ITDC chairman gives Rs 18.88 cr dividend cheques to Tourism Minister (UPDATED)
Chairman & Managing Director of India Tourism Development Corporation (ITDC) Umang Narula, on behalf of India Tourism Development Corporation (ITDC) and Kumarakruppa frontier Hotels Pvt. Ltd., handed over two cheques amounting to Rs 18.88 crore to Union Tourism Minister Mahesh Sharma today, towards dividend payment to the Government of India for the year 2014-15. Present on the occasion were Secretary - Ministry of Tourism -Vinod Zutshi, Joint Secretary, Suman Billa, Ministry of Tourism, V.P. (Finance), P K Aggarwal, ITDC along with other Sr. officials of MOT & ITDC. The ceremony took place at Minister's office at Transport Bhawan, New Delhi. The decision for the payment of Dividend was taken during ITDC 50th Annual General Meeting held at the Group's flagship hotel, The Ashok, New Delhi. It may be noted that ITDC, a PSU under the administrative control of the Ministry of Tourism has declared a dividend of 20% amounting to Rs.17.15 crore for 2014-15, the highest ever in terms of amount and the highest since 2007-08 in terms of percentage and Kumarakruppa Frontier Hotels Pvt. Ltd., another PSU under the Ministry of Tourism has declared a dividend of 450% amounting to Rs.4.39 crore for 2014-15. For the financial year 2014-15, ITDC posted a robust performance registering the Net profit of Rs.38.95 crore on a turnover of Rs.504.19 crore, the highest since 2007-08. Of the overall performance, the Hotel Segment i.e. the Core area of ITDC achieved an impressive turnover of Rs.283.90 crore with a profit of Rs.10.81 crore. Besides Hotels, the other segments dealt by ITDC are Tours & Travels, Events Division, Institute of Hospitality & Tourism Management, Consultancy & Engineering Services, and International Trade Division all under the brand of Ashok. During 2014-15, the Events Division of ITDC hosted "India-US CEO Forum" [ chaired by the Prime Minister of India & His Excellency The President of USA];"India-US Business Summit" [ chaired by the Prime Minister of India & His Excellency the President of USA]; besides many other prestigious events organized by the Government of India.

Natural Justice meaning for ideal collegium system


How natural justice meaning is discussed in para 17 of Supreme Court Judgement in the matter of -- Uma Nath Pandey & Ors vs State Of UP & Anr on 16 March, 2009 (CRIMINAL APPEAL NO. 471 OF 2009 Arising out of SLP (Crl.) No.6382 of 2007) - Full Text available in www. indiankanoon.com

--" Para 17. How then have the principles of natural justice been interpreted in the Courts and within what limits are they to be confined? Over the years by a process of judicial interpretation two rules have been evolved as representing the principles of natural justice in judicial process, including therein quasi-judicial and administrative process. They constitute the basic elements of a fair hearing, having their roots in the innate sense of man for fair-play and justice which is not the preserve of any particular race or country but is shared in common by all men. The first rule is `nemo judex in causa sua' or `nemo debet esse judex in propria causa sua' as stated in (1605) 12 Co.Rep.114 that is, `no man shall be a judge in his own cause'. Coke used the form `aliquis non debet esse judex in propria causa quia non potest esse judex at pars' (Co.Litt. 1418), that is, `no man ought to be a judge in his own case, because he cannot act as Judge and at the same time be a party'. The form `nemo potest esse simul actor et judex', that is, `no one can be at once suitor and judge' is also at times used. The second rule is `audi alteram partem', that is, `hear the other side'. At times and particularly in continental countries, the form `audietur at altera pars' is used, meaning very much the same thing. A corollary has been deduced from the above two rules and particularly the audi alteram partem rule, namely `qui aliquid statuerit parte inaudita alteram actquam licet dixerit, " haud acquum facerit' that is, `he who shall decide anything without the other side having been heard, although he may have said what is right, will not have been what is right' (See Bosewell's case (1605) 6 Co.Rep. 48-b, 52-a) or in other words, as it is now expressed, `justice should not only be done but should manifestly be seen to be done'. Whenever an order is struck down as invalid being in violation of principles of natural justice, there is no final decision of the case and fresh proceedings are left upon. All that is done is to vacate the order assailed by virtue of its inherent defect, but the proceedings are not terminated.

Yes, it is 100% true. Most of the IAS officers nowadays are mere educated clerks doing nothing except signing proposals put forth by their babu-clerks. The mere fact that in spite of having all resources like mineral, water, land etc..., India remains a poor country and no one gets 2-square meals a day is due to these IAS lobbies and their corrupt habits. They deserved to be banished by general people.

The staff selection headquarters and northern region are heading useless and corrupt people. Why cannot they be replaced even otherwise? The candidates are exploited by these authorities/DoPT can see.

Long postings

It has been observed that many IAS officers in higher positions like Additional Secretary and Secretary, remain in one ministry for a short period before being transferred to another. One will find several instances when they remain in the posting for periods between six months and 12-13 months.

This aspect needs to be examined with such short tenures. How can the government extract the right type of quality work from the officer? And in the end the ministry concerned suffers.

It must be examined whether the officer was (a) incompetent (b) misfit (c) indifferent (d) acted in a way to get himself/herself transferred.
The process of deciding on the postings also needs to be gone into. DoPT must undertake an exercise on this.

Disclosure of the name of the whistle blower under PIDPI

The appellant filed a complaint related to malpractices in purchase of medical material like Fumy floor solution, Multipurpose cleaning solution etc. to the CVC. He stated that after the receipt of the complaint, the CVC had sent a letter to him seeking the identity. The envelope containing that letter was superscribed as "Public Interest Disclosure & Protection of Informer Resolution (PIDPI)". In spite of this, the envelope was opened by the then Medical Superintendent because of which his identity and name was unnecessarily revealed. He sought to know whether the confidential letters in favour of any doctor/employee can be opened by the medical superintendent of the hospital and related information. The CIC issued a show cause to the PIO to show-cause why penalty should not be imposed on him for not furnishing the information within the prescribed period and why compensation should not be awarded to the appellant.

Comments

The PIDPI requires the Competent Authority to conceal the identity of the complainant and the documents or information furnished by him, for the purposes of enquiry under this Act. Hence, the officers and staff should be careful about which envelopes to be opened and by whom.
