Civil servants and 7th CPC

68 years of independence have passed but we have not achieved much at the ground level wherein we can boost about our achievements. The civil servants are more to be blamed for miseries in comparison to politicians. Politicians are there only for a period of 5 years whereas civil servants have stooped to a very low level to please the politicians. They have depicted a feudalistic attitude on the lines of Britishers towards their subordinates. As the Courts take a lot of time in taking decisions in the country the subordinates have peacefully retired and take their pension. Not all civil servants are bad though. It is those who think that administration is done through carrot & stick policy only. They do not realize that they are carrying with them a lot of 'Baddua' and when they retire people look at them with contempt in the streets. They are many who have personal problems and take out their frustrations on their subordinates. The 7th Pay Commission have come out with attractive gratuity and insurance scheme. Last but not the least is the misuse of office perks, facility and authority beyond permissible limit.

I am shocked about no representation from states. Wait till you see the design to ensure that only Bihar, UP figure and of late Gujarat, rest have been ignored on some stupid excuse or other. God save the nation.

Election reforms

The Bihar election 2015 results show what a sham our democracy is. Now, more than hundred criminals (accused of kidnappings, multiple murders, rape, extortion, hafta/maheena vasooli etc) have become Bihar's law makers.
The charge sheet in the criminal cases of elected MPs/MLAs should be filed within 3 months by CBI (not local sate police) and decided within 6 months by fast track special lower court.

It is surprising that our Constitution permits a person, who is convicted for stealing the fodder of dumb cattle, to become the head of recognised political party. This is a major flaw in election rules. A convicted or charge-sheeted person should be DEBARRED from either becoming head of any recognised political party or to campaign for any political party during elections. If any political party utilises services of such tainted persons, then that party should be debarred from fielding its candidates in the elections. Such tainted persons should be kept in JAIL or under house arrest during the period of election notification and election results. This party has cornered maximum seats on the basis of caste.

Is it a 'VIKAS' model for Bihar state or it is a 'VINASH' model of criminals, based on caste lines.

Bihar results have proved that it is a typical example of what a Democracy should not be. After more than 68 years of independence, parties in Bihar are still thriving on caste factor aka Mandal Raj. Let us eliminate caste-based reservation in Govt forever, as propounded rightly by Bhagwat ji, recently. Reservation on caste-lines was meant for only 10 years, upto 26 January 1960 but nobody (weak and un-willing politicians) dared to stop it thereafter. Let there be maximum 5% reservation only, solely based on economic considerations and physical disability, limited to ONE generation only. The next generation (children) shall not get benefit of reservation, if already availed by his previous economic beneficiary parents.

It is time we redraw our constitution so that certain minimum qualifications are made mandatory to get voting rights. This will prevent illiterates from electing ruffians and criminals into assemblies and parliaments.


My suggestions for voter eligibility are:
1. Illiterates- eligible to vote ONLY for gram and zila panchayats elections.
2. 10th class pass- eligible to vote ONLY for corporators/ municipal councillors elections+ those for illiterates.
3. 12th class pass- eligible to vote ONLY for State assemblies elections + those for 10th pass.
4. Graduates- eligible to vote for Lok sabha elections and all other elections.

My suggestions for contesting CANDIDATES eligibility are:
1. Illiterates- NOT eligible candidate for any election.
2. Accused of more than one murder- NOT eligible candidate for any election.
3. 10th class pass- eligible to be a CANDIDATE ONLY for gram and zila panchayats elections.
4. 12th class pass- eligible to be a CANDIDATE ONLY for corporators/ municipal councillors elections+ those for illiterates.
5. Graduate pass- eligible to be a CANDIDATE for State assemblies elections, Lok sabha elections and all other elections.

I hope that our result-oriented, quick decision taker, tough taskmaster and bold PM Narendra Modi shall give a thought to my suggestions on electoral reforms.

Actually this is a very good move by the government as the other services officers though are getting the pay in joint secretary level but actually have not been promoted to joint secretary's post. So they can work now as Jt Secy level post with full energy as they have been waiting for a long time - in some cases since last 10 years.

Vacancy of NBA chief


Will PMO look into the matter of vacancy of National biodiversity Authority chairman's post, which has been lying vacant since 21 months. Interviews were taken six months back. Biodiversity conservation is the most important issue when we talk of climate change , because both CBD and convention on climate change originated from Rio de Janeiro earth submit. Due to absence of regular chairman work on biodiversity conservation is suffering and nobody is there to guide State biodiversity boards. These boards and even NBA is not implementing access and benefit sharing guidelines thereby incurring loss to the tune of more than Rs 25,000 crores, which otherwise has been utilised by grassroot level Biodiversity management commitees in village level for their overall development. It seems that current charge chairman NBA has not apprised the facts to minister who is ignorant in this matter.

Fact is that all industries having foreign share has to give 0.5% of their turnover to National biodiversity authority and all those firms dealing with bio resources of India for commercial purposes will have to pay from 0.1% to 0.5% of their turnover to state biodiversity boards. National green tribunal Bhopal in December 2014 in their judgment ruled that state biodiversity board should take action as per ABS guidelines issued by NBA in October 2014 but none of the state biodiversity boards and not even NBA has implemented guidelines issued by NBA itself.

This is because chairman looking as additional charge is not serious in this matter. Hope PMO will listen to the advice as they say that they are digital and sincere to the views raised by any responsible citizen of India.

Senior citizens ignored


Minister for H&FW is not taking interest in resolving the pain & harassment of Sr. Citizens in visiting Govt. hospitals for specialist consultations. Neither HOD of Govt. hospitals nor Administration make provisions for CGHS retired persons. They have to go same pain as serving CGHS beneficiaries. Minister should consider allowing CGHS beneficiaries of pensioners category to go directly in empanelled hospitals for consultation and diagnostic tests. This will ease out the process for old Sr.citizens who do not have any one to look after. Govt. is having many schemes for sr. citizens then why not in availing medical facilities.

Disclosure of the name of the whistle blower under PIDPI

The appellant filed a complaint related to malpractices in purchase of medical material like Fumy floor solution, Multipurpose cleaning solution etc. to the CVC. He stated that after the receipt of the complaint, the CVC had sent a letter to him seeking the identity. The envelope containing that letter was superscribed as "Public Interest Disclosure & Protection of Informer Resolution (PIDPI)". In spite of this, the envelope was opened by the then Medical Superintendent because of which his identity and name was unnecessarily revealed. He sought to know whether the confidential letters in favour of any doctor/employee can be opened by the medical superintendent of the hospital and related information. The CIC issued a show cause to the PIO to show-cause why penalty should not be imposed on him for not furnishing the information within the prescribed period and why compensation should not be awarded to the appellant.

Comments

The PIDPI requires the Competent Authority to conceal the identity of the complainant and the documents or information furnished by him, for the purposes of enquiry under this Act. Hence, the officers and staff should be careful about which envelopes to be opened and by whom.
