conceived and from President of India to Governors and
Chief Ministers ceremoniously contribute towards this fund from their
pockets as a gesture of gratitude and goodwill. However ,it has been
observed that for the last some decades, the voluntary and willing contribution
to this fund has stopped and ,the collections are made compulsorily
and coercively as a part of target given to the district officers by
the deputy commissioners. The public resists the coercion especially
when even the poor who visit government offices for any work are also
not spared Thus, the sanctity of the purpose and cause has been diluted
and compromised. The government must stop coercive collection of the
fund whole-heartedly to restore the sanctity of the purpose for which
the fund was set up.

Duration of inspection of the documents
The complainant submitted that the PIO had allowed the inspection
of the records in question for 15 minutes only and that too with
the condition that the entry to the building for the purpose of
inspection shall be at the discretion of the security agencies.
The FAA directed the PIO to provide access to the records to the
appellant in such a manner that the purpose of the application
is fulfilled. The complainant alleged that the PIO has been persistently
causing obstruction to supply of the information to the complainant
despite the orders of the FAA. The PIO contended that he made
effort to get file located which was more than ten year old and
had given prior intimation for inspection of documents. The complainant
admitted that he has been provided the requisite information though
there has been a delay and demanded to be compensated. The CIC
held that due to communication gap, there was a delay in the inspection
of the file by the complainant and no further action is required.
Comments
The duration of inspection and convenience of the applicant to
inspect the documents was the issue under consideration in the
case. Under RTI Rules, an applicant is entitled to one hour inspection
free of any charge and thereafter, on payment of fees. A PIO should
not restrict the timings of an applicant arbitrarily which may
lead to a charge of obstruction to free flow of information.
