Misuse of government resources

Regulatory bodies like Water Commission, Telecom Regulatory, Airports Regulatory etc, mostly retired persons are appointed Chairman and Members. They get fat salary of Rs.4,25,000/- and Rs.3,75,000/- without Car and house. But they use government and private v ehicles of office, Servants, Guards, etc. This is misuse of government resources . Department of expenditure control these types of expenditure. Acts should be notified again to control the expenditure.

Mufti playing dangerous game

Mufti is playing a very dangerous game in Jammu &Kashmir with his personal political agenda in mind. On the very first day of his becoming Chief Minister he shocked the country in giving credit to Pakistan, militants and separatists for the smooth election process in the state. This was an insult not only to our brave security forces, the Election Commission but the people of J&K.His subsequent utterences and then the plan to release terrorists like Masarat Alam from prison are frightening messages to throw the state once again in turmoil of violence. He is provoking Bhartiya Janta Party .His game plan is to come into power with the help of all these traitors if BJP withdraws from the coalition.BJP is really in a Catch 22 situation. If they do not leave the coalition they would be a party to his anti-national agenda and if they withdraw they will not be able to win even from Jammu in the next election as they will have to face the anger of people there. Tying up with Mufti is the greatest miscalculation of BJP. They should have looked into the past of this man before trusting him. National Conference is a better bet as both Farook and Omar ,whatever their other faults may be ,could not have been so anti-national.BJP should try to get out of Mufti's trap before further damage to the country is done.

Communication by Lt Governor of Delhi regarding appointment of CM

The appellant sought copies of all communication made between Lt Governor of Delhi and Mr. Arvind Kejriwal, Central Government, Commissioner of Police & Advocate General or Solicitor Generalregarding appointment of Chief Minister. The PIO declined disclosure claiming exemption under section 8(1)(c) of RTI Act. The Central Information Commission (CIC) referred to the Apex Court decision in the case of SP Gupta vs Union of India, wherein it was held that while the exact advice given by the Council of Ministers to the President could not be examined by the court, the material on which such advice was based was not excluded from the judicial purview. The CIC held that appointing a Chief Minister of a state is an open public activity. It is also not the case of respondent that the correspondence between Executive Head of State and leader who staked claim to form the Government could not be disclosed when the decision is still in the process. No harm would cause to any interest whether public interest, protected interest or interest in protecting the communication sought by the appellant.


Comments

This case pertains to the time before the election of the Delhi Assembly. It is important as it discusses what constitutes a breach of privilege of Parliament or the State Legislature. Section 8(1)(c) of the RTI Act says that there shall be no obligation to give any citizen information, the disclosure of which would cause a breach of privilege of Parliament or the State Legislature. Article 74(2) of the Constitution of India prohibits the courts from inquiring into the question 'whether any and if so what advice was tendered by Ministers to President'
