If Ministry of Law and Justice go by seniority then seniormost additional
secretary TN Tiwari will be appointed new Secretary, Legislative Affairs.
Presently he is posted in the Legal Department.
Ajay Damle to succeed Sanjay Bandopadhyay ?
Ajay Damle is likely to succeed Sanjay Bandopadhyay as Joint Secretary,
Road Transport and Highways. He is a 1989 batch IRS (IT) officer. Name
of a Haryana cadre IAS officer is also in circulation for the post.
Now number of ACS officers is 20 in Haryana

Restructuring of I-T Department started
The government has started restructuring of the Income Tax Department.
A cadre restructuring of the Income Tax Department was approved by the
Government in May, 2013. The restructuring exercise has gathered momentum
this year with the Department moving towards filling-up posts at various
levels. Recently promotion of 153 IRS officers to the rank of Commissioners
of Income Tax is said to be the first step in this direction. The Department
will be able to address the shortage of officers at various stations
to a significant extent. These officers will be deployed in posts primarily
dealing with matters of dispute resolution. It is expected that with
these postings, the Department will be able to address the backlog of
taxpayers' appeals and offer better services to the taxpayers in the
field offices.
UIDAI will have administrative control of IT
The Unique Identification Authority of India (UIDAI) has been shifted
to the administrative control of Ministry of Communication and Information
Technology from NITI Aayog.
In UPA government, he handled maintenance of copter in Gujarat !
Now it is known that when RK Tyagi was the CMD of Pawan Hans in the
UPA government, he handled operation and maintenance of helicopter of
Gujarat government being used by the then CM Narendra Modi from October
2007 to March 2011 . Tyagi used to coordinate with Atanu Chakraborty
and Ajay Chauhan.

MP Tourism bags six National Awards for Tourism
MP Tourism has been awarded six National Awards for Tourism out of 12
for the outstanding work in the field of Tourism. Ministry of Tourism
Government of India has Judged MP Tourism as a best and outstanding
Corporation in the various categories. President Pranab Mukherjee and
Union Minister for Tourism, Mahesh Sharma gave away the six National
Tourism Awards to State Tourism Minister, Surendra Patwa and ED of MPSTDC,

Irrigation Project
Work completion and handing over certificate of Champassack Irrigation
project was presented by Mr. Maykong PHONEPHOMMAVONG, Director General,
Department of Irrigation, Ministry of Agriculture and Forestry Lao PDR
to R K Gupta, Chairman Cum Managing Director, WAPCOS Limited in a ceremony
at Presidential Palace "Ho Kham", Vientiane, Lao PDR in the
gracious presence of H.E. Mohammad Hamid Ansari, Vice-President of the
Republic of India and H E Bounnhang VORACHITH, Vice President of Lao
PDR during the visit of Vice President of the Republic of Indiato Laos
on September 18, 2015. The ceremony was also attended by Sanwar Lal
Jat, Minister of State, Ministry of Water Resources, River Development
and Ganga Rejuvenation, Government of India, Members of Parliament,
Secretary (East), Anil Wadhwa and Additional Secretary Mrs. Monika KapilMohta,
Ministry of External Affairs, Government of India and other senior officers
and delegates from India. Six large irrigation schemes namely Savang,Sakmuang,
Thaphosy,Somhong,Ban He and Muangsen Irrigation Schemes have been developed
in this project. Total cost of the project is 17.34 M USD.This project
will serve 17 villages in 6 districts of Champassack province, with
a total command area of 5953 hectares. Earlier, there was onlyone cropgrown
by the farmers during rainy season, with these new schemes now operational,farmers
shall be able to harvest 2-3 crops per year.This Project will immensely
contribute towards Socio Economic Growth of Lao PDR.

