Appeals in CIC

The number of appeals in the Central Information Commission in the recent past has reduced by 75%. Read the 'Saptahik Hindustan' of 9.10.2015. The reason could be on account of the following reasons:-

(i) The art of Government officials to give reply to RTI applications is one of the reasons, which has led to this.
(ii) The problem arises if you falter in giving reply either in yes or no/complete or incomplete.
(iii) The important reason for this could also be lack of coruption during the last one year.
(iv)Curb on black money and fall in real estate prices.
(v)Not to forget that spectrum scam and Coalgate was only on account of RTI applications. This may have made government employees cautious.
(vi)One more could be Attendance Machine.
(vii)However, still there are black sheep and they need to be brought to book.
(With the number of applications reducing, the task of dealing with public grievance applications could be given to CIC.

RTP misused more by CSS officers

RTP has been misused more by CSS than CSSS officers because CS Div. is managed by CSS Officers. CSS Officers continue to work in the same Ministry even after getting promoted or completing the tenure. Fresh date (of promotion) is mentioned against their name in that Ministry. Many CSS officers manage shifting to another Ministry within one year if they do not get department of their choice. One officer has managed to return to MHA and got posting in the same Division. What Secretary (P) can do if concerned JS and his team do not work in an impartial manner or flout the rules/guidelines. The situation was much better when the promotion orders used tobe issued by EO Div.alongwth posting to a new Deptt RTP therefore has done more harm than good in the organisation.

More staff than entitlement

One more fact is to be noted that Ministers, Secretaries, Additional Secretaries & Joint Secretaries in the Ministries/Departments are entitled to some number of Staff. But when you will see through a transparent lens all of them have got with them Staff much more that their entitlement. This is done forcibly. PSU men and the hired Data Entry Operators is also posted with them, who attend to personal chores of both the Minister/Officer and the Private Secretaries. This over employment and loss to exchequer, can be treated as form of corruption. In a Department there is no PSU but the Director(Admn) and junior officials of the administration are forced to attend to their household work. There massive excess use of vehicle at Government cost for personal purposes. Where are you Mr."Na khaunga na khane doonga". Even god is not going to forgive such acts in the background where we have so many poor people in the country.

On grievance redressal in GoI

The comment in WIC on 12.10.2015 by BBS, an insider in the Department of Administrative Reforms & Public Grievances on my earlier submission indicates the cynicism with which a grievance is viewed by him and his friends. He presumes it to be false and illegal which is pathetic.
When a complaint is sent to CVC, it forwards it to the CVO of the concerned department who is working under the persons against whom the complaint is made. The investigation is covered-up and CVC, in general, do not examine it. The complaint is given no chance to counter the findings of the CVO. In some cases, he is harassed too. Similarly, DARPG forwards the grievances to the concerned ministries and when the same is closed without proper redressal with the remarks that the complainant was not responding to the Ministry, it neither verifies the claim nor apply its mind to see the absurdity of the claim of the Ministry. Why a genuine complainant will not respond to the Ministry! It is in this context that I categorised, DARPG as a mere post office which passes on the message without examining the content.
There may be cases where persons are misusing the grievance mechanism, but the duty of the system is to ensure justice to genuine persons and in the process it has also to deal with false cases too.

