Modified BDAP guidelines issued
The Department of Border Management has issued modified Border Area Development Programme (BDAP) guidelines. Now BADP has been extended to cover all the villages which are located within the 0-10 km of the International Border. BADP has been implemented through 17 states viz. Arunachal Pradesh, Assam, Bihar, Gujarat, Himachal Pradesh, Jammu & Kashmir, Manipur, Meghalaya, Mizoram, Nagaland, Punjab, Rajasthan, Sikkim, Tripura, Uttar Pradesh, Uttarakhand and West Bengal, which constitute the International Land Borders. It is implemented in 367 border blocks of 104 border Districts in these 17 states.

Derogatory remarks

DoPT has to merge CSS and CSSS to make unified cadre and redeploy, retrain, redesignate all the incumbents, as per the requirement - as recommended by VI pay commission and as accepted by Cabinet. Derogatory remarks about PS to PSO won't make any sense. Cadre management is always based on the history, parity and work distribution, stagnation and so many factors, not on a single parameter of one Secretary and to PS, dictation etc. Those giving derogatory remarks, can they say that in their cadres work is equally distributed in similar designates. It varies from dept to Dept and from Dte to Dte. Cadre is an overall phenomenon.

Identify sensitive posts

Instructions of Central Vigilance Commission in the Circular No. 03/09/13 (No.004/VGL/090/225553 dated 11.9.2013) reiterate that sensitive posts should be identified and staff working in these posts strictly rotated after every two/three years to avoid developing vested interests but sensitive Ministries like Home, finance, environment, forest etc. at all crucial posts officers with secretaries etc. are sitting over 25 years and even in some placed they dont allow even senior posts to be filled up. CVC being from M/o Finance knows the condition in D/o Revenue. All these sensitivities are meant for mere eyewash or meant for implementation and these instructions issued ritualistically and are applied to mortals who are not able to defend themselves. There are DOPT instructions that in Secretary's office the total tenure should not exceed 10 yrs but is being flouted with impunity. Exception should be for one or two years but complete life is being spent by these people on these posts. In GOI all sensitive & economic posts are grabbed by these officers who are there for over 25 years and fortunately DOPT knows these almighties very well. Is there any authority who can bell the cats.

Promotions

I also sincerely thank the Government for speedy promotion of CSS officers. The same spirit of speedy promotion of CSSS officers may kindly be shown to especially the officers who are due to retire on superannuation within a year or so are eagerly waiting for their regular promotions as PS. But their promotions have been kept pending under one pretext or the other. Moreover, DP&T, as in the case of CSS officers, may consider promotion of CSSS officers working as P.A. upto Select List, 2008 in one go and cover in the Select List 2013. It would, perhaps, not be desirable for the officers waiting for regular promotions as PS to keep them pending for one more year who are even otherwise eligible to be promoted. If need be, proposal for in-situ promotions can be considered. It would give some kind of solace to the officers from the ongoing acute stagnation faced by them at the time of their ad-hoc promotions for more than 11 years.

DATE WITH RTI

Filing of RTI Application to know the fate of earlier application

An application was under the RTI Act seeking information regarding action taken on an earlier RTI application and first appeal filed by the Complainant. A reply was sent to him on but the Complainant stated that he did not receive this reply. The Respondents volunteered to send another copy to him. While noting that no further action is due on this RTI application, the CIC observed that the right course of action for an RTI applicant, in the event of the PIO not responding to his RTI application, is to file an appeal to the First Appellate Authority and thereafter, if necessary, an appeal / complaint to the Commission. Instead, the Complainant took upon himself to enquire into the delay on the part of the Respondents in responding to his earlier RTI application by filing yet another RTI application. Filing of such applications is avoidable because the RTI Act provides for appeals / complaint process in the event of unsatisfactory action by Respondents on an RTI application. Such applications needlessly clog the system.

Comments

RTI act is a self contained act which provides for the mechanism to deal with cases where replies have not been received. An applicant should use the modalities provided under the Act which can provide him the best results.
