Who is trying to scuttle ED transfer policy?
Enforcement Directorate (ED) has drafted its first transfer policy but
as sources feared, it is doubtful to be implemented. Reason is said
to be some insiders' lobby that is trying hard to scuttle the move.

Creation of four posts of Directors for four

The Union Cabinet chaired by Prime Minister Narendra Modi, has approved
the creation of four posts of Directors for four new National Institutes
of Design (NIDs) at Kurukshetra (Haryana), Bhopal (Madhya Pradesh),
Jorhat (Assam) and Vijayawada (Andhra Pradesh). The Cabinet had already
approved financial implications including salaries, for setting up of
these new NIDs in its meeting held in February, 2014.

Union Defence Minister Manohar G Parrikar on Wednesday released a book
titled "RAKSHA : BANDHAN - PRABANDHAN" authored by Dr. RK
Tyagi, former Chairman, Hindustan Aeronautics Limited. The book written
in Hindi language carries some of his experiences while managing giant
Navratna - Hindustan Aeronautics Limited. The focus of the book is on
time management and risk taking under constraining circumstances of
a defence PSU. Special focus has been on indigenization and skill development.
Just a few days back Prime Minister Narendra Modi while inaugurating
the 10th World Hindi Sammelan emphasized the need for writing in Hindi
specially on subjects of technology and science. The book is a humble
step in this direction.

P C Jhamnani, then Engineer; S N Jha, then Assistant Foreman, all from
Bharat Heavy Electricals Ltd (BHEL) and Anil Kumar Goel (private person)
U/s 120-B, 420, 467, 471 of IPC and 477A(IPC) r/w Section 13(2) r/w
13(1)(d) of PC Act, 1988 for causing loss to the government exchequer.
V C Ramulu, O P Sharma, Denis Barnabas, P C Jhamnani, all from BHEL
& Anil Kumar Goel (private person) have been sentenced to undergo
five years simple imprisonment with fine of Rs.5 lakh each and S N Jha
to undergo 3 ½ years simple imprisonment with fine of Rs. 2 lakh
& P L Khadala to undergo four years simple imprisonment with fine
of Rs.3 lakh.CBI had registered the case on August 1 1995 against V
C Ramulu, then DGM, BHEL and others on the allegations that the accused
persons in conspiracy with Anil Kumar Goel, private person cheated BHEL
in the passing of bills for fixing of 242 ceiling fans at Noida township
of BHEL.

NBCC holds AGM; PAT
surges by 8.09% (UPDATED)
The 55th Annual General Meeting (AGM) of NBCC, a Schedule 'A' Navratna
CPSE under the Ministry of Urban Development, Govt. of India, and a
State owned Construction Giant, was held in New Delhi on September 16,
2015. Addressing the Annual General Meeting, Dr. Anoop Kumar Mittal,
Chairman-cum-Managing Director of NBCC, gave a detailed account of the
company's performance for the FY 2014-15, its operations in various
segments of business and also future outlook. Dr. Mittal stated that
the Company, during FY2014-15, registered 15% growth in its Turnover
from Rs.4038 Crores to Rs.4633 Crores. Its EBITA Margin increased from
Rs.371.53 Crores to Rs.433.09 Crores and PAT from Rs.257.45 Crores to
Rs.278.28 Crore. He also informed that NBCC's outstanding Order Book
stood at more than Rs.25000 Crores. Giving an outlook of NBCC's future
initiatives, Dr. Mittal said that NBCC's future initiatives would include
its major participation in the Govt's ambitious schemes such as Housing
for all by 2022, Development of 100 Smart Cities in the Country and
AMRUT. In this context, he mentioned about some concrete steps already
taken by the Company as a part of its preparation for the involvement
in above activities, such as signing of several JV MoUs both at home
and overseas with various renowned companies for technology sharing
(ii) setting up of independent and dedicated in-house department to
specifically attend to smart city initiatives, (iii) establishing of
Research & Development Centre in association with IIT Roorkee for
technology upgradation and innovation in construction activities. Dr.
Mittal also divulged the Company's future plans to (I) Launch an e-Commerce
enabled G-2-G Portal to assist Government agencies in procurement and
management of Real Estate properties (ii)Roll out a housing scheme with
various stakeholder-agencies of Government towards providing houses
to the poor without any financial burden on the Government (iii)Act
as Lenders' Engineers to carry out valuation and monitoring of loans
for timely intervention by the Financial Institutions.