Quiet flows the Verinaag

Three decades back, I had the chance to witness the awe-inspiring, breathtaking charm and pristine beauty of the king of springs Verinaag in Kashmir valley. River Jhelum flows from it with the same stream and same amount of water since centuries irrespective of periodic droughts. I had been witnessing for about five decades, reading in news-papers, watching TV, hearing on radio broadcasts, the similar stream of our countrymen living abroad, coming to their native places with unbridled gusto and enthusiasm. The countryside seemed to be vibrating and happy in their presence. They organised sports melas, circle-style kabbadi matches, constructed stadiums, dispensaries, schools, dharamsalas, got sewerage laid and drains constructed for sullage water disposal, brick- lined the streets and internal drains and ponds, planted trees, brought specialists from abroad for holding health check-up camps and providing free medicines and requisite treatment. Gates were used to be constructed and hundreds of other charitable activities were undertaken in the memory of their ancestors. Government also contributed matching grants for development works.
During the arrival of NRIs, the poor of the villages were the most satisfied beneficiaries as they were the recipients of their largesse and charity. Small towns also felt the economic upsurge during such visits. Unfortunately the rural population of the state had not been economically vibrant for more than a century. For this reason, the peasantry in spite of having large chunks of agricultural lands had to opt for army or other government jobs for living honorably. Luckily for them there were no quota restrictions in the army to which Punjab remained major contributor more than 35 years back. However reduction in land holdings because of division, failing law and order, almost complete unavailability of job opportunities on merit, criminalization and money -minting trends in politics, and better economic and work environment in foreign lands, led to exodus of the population to foreign lands in significant numbers led by Doaba and followed by Malwa and Majha. The prosperity brought about by them was visible in their palatial houses in the countryside. However leaving the country in poor economic conditions with old parents having no one to look after them had never been an easy job. They had to sell their lands, suffer humiliation of relatives in case of intended borrowings, suffer frauds of travel agents with still uncertain and unsafe future.
ajority of the population has migrated in unhappy circumstances and this is the reason their love for their land doubled up when by dint of their hard work and commitment, they earned honorable living not only for themselves but also for their families. By the mid 1990s,the government had become fully conscious of the economic and political clout of the NRIs, as many amongst them had become Ministers, MPs, and top industrialists and the richest in the world .So efforts started to accord them special treatment formally and informally and schemes were chalked out to entice them to invest in the state. NRI sabhas, NRI Commission, NRI police stations, NRI Revenue courts and NRI Nambardars were some institutions which came into being. Some legislative changes in the Punjab Tenancy Act and Urban Rent control Act were also brought about for their benefit. NRI sammelans became big annual events.
Since early 1990s the problem of drugs had started spreading its wings in the rural areas. The successive governments failed to see the gravity of the situation. Resultantly vote seeking politics succumbed to the economic power of drug mafias and left the people at their mercy. The other mafias supported by lose implementation of law and order also helped the rot to speed up. The discerning eyes of the NRIs with constant feedback from the relatives, dissuaded them to invest in the state. So the annual sammelans of NRIs have been discarded and replaced by NRI sangat darshans professedly to sort out their pending issues. The message was clear and the NRIs who fought for the freedom of the country and sacrificed their lives have taken up the challenge and have also expressed their anguish during the tours of ruling politicians of the state in foreign countries. For more than 2 years visibly the vibrancy of the NRIs in the state seems to have substantially dwindled. But the agony of the NRIs is unbearable.
How nostalgic our brethren in foreign lands are about their places of birth, the streets in which they played, the schools in which they studied, the village ponds, the water-channels, the big old peepal and boharh trees, this narrative will tell. In the year 2003,when I was heading the Nawanshehar district, about fifty years old turbaned, very well dressed man accompanied by about 23 years old tall girl from London came to see me. The man was visiting his native place after 27 years and the girl, who was a doctor, had come to Punjab for the first time. They belonged to a nearby village. After usual courtsies, the man said, ''Sir, I have come here after such a long gap, but my brothers have not allowed me to enter my own house, where I was born and where my parents had been living. ''Tears had started swelling in his eyes as he was speaking. The girl interrupted, ''Actually my father was not coming as he was aware of the nature of his brothers. But I insisted to see the place of his birth and the place where my forefathers lived. Look, my uncles did not allow us to enter the house, my father still has share in the joint property and he never even claimed profits from the land''. The gentleman was now in tears. It seemed he did not want his daughter to be witness to this embarrassing and humiliating scenario.. But he respected her emotions for her ancestors. He said, ''sir, we want your help to go inside the house to just see each and every nook and corner and pay respects to our ancestors. My one brother is a Thanedar, he has already threatened me. ''I was just wondering at the purity of the sentiments and also weighing the legal trail of the issue. I called up the SSP and told her the entire situation with my own views to help them. Incidentally she was also a young girl from Hyderabad. As usual overcoming her initial diffidence, assured she would get it done without hassles. Within 10 minutes DSP of the concerned area came. I had already called the SDM. After about four hours, I was informed that they had seen the house to their heart's fill. The brothers also seemed to be in their awe in the presence of the officers. SDM was a God fearing man. He had also asked the person if he wanted partition of the land. But the gentleman still refused as he insisted that he had for long left the claim on it in his heart of hearts.
I was very happy at the outcome. Next morning they came and profusely expressed their gratitude. The tears rolled down uncontrollably. The pen they gifted me still adorns my precious belongings. The spring of emotions of NRIs for their native places and for their ancestors will never dry up like the Verinaag. The governments must understand and the politics should take a detour.

Delay in payment of final bill

The appellant sought reasons for withholding the payment of final bill after completion of the work even though a period of 5 years elapsed and whether final EOT and RE is approved by General Manager's office signaling clearance of final payment of the bill. The Respondent stated that final payment is under process and the same was already intimated to the appellant. On a query by the Commission as to why the payment is not made to the appellant, Respondent stated that the work was awarded in 2005 for Rs. 2 crores and completed in 2008 but the minor works were pending which was completed in 2009. He further stated most of the payment has been made and now only a lumsum of Rs 10 lakh is due for payment. After hearing both the parties and on perusal of record the Commission directs the respondent to provide revised reply giving complete status along with reasons for withholding the payment to the appellant within one week of receipt of this order under intimation to the Commission.

Comments

For commercial disputes, the contractors are frequently using the RTI Act. The officials should be careful about timely processing of claims and the disposal of the bills.
