CPWD organises seminar on 'Preventive Vigilance as a tool of Good Governance'
The Vigilance Commissioner, Central Vigilance Commission, Rajiv on Tuesday
praised the efforts made by the Vigilance Unit of CPWD towards implementing
various preventive vigilance measures to bring about more transparency
and accountability in the organisation.
He was speaking as a Chief Guest at a Seminar cum interactive session
organized for all seniors officers of CPWD focusing on the main theme
of the Vigilance Week "Preventive Vigilance as a tool for Good
Governance" held at Nirman Bhawan, New Delhi.
Rajiv has also emphasized the importance of creating the right environment
in the organisation which is conducive for honest and sincere working
besides inaugurating the upgraded web page of the Vigilance Unit provided
in the CPWD web site.
CPWD is observing the Vigilance Awareness Week from Oct 26 to Oct 31,
2015 in the Directorate and in all the field offices spread across the
country.
M.R. Krishna, CVO, CPWD give a detailed presentation of various preventive
vigilance measures implemented by the Vigilance Unit. He also explained
in detail various systematic improvements implemented by the Vigilance
Unit. Digital technology and information technology are being leveraged
to a large extent to bring transparency in the procedures and systems.

Vigilance Awareness Week 2015 is being observed by HUDCO from October

Who Appoints Judges: A Significant Debate
Let us read the text from Art 124 first:-
Quote "Art 124 (2) Every Judge of the Supreme Court shall be appointed
by the President by warrant under his hand and seal after consultation
with such of the Judges of the Supreme Court and of the High Courts
in the States as the President may deem necessary for the purpose and
shall hold office until he attains the age of sixty-five years: Provided
that in the case of appointment of a Judge other than the Chief Justice,
the Chief Justice of India shall always be consulted: Provided further
that- "Unquote
The SC judgement on the NJAC swaps President by CJI in effect. It tends
to Read: The judge shall be appointed by the CJI in consultation with
the President. Is it possible to disturb the syntax in ART 124 of the
Constitution of India?
There is need to build trust between the judiciary and the executive.
Both have some of the finest brains of the country, the legal luminaries
of the nation and men of the highest integrity. Arraigning one or the
other for lack of any of these cardinal qualities is expression of distrust
between the two. It is necessary to bridge this chasm. What if a former
CJI became the President of India one day? As President, the former
CJI, may find the recommendations made by the incumbent CJI in consultation
with the Collegium unacceptable. In the absence of unshakeable trust
between the judiciary and the executive, such a climate shall prevail
forever. This will deprive the country of the services of the best persons
on the bench. Judges are respected for their honesty due to the hearings
in open courts, ably assisted by legal luminaries. They can ill afford
to be anything else but honest and fair. And still they do err at times
on facts as well as law, which gets corrected in appeal; sometimes making
a life & death difference. The Collegium system is an extra-constitutional
mechanism which is opaque, but the NJAC is going to be transparent.
It (NJAC) can be further strengthened. In the long run, the NJAC alone
is going to prove to be the right choice. However, it is likely that
the SC might be aware of these points and still withheld clearing the
NJAC as a short term measure for some other considerations.

Streams of legal services
From my 40+ years experience in the Government of India at various capacities,
my observation is that there are three different streams of legal services.
One, framing Bills, Rules and Acts (mainly done in Legislative Department),
two, interpretation of those Rules and Acts to decide cases (the judiciary);
and three, using the Rules and Acts to put forward their cases (the
lawyers, advocates). Like Indian Revenue Service (Customs & Central
Excise) and Indian Revenue Service (Income Tax), three different types
of All India Judicial Service will be required. While the judiciary
and lawyers' roles are similar to some extent, the legislative role
is entirely different. An officer from one stream may feel unfit in
another stream.

Minutes of meeting
of Empowered Committee of State Finance Minister on GSTN
The appellant asked for the minutes of the meeting of Empowered
Committee of State Finance Ministers from January 2010 to till
date etc. The FAA directed the PIO to provide extracts of the
minutes of the Empowered Committee meeting pertaining to the GSTN.
The FAA clarified that the Empowered Committee had taken a decision
that the Minutes of the Empowered Committee meeting should be
treated as items covered under not open to disclosure under
section 8 of the RTI Act, 2005. It was argued that disclosing
the entire minutes of the Empowered Committee meetings will be
a breach of parliamentary privilege. The appellant contended that
the Empowered Committee is a registered Society and does not perform
any sovereign functions. The CIC noted that the Empowered Committee
(EC) is deliberating the issue of introduction of the Goods and
Services Tax (GST) in the country and that the discussions on
the same are intense, resulting in points of views, often, being
expressed in closed door meetings of the State Finance Ministers.
The PIO has also stated that the decision of the working groups
consisting of officers of both the Central and State Governments
have been formed to prepare a draft legislation of GST, business
process to be adopted in the GST regime and related issues. He
has categorically stated that any premature disclosure about the
future tax policies could have an adverse effect on the economic
interest. The CIC upheld the denial of information.
Comments
The introduction of Goods and Services Tax is heralded as the
major tax reform initiative. With the advent of participation
of the stakeholders in the statute making process, new ways and
means have to be found for constructively involving all in such
a manner that sharing of information does not itself become a
hindrance.
