Rajiv Bhattacharya wins battle; FSNL gets MD after 30 months
Appointments Committee of Cabinet (ACC) has reportedly finalized the appointment of Rajiv Bhattacharya for the post of Managing Director, Ferro Scrap Nigam Limited (FSNL). Interestingly, K K Jain, GM, SAIL, was first selected for this post by PESB on December 4, 2012, but his name was struck off by the Ministry and it proposed the second runner up, Rajiv Bhattacharya, GM, FSNL. Due to tug-of-war between Jain and Bhattacharya, CVC had been withholding clearance for two years. The proposals of both were sent to ACC to decide their fate. The post has been lying vacant since August 23, 2012.

Bureaucracy unwilling to change !

It is indeed very shocking to learn that a high official in the Govt. of India tried to influence the CBI to prevail upon the I/O not to arrest a certain influential person suspected to be involved in a chi fund scam.

This shows that regardless of the sincerity and efforts of the top political leadership, the entrenched bureaucracy is just not willing to change itself.

This issue has come to the fore only in view of the case being high profile.

There may be several cases like this when bureaucracy may be putting pressure on lower level officials to show favors to someone or the other.

Naturally, the lower level officials also would take full advantage and do what they want in matters where they are themselves interested.

Delhi in for anarchy


In case, Kejriwal wins, Delhi is in for anarchy , dharnas, and lawlessness. He has already announced 50 per cent reduction in electricity tariff , when fixing tariff is the statutory responsibility of the DERC. Delhi govt. Can only announce subsidy at the cost of the honest tax payer . Theft of electricity was rampant till 2000 and in some areas as high as 67per cent . Privatization helped control theft. If Kejriwal wins , we will return to the earlier era. Water sharing agreement by BJP in1993 -94 assured water for Delhi. No augmentation of supply is possible. Promise by AAP to give free water 24 hours daily is just not possible

Information related to ongoing trial

The Appellant sought copies of all correspondence exchanged between the bank and CBI / CVC/ other government departments, along with office note with regard to certain allegations levelled against her and the sanction sought by the CBI for her prosecution. The Public Information Officer (PIO) denied the above information on the ground that it was regarding CBI investigation pending prosecution and its disclosure was likely to hamper the progress in the steps being initiated by the agency. The respondents added that the matter concerning the Appellant is now before a CBI court. The Central Information Commission (CIC) upheld the denial holding that once the stage of an order framing charges have been crossed, it would be open to the accused to make an appropriate application before the learned trial court to summon the above documents in accordance with the law.

A document may be available with one public authority and copies of the same may be available with other public authorities. In such situations, there is a confusion which public authority should take a decision regarding the disclosure of information. Under the RTI Act, the right to access the information is that which is "under the control of" which implies that the information, regardless of which public authority holds it, is under the control of a specific public authority on whose orders alone it can be produced in a given proceeding. In case of an ongoing court proceeding, the documents related to the proceedings are under the control of the Trial Court, who alone can decide how the information is to be dispensed.
