Who will become NHRC head?
National Human Rights Commission (NHRC) is headless since more than
two months now. Government seems to be in no hurry to fill up the post

Dr Sanjay Kumar, GM, CIL, who was selected for the post of Director

Frame & put RTP in public domain; DoPT
All ministries, departments and cadre authorities of Govt of India have
been asked to frame Rotational Transfer Policy (RTP) and put up in public
domain. The policy should include identification of sensitive posts
and rotation of officers from sensitive posts. They have been asked
to communicate action taken report (ATR) in this regard to DoPT latest
by July 10, 2015.

in GoI from UP
As many as seven IAS officers belonging to 1982 batch of Uttar Pradesh
cadre have been empanelled for the posts of Secretary in Government
of India.
J S Mathur tops out of ten in Secretary Empanelment in MP
The empanelment list issued for the posts of Secretary in Government
of India came as a surprise when only one name J S Mathur from a big
state Madhya Pradesh turned up out of total 10 IAS officers of 1982
batch. There are presently ten IAS officers: Dr Aruna Sharma, Pravesh
Sharma, Rakesh Agrawal, Ajay Nath, Jitendera Shankar Mathur, Sudhir
Ranjan Mohanty, Raghav Chandra, Ms Suranjana Ray, Ms Snehalata Shrivastava,

A revolutionary decision by a hard task master PM Modiji. It will now
break the monopoly of one British era service. Now, they will have to
compete with other class-1 officers of Organised Services to prove their
worth. creation of one All India technical service- Indian Engg Service
(IES) is also the need of the hour. PM may be apprised of this.

Finance is a very ticklish and complex subject for which a financial
wizard must be selected, whether he is from the IAS or from Banking
service or from industry. In fact the time has come when each Ministry

More transparent process needed
Why is this hue and cry by IAS officers who have not been empanelled
for Secretary level posts? Just because they qualified an exam 35 years
back, they have the right to become Secretary? All services has pyramidical
structure and only few can go up, eg in Armed Forces every officer does
not become General !!! Instead of asking for moderation in evaluation
of ACR they should ask for more transparent process in empanelment and
subsequent posting by DOP&T.

Pay commissions recommendations
I tend to disagree with A. Srivastava that Pay Commission's recommendations
are without going into the practicality of the situations. On the contrary,
Pay Commission is actually an expert body who studies the system of
GoI in great details and after due deliberations/consultations give
its recommendations. These recommendations are further scrutinized minutely
item by item by Committee of Secretaries [wherein, Secretary Expenditure
and DoPT Secretary etc. are also members] and then approved by Cabinet.
Cabinet in India is supreme and anything approved by Cabinet is binding
on all GoI Departments. Once a recommendation is approved by Cabinet
it is not open for DoPT to study the practicality but to implement the
Cabinet decisions. It is another matter that DoPT played with the system
and high-ups also ignored DoPT's hypocrisy and tax-payers money is wasted
by taking work of stenographer [UDC equivalent] from a PSO [director
equivalent]. 6th Pay Commission had recommended PSOs' post as a temporary
measure to give relief to stagnating officials until merger is effected.
Now even take the case of practicality why 3-4 officials ranging from
PS to PSO are required in a Secretary's office when there are only two
telephones in his office? How many persons are required for dictation
from one Secretary? How many persons are required for keeping engagements
of one Secretary??? Pay Commission's recommendations, once approved
by Cabinet, are binding and no department is excluded from implementing
these.

RTI being misused
Completely agree with a comment that RTI is being misused by some to
seek frivolous information. Recently, someone went up to SC to seek
information of medical bills of judges. Fortunately, the supreme Court
rejected the appeal otherwise it would have opened floodgates of similar
trivial requests. Medical expenses of an individual are his private
matter and just because the person works in government, does not mean
that details of medical bills submitted by the person for reimbursment
under the rules can be asked for by any tom, dick and harry.
It is possible that some individuals may be submitting inflated bills
but that can be for any government servant not necessarily singling
out judges.
I am sure government must be having a reasonable system of checking
and audit and if need be the same can be strengthened. There is no need
for the common man to get involved in purely administrative matter.
In any case, assuming information is provided, there is nothing the
person getting it can do, except write to appropriate govt. dept. He
has no means to judge anything one way or the other.

Disclosure of the reasons for the decision taken by the Supreme
Court
The appellant sought for the copy of judicial record related to
the case decided by the Supreme Court of India and the reasons
for some of the conclusions reached in that order. The Public
Information Officer (PIO) advised the appellant to deposit a certain
amount of money for getting the copy of the order and informed
him that it is beyond the scope of the PIO's duty to offer any
justification/explanation for the orders passed by the Supreme
Court of India. The First Appellate Authority (FAA) endorsed the
views of the PIO. The Central Information Commission rejected
the appeal observing that if there are certain conclusions in
the order, the reasons for those conclusions have to be found
out in the order itself. The PIO cannot interpret the order and
come out with his own justifications.
Comments
Explanations cannot be sought under the RTI Act. There are many
cases where the judge has not given any reasons or justification
for coming to a conclusion. The only remedy available is to go
for an appeal. However, if a case is thrown out with a single
word "dismissed" by the apex court, there is very little
option for an individual.
