Majumdar is no more
Golok Majumdar, a 1950 batch IPS officer of West Bengal cadre, died in Kolkata earlier this week. He retired as Chief of West Bengal police. He was 89 years old. Thus far, he remains the only civilian officer to have been awarded the top Military honour, the Param Vishisht Seva Medal (PVSM) for his role in the Bangladesh operations while serving in the BSF on deputation.

Revolutionary Act
Ten years have passed since this revolutionary Act came into being. Many attempts have been made in this period to bring about some amendments in the Act, but under the pressure of the ever vigilant RTI activists, no amendment has been possible so far. With the passage of time, all legislations have to come to terms with the changing circumstances. So this legislation has to evolve itself by taking into account experiences of various stake-holders particularly activists.I have experienced that the Centre and the State governments are still moving at snail's pace to make its offices/public authorities RTI compliant. There is no power with the information commissions to review its orders, the commission also cannot take suo-motu notice of any lapse, non-compliance of the provisions of the Act, meaning that powers of revision have also not been vested in the Information Commissions. The Central Information Commission has jurisdiction of all India, there are small and big states, but the Act says that there can be 10 Information Commissioners besides Chief Information Commission in each Commission. The Central Information Commission should have 24 Information commissioners and regional benches also need to be set up, if the normal norms and geographical areas are taken into account. In many states only 2 Information Commissioners are required as per the pendency of cases, but keeping in view the political compulsions all the 10 posts are filled. The Centre govt should fix the norms for each post of Information Commissioner with the proviso that the post of I.C. will be filled as per the norms enshrined in the Act itself. Many NGOs, private bodies and authorities created by the Acts of the government are penalised for delay or are ordered to pay compensation. But ,there is no provision in the RTI Act to coercively recover the penalty/compensation if that authority refuses to comply with the order of the respective Information Commissions. These are some instances only. In my view, the Act needs to be suitably amended to make it more purposeful and effective

Colours of bureaucracy

The article in Economic Times of July 10, 2015 "No to Delhi? 56 IAS officers opt for states" shows the real colours of IAS bureaucracy - something which has always been suspected by the people. It is true that few of them might have gone back for better posts, but most of them clearly wanted to shirk real responsibilities and find cosy jobs in the States where political leadership is not as sharp and where they can easily indulge in vyapam like scams, placing blame on politicians.
We should feel ashamed of the IAS class where sincerity, competence, honesty and integrity seem to be at a premium. Only power, perks and making money (Joshis of MP are live examples) are the real goals.

DATE WITH RTI

Filing of RTI Application to know the fate of earlier application

An application was under the RTI Act seeking information regarding action taken on an earlier RTI application and first appeal filed by the Complainant. A reply was sent to him on but the Complainant stated that he did not receive this reply. The Respondents volunteered to send another copy to him. While noting that no further action is due on this RTI application, the CIC observed that the right course of action for an RTI applicant, in the event of the PIO not responding to his RTI application, is to file an appeal to the First Appellate Authority and thereafter, if necessary, an appeal / complaint to the Commission. Instead, the Complainant took upon himself to enquire into the delay on the part of the Respondents in responding to his earlier RTI application by filing yet another RTI application. Filing of such applications is avoidable because the RTI Act provides for appeals / complaint process in the event of unsatisfactory action by Respondents on an RTI application. Such applications needlessly clog the system.

Comments

RTI act is a self contained act which provides for the mechanism to deal with cases where replies have not been received. An applicant should use the modalities provided under the Act which can provide him the best results.