Commissioner for Industrial Development & Director of Industries
& Commerce Gaurav Gupta.
Following are the excerpts :
Q: What is your mission as far as industrial
sector in Karnataka is concerned ?
A: Karnataka is industrially most forward State. It is home for more
than 700 MNCs. State is known for salubrious climate, excellent human
resource, R & D base.
Government of Karnataka has decided to conduct Invest Karnataka - 2015
event from November 23 to 25, 2015 at Bangalore Palace grounds to showcase
the investment opportunities in the State. This will help to attract
investors across the globe to a great extent.
New Industrial Policy 2014-19 of the Government aims to build prosperous
Karnataka through inclusive, sustainable and balanced industrial development
thereby creating large employment opportunities. My mission is to place
Karnataka at the top as most preferred destination in the country.
Q: How do you rate the overall performance of
Karnataka industries ever since you assumed office?
A: Since 2013, we have approved 368 projects through single window
mechanism with an investment of Rs.98,659 crores generating employment
for 2.31 lakh people. This clearly shows that State is industry friendly
and overall performance is quite satisfactory.
Q : Would you like to elaborate on few of your
top priorities?
A: After assuming charge as Commissioner I was instrumental in bringing
New Industrial Policy of the State. Our focus is on improving Ease of
Doing Business in Karnataka. We facilitate investors to implement the
project with least lead time. Now, we are working towards making Invest
Karnataka - 2015 as a most successful event.
Q: Any pockets of stress ? And if so, what mechanism
you have to curb it ?
A:No constraints. State Government is committed for industrialization
of the State.
Q: What is your R & D strategy ?
A:We are creating an investor - friendly environment to ensure Ease
of Doing Business in Karnataka. Like single window mechanism, on-line
payment of prescribed fees and online approvals and clearances from
other related Departments / Agencies also.

Secy DOPT must be alert
Present Secretary, DOPT has been a very vocal supporter of RTP and
he has done his best but alas there are some instances which need to
be looked into. Recently a list of PPS of CSSS was put on website to
seek their preferences and the date of submission of preferences is
18.9.2015. But DOPT knows that there are a few high and mighty in both
lists (A & B) and these are from Health, Environment, Finance, Home
and some other serving with Secretaries offices. Most of them have already
finalised their Ministry and place of postings as well i.e Revenue will
go to UD and visa versa. When DOPT have a rule that one cannot work
more than 10 years in a Secretary office than why don't they indicate
that they should not be posted with Secretary's office in future. Secondly
most of them will go to their place of Ministry but will come back on
loan basis to their offices where they have been for the last 20 plus
years. These are the persons who are privy to all sensitive Hope Secretary,
DOPT, looks into all these maneuvers by these highly placed officials.

Din over Revenue secy post
There is quite a din on your channel about higher service officer required
for the post of Revenue Secretary to bring a "fresh perspective",
"whiff of fresh air" etc to the Revenue Department and avoid
retrospective amendments, tax terrorism etc. First, the IAS is not a
higher service than the IRS. It is a similarly placed service selected
through the same examination with 50% officers having ranks lower than
50% of the members of the IRS. Next, all the things collectively being
referred to as "tax terrorism" have been "perpetrated"
with an IAS officer as Revenue Secretary at the helm! Where is the whiff
of fresh air being bandied about? Retrospective amendments though actually
clarificatory, were also carried out by the Revenue department with
an IAS officer at the helm as Revenue Secretary! So, it is amply clear
that Revenue Secretaries from the IAS have actually guided "tax
terrorism" and retrospective amendments. Thus, it is clear that
what is actually required to bring in "a whiff of fresh air"
is a genuine outsider to the Department of Revenue, viz. from the Corporate
world. The person should have a track record of integrity and should
understand direct and indirect taxation of the Central Government, which,
by the way, any IAS officer as Revenue Secretary would not, never having
had any exposure to either income tax administration or customs, excise,
service tax administration. Not only the Revenue department, other departments
also need whiffs of fresh air. All of them need genuine outsiders to
bring in necessary fresh air, none should be headed by the IAS officers
whose world view is old, narrow, rigid, bureaucratic, corrupt etc and
all should be headed by top people with adequate exposure from the Corporate
world.

