Who will win the Delhi elections?

Most of the educated middle class would be divided over Arvind Kejriwal and Kiran Bedi. Lawyers could vote for Kejriwal, policemen and women could vote for Kiran Bedi. Punjabis could vote for Kiran Bedi, jhuggis could vote for Kejriwal. Junior Government servants could vote for Kejriwal, seniors could vote for Bedi. Interesting fight. The decisive vote could be of those who were traditionally Congress voters but would be forced into either camp this time so as not to waste their vote. Between the two, there is little to differentiate, Bedi is more experienced but Kejriwal is more energetic. With his own party, he does not face any infighting either. However, his style is as dictatorial as Bedi's allegedly is. Both might be termed opportunistic, but at the same time, both might be seeking to serve people.

Administrative ministries are main defaulters


The poor performance of the PSUs is not on account of the PSUs. The administrative ministries are the main defaulters. The Ministers have the power to change priority of the two recommendations of the PESB. Have you not heard about the mulching of the PSUs by the Ministers and Officers. Not to forget the politically powerful employees and shirker of work of PSUs. The PSUs are more private company in the country as they are own by only one person that the Government. Whereas the private limited companies are more public as they raise from the public.

Information related to ongoing trial

The Appellant sought copies of all correspondence exchanged between the bank and CBI / CVC/ other government departments, along with office note with regard to certain allegations levelled against her and the sanction sought by the CBI for her prosecution. The Public Information Officer (PIO) denied the above information on the ground that it was regarding CBI investigation pending prosecution and its disclosure was likely to hamper the progress in the steps being initiated by the agency. The respondents added that the matter concerning the Appellant is now before a CBI court. The Central Information Commission (CIC) upheld the denial holding that once the stage of an order framing charges have been crossed, it would be open to the accused to make an appropriate application before the learned trial court to summon the above documents in accordance with the law.

Comments


A document may be available with one public authority and copies of the same may be available with other public authorities. In such situations, there is a confusion which public authority should take a decision regarding the disclosure of information. Under the RTI Act, the right to access the information is that which is "under the control of" which implies that the information, regardless of which public authority holds it, is under the control of a specific public authority on whose orders alone it can be produced in a given proceeding. In case of an ongoing court proceeding, the documents related to the proceedings are under the control of the Trial Court, who alone can decide how the information is to be dispensed.
