Ministry of Law & Justice the oldest limb of GoI

The said Act vested for the first time legislative power in a single authority, namely the Governor General in Council. Media in Kerala

The press and media in Kerala are never tired of catering to the decadent tastes of the politically jaundiced Malyalees. The press and media are full of news of the beef festivals being conducted by leftist organisations, basically to cock a snook at BJP and indirectly at devout Hindus. They are full of frontline news of some leftist literary figures returning their Sahitya Academy awards on their sudden awakening of conscience after the odd Dadri incident. Their conscience never burdened them when a lecturer's hand was hacked by Islamic bigots nor when the School authorities kept him on suspension till his retirement nor when his wife committed suicide. They never protested when fatwas were put against writer Taslima Nasrin. But the press and media went gaga a over it. Then came juicy stories of a Swamiji's death that happened more than a decade ago insinuating the involvement of an OBC leader who opened his links with Modi. But what the press and media omitted to give prominence was the outstanding investigative work done by CCF, Amit Malik and his team in unearthing the large scale elephant poaching in Kerala. This is the biggest wildlife crime ever unearthed since the days of Sansar Chand. About 800 kg of tusks have been seized in Delhi and many including kingpins arrested. In the last two years alone, almost 100 tuskers have been reportedly killed in Kerala forests. In any other country this would have been prime news. But not in Kerala. Even the forest minister and the department thought it not worth giving publicity.
The agitation carried out by reportedly forest encroachers against Madhav Gadgil and Kasturirangan reports ostensibily supported by a partner in the present UDF government has practically demoralised the entire forest staff, many of whose offices have been attacked and burnt. This has given a fillip to the poachers who are having a field day today.

CCI invites applications for chairperson

The Competition Commission of India has invited applications for Chairperson with the following qualification:
"As per the Competition Act, 2002 a person of ability, integrity and standing and who has special knowledge of, and such professional experience of not less than fifteen years in, international trade, economics, business, commerce, law finance, accountancy, management, industry, public affairs or competition matters, including competition law and policy, which in the opinion of the Central Government, may be useful to the Commission is eligible for appointment as Chairperson of the Competition Commission of India." It is obvious that the choice will invariably be an IAS officer irrespective of his/her qualifications. Then why this facade of a fair selection process?

Opinion on Balmer Lawrie in Forum


This is with reference to the below mentioned opinion published in the 17th October issue of whispersinthecorridors online under the column "Forum".

Only those bills get delayed in Government which are not correct. Some of the vendors are in the habit of submitting exaggerated bills. In an office the Balmer & Lawrie & Co. used to provide tickets for officials tour. It had been noted that the concerned PRO was also using the facility of BL&Co. to arrange for tickets for the private visits of the senior officials. The company used to claim payments of these personal tickets from the office and was to get cleared. There were a number of tickets of the air travel of the PRO but there was no record to substantiate whether the visit was official or personal. In such a situation is it correct to criticize officials who raise queries over the bill?

However, Balmer Lawrie (BL) wishes to state that delay in payment occurs mainly on account of paucity of funds with the Ministry, and on account of the traveller not having submitted his/her tour claim form, besides the procedure being longish. BL issues tickets based on authorised requisitions to its clients. The authority (authorised nominee of the client) who seeks the booking informs Balmer Lawrie whether the trip is personal, in which case, the billing is done on the individual and the payment / settlement is tracked separately. If it is not explicitly told to BL that the booking is “private”, BL assumes that the trip is official and proceeds to bill the client (BL has no way of checking whether the trip is personal or official). BL claims payments only for those bills which are payable by the client. In fact, some of the clients have questioned us as to why BL is insisting on immediate payment for personal trips.

The insinuation that exaggerated bills are submitted is absolutely wrong and without basis and totally denied.

Minutes of meeting of Empowered Committee of State Finance Minister on GSTN

The appellant asked for the minutes of the meeting of Empowered Committee of State Finance Ministers from January 2010 to till date etc. The FAA directed the PIO to provide extracts of the minutes of the Empowered Committee meeting pertaining to the GSTN. The FAA clarified that the Empowered Committee had taken a decision that the Minutes of the Empowered Committee meeting should be treated as items covered under “not open to disclosure under section 8 of the RTI Act, 2005. It was argued that disclosing the entire minutes of the Empowered Committee meetings will be a breach of parliamentary privilege. The appellant contended that the Empowered Committee is a registered Society and does not perform any sovereign functions. The CIC noted that the Empowered Committee (EC) is deliberating the issue of introduction of the Goods and Services Tax (GST) in the country and that the discussions on the same are intense, resulting in points of views, often, being expressed in closed door meetings of the State Finance Ministers. The PIO has also stated that the decision of the working groups consisting of officers of both the Central and State Governments have been formed to prepare a draft legislation of GST, business process to be adopted in the GST regime and related issues. He has categorically stated that any premature disclosure about the future tax policies could have an adverse effect on the economic interest. The CIC upheld the denial of information.

The introduction of Goods and Services Tax is heralded as the major tax reform initiative. With the advent of participation of the stakeholders in the statute making process, new ways and means have to be found for constructively involving all in such a manner that sharing of information does not itself become a hindrance.
