Colossal credibility crisis

'When Anna Hazare raised the slogan of Lokpal for eradication of nation's evils, majority of the people were sceptical of the demanded Institution's existence and its competence to achieve desired goals, in view of the almost pervert politics. So, the individual slogan raisers gained prominence and the Institution is not yet in sight, nor anyone is asking for it anymore. Since the days of Internal Emergency serious efforts have been afoot to gain political intrusion into the domain of Judiciary for the reasons other than bringing about reforms for better justice delivery system. The main reason for failure of such motivated efforts is the almost complete credibility crisis of the other two pillars of democracy i.e Executive and Legislature. At the same time Judiciary, in spite of some questionable issues, has been able to retain public faith and its inbuilt credibility..The likes of the stalwarts like, late Justice Hans Raj Khanna, the judge of the Supreme Court, who spoke his mind in the historic judgement about the vires of Emergency and sacrifice his illustrious career, added lustre to the judiciary. The efforts to replace Collegium system with NJAC are prima-facie motivated to wrest control of Judiciary to make it subservient, thereby defeating the constitutional provision of Judiciary's independence. It is good that the self scrutiny by the Supreme court to make the Collegium system more transparent and effective will be substantially helpful, instead of replacing it with NJAC. Governments in states and at the Centre have made some rules for filling the Constitutional posts. How the governments have been making those appointments is not beyond even a laymans' comprehension. By making appointments on the criteria other than merit, most of the Constitutional bodies have lost faith of the public and credibility. Here is an example. In the states where the population of Ex-servicemen and serving soldiers is large, some Constitutional institutions get retired Generals as their heads. I know a retired Lt General, who wanted to get appointment as chairman of a public service commission. He had some political relatives, who approached the keyman for such appointments. That keyman, after listening to his very well-known politicians said, ''Baaki ttan sabh theek a, par jarnail sahib jitthe kawange angutha laounge? (well, will the General sahab put his thumb impression wherever they wanted?)''So in the current political scenario,control of judicial appointments should remain with the judiciary.

"Collegium v/s NJAC"

In terms of Apex Court's verdict, the collegium's recommendations will be required to be submitted to the President, who acts on the aid and advice of Union Council of Ministers i.e the political Executive. Selection of judges of high courts and Supreme Court involves search for essential core qualities in judges in a transparent manner. Making 360 degree appraisal of aspirants' credentials through NJAC, is the best option. The in-house mechanism would be opaque, fraught with biases and prejudices. The impasse must be resolved with Presidential intervention as otherwise the "sovereign people of India" will continue to suffer due to judicial delay caused by vacancies in high courts and Supreme court. About 3 crore cases are reportedly pending in courts across the country. This is no time for confrontation, debates and political wrangling.

Attitude of senior officers

One of the ills which is plaguing the development of the country is the feudalistic attitude of Senior Officers in the Ministries/Departments. Why should a junior official enter the room of his Joint Secretary, Additional Secretary and Secretary with fear? Why should the Senior Officials not entertain the sporting advice of their juniors? Why should the Senior Official not have trust in his juniors, when he says so? Why should there not be any training senior officers as to how they should they behave with subordinates? In this era the carrot stick policy will not work. You will have to work in cooperation. By being feudalistic and ferocious you only make yourself unpopular. At the time of transfer/retirement people don't give you farewell. When people see you in the market/streets, they look at you with disdain. The ACR/APAR system is ruining this country wherein the junior even if he is right has to keep quite. We should have a system of performance review which is quantitative nature only which includes punctuality, energy, dynamism etc. also.

DATE WITH RTI

Minutes of meeting of Empowered Committee of State Finance Minister on GSTN

The appellant asked for the minutes of the meeting of Empowered Committee of State Finance Ministers from January 2010 to till date etc. The FAA directed the PIO to provide extracts of the minutes of the Empowered Committee meeting pertaining to the GSTN. The FAA clarified that the Empowered Committee had taken a decision that the Minutes of the Empowered Committee meeting should be treated as items covered under “not open to disclosure under section 8 of the RTI Act, 2005. It was argued that disclosing the entire minutes of the Empowered Committee meetings will be a breach of parliamentary privilege. The appellant contended that the Empowered Committee is a registered Society and does not perform any sovereign functions. The CIC noted that the Empowered Committee (EC) is deliberating the issue of introduction of the Goods and Services Tax (GST) in the country and that the discussions on the same are intense, resulting in points of views, often, being expressed in closed door meetings of the State Finance Ministers. The PIO has also stated that the decision of the working groups consisting of officers of both the Central and State Governments have been formed to prepare a draft legislation of GST, business process to be adopted in the GST regime and related issues. He has categorically stated that any premature disclosure about the future tax policies could have an adverse effect on the economic interest. The CIC upheld the denial of information.

Comments


The introduction of Goods and Services Tax is heralded as the major tax reform initiative. With the advent of participation of the stakeholders in the statute making process, new ways and means have to be found for constructively involving all in such a manner that sharing of information does not itself become a hindrance.