No harm if IRS officer is Revenue Secy
Work in the Department of Revenue is a specialized work and the civil
servants who are specialized to handle such work are IRS officers. Earlier
we had non-IRS officer as Revenue Secretary, even now also. IRS officers
simply implement the rules and regulations enacted in the Parliament.
So I do not see any harm to the country if India has IRS officer as
Revenue Secretary. They should also get a chance!

Futile views over anonymous complaints
We are having some futile expression of views regarding treatment of
anonymous or pseudonymous complaints. After promulgation of Whistleblowers
Act such complaints can't be entertained. So, the likes of Saxena and
others can treasure whatever pearls of wisdom that they have.

No spirit of service
Woh pareshan karte rahe, hum kaam karte rahe; then how come dengue
acquired such menacing proportions this year in Delhi? Were preventive
measures taken adequately? Was sufficient fumigation and destruction
of mosquito breeding sites carried out? A simple prognosis would have
been sufficient to show that a rise in dengue prevalence could be expected
this year, since dengue peaks every four five years. To govern does
not mean only politicking and trying to score points over needless issues
in a bid to acquire more power over Police etc, it means a spirit of
service, which may sadly be lacking in all concerned.

" CGHS - How to improve its services ".
A few more suggestions for improving CGHS services. Instal CCTVs at
all CGHS Wellness centres. Let the Health Ministry's mandarins make
surprise checks at dispensaries and zonal offices instead of remaining
fixtures at offices. The conduct of the spouse of Additional Principal
Secretary to PM, by insisting on waiting in queue ( "An unbelievable
story ", WIC, dt Sept 15 ) is exemplary . CGHS doctors, though
quick at diagnosis, are curt. The pharmacists behave as though they
are doing a favour to patients. Their nexus with CGHS vendors (Wholesale
suppliers of medicines) is not for free but unmentionable considerations.
A big scam of public money is crying for attention of CBI. Let this
post be treated as Whistleblower's call.

Biodiversity conservation
MOEF and CC is least bothered about biodiversity conservation. Chairman
NBA post is lying vacant since one and half year. Office is at Chennai
and Hem Pandey is looking from Delhi. Interview was conducted in May
2015 but they could not decide on the post in 4 months. This speaks
volumes about working and apathy. Government of India losing Rs 10,000
crore every year due to non-implementation of BD Act 2002 due to absence
of full time chairman. All states together are losing Rs 25,000 crore
every year. Money should have come from MNCs working in bio-resoures
of India. This would have helped Rupee to be strong against Dollar,
because we are not taking revenue share from these MNCs as per BD Act
2002. Minister is in the dark about this act. PMO is being befooled
by bureaucrats of MOEF.

Recovery from a deceased employee
The Appellant's husband was the Manager of a Branch of a Bank.
After he passed away, the bank recovered some money from the amounts
due to him on the ground that he had been involved in some frauds.
The Appellant sought information regarding the action taken by
the bank to recover some amount from the dues of her late husband
and related issues. The information about the deposits of third
parties in respect of which recoveries were made from the her
husband's dues, action taken against third party employees and
an inspection report of the bank was denied under Section 8 (1)
(e) and (j) of the RTI Act. The CIC noted that no departmental
enquiry was initiated against the deceased officer as he had already
expired when the fraud was detected. Had he been alive, he would
have got some of the information, in the course of an enquiry
that would have been conducted against him. The CIC held that
since his dues, which would have come to the Appellant as his
widow, have been adjusted against the amounts, allegedly misappropriated
by him, the Appellant should at least be given the information
about the basis on which the above action was taken. The CIC directed
the PIO to provide a certified copy of the notings / report(s)
of the bank leading to the recoveries from the dues applying severability
under Section 10 of the RTI Act.
Comments
Whenever any action is taken against an individual, an opportunity
of hearing should be provided to him. Unilateral action where
any benefit is denied to an individual or his dependent, is likely
to be challenged in a court of law.