'NTPC a stellar performer, powering India's
growth' (UPDATED)
A K Jha, CMD, NTPC , U P Pani, Director ( HR), S C Pandey, Director
Projects , K Biswal, Director Finance and K K Sharma, Director Operations
interacted with media persons today in New Delhi. Speaking on the occasion,
A K Jha, CMD informed that NTPC is the largest power producer in India
in terms of both installed capacity and generation, with aggregate installed
capacity of 45,548 MW (including 39352 MW through directly owned units
and 6,196 MW through Subsidiaries and Joint Ventures) as on September
10, 2015. In addition, the Company has a capacity of 23,004 MW which
is under different phases of completion as on date. NTPC's capacity
excluding renewable but including capacity of Subsidiary and Joint Ventures
represented market share of 18.77% of India's total installed capacity
and we generated 260.58 billion units of power, representing market
share of 24.95% of India's total power generation in fiscal 2015. K
Biswal, Director ( Finance ) NTPC said that NTPC has a history of creating
records in regard to tax free Bonds. Earlier issue in December 2013
was oversubscribed by 3.67 times and we had to pre-close the issue.
NTPC has already issued Rs 300 crore on private placement basis to institutional
investors which received an overwhelming response and the issue was
oversubscribed by 7.25 times The issue opening date is 23rd September
2015, Wednesday. The balance amount of Rs 700 crore is being raised
through public issue. 40% i.e. Rs 280 crore is reserved for allocation
to retail category. The issue is managed by 4 reputed Lead Managers
- AK Capital, Edelweiss Financial, Axis Capital, SBI Capital and the
consortium members - AK Stockmart, Edelweiss Securities, SBICAP Securities.
The legal advisor to the issue is a leading legal firm - AZB & Partners.
There are three tenures 10, 15 and 20 years. The investors are classified
under two categories retail and non-retail. The non retail category
consists of QIBs, Corporates and HNIs.
NLC HR Director, Acharya lays foundation stone
for class rooms for school (UPDATED)
Sarat Kumar Acharya, Director (HR), NLC, laid the foundation stone morning
for the construction of four class rooms under its Corporate Social
Responsibility (CSR) initiatives, at an approximate cost of Rs.30 Lakh
for Saraswathy Vidyalaya in Utthangal Mangalam Village, near Neyveli.
'Vidya Bharathi' an voluntary organization running schools, all over
the country, is running a school, Saraswathi Vidhyalaya in Utthangal
Village, near the Second Mine of Neyveli. The school is imparting education
between LKG and 5th Standard and the school has a strength of 300 pupils.
Majority of them being the wards of NLC Contract Employees. Free education
is being given to economically weak students. NLC had conceded to the
request of the management of this school for additional class rooms.
Accordingly, the Corporation will construct four additional class rooms
at an approximate cost of Rs.30 Lakhs. The foundation stone laying for
this work was done by Sarat Kumar Acharya, Director (HR),NLC, this (21.09.2015)
morning in the presence of N Muthu, ED(HR&CSR), S Sridhar, GM (PR&Education),
M Karthikeyan, GM(CSR) and senior officials of CSR wing. In his address,
the Director said "Education is the important agenda of NLC CSR
activities. Hence, the fund allocation is done accordingly". Acharya
further said that "NLC is contributing for the economic upliftment
of the people of its peripheral villages under CSR, there by the Development
of Nation."

IRS officer as Revenue Secretary
The suggestion made in this column to anoint an IRS officer as revenue
secretary is devoid of any logic or reasoning. A Taxman can never be
an administrator much less a development oriented agent which is the
hallmark of IAS. With his rigid outlook and vigilant mind an IRS may
bring to halt the smooth functioning of tax administration. His contribution
to tax terrorism in the last decade cannot be forgotten so easily. The
present dispensation cannot afford to risk the next general elections.
The IRS is now known only for failures in International Taxation as
well as domestic taxation when their unprofessional tax demand orders
are struck down at various courts. The Judicature has to go out of the
way to confirm certain Tax demands which otherwise needs to be thrown
out. The Tax officers are too busy to get their promotions and target
a few honest officers by misusing vigilance directorate. No other service
is there with an instance of four batches of IRS officers promoted to
the post of commissioners. Any administrative authority would ensure
a gap between each batch before promotion to maintain the seniority
rule. How can an IRS officer administer the Tax Machinery ?

The time has come to have a revenue secretary-neither from the IAS or
IRS. He should be well-versed in both the taxes, preferably an eminent
academician in the mould of Prof Kelkar or Prof. Shome....that will
give a fresh perspective...

I read with interest the logic of KP Singh regarding the necessity
of a non IRS revenue secretary to ensure the momentum in tax regime.
On this logic, IRS officers must also be posted as tourism secretaries,
home secretary, telecom secretary, etc. to ensure that the people of
India get service and not snobbish administration in which even an IAS
probationer feels that he is true ruler of this great country. I wish
I could provide you the videos of how they talk and behave and if the
Prime Minister sees that he will recommend disbanding this service .

Fresh air by political executives
About the posts of Secretary being manned by the IAS/ IRS etc, one thing
which is being overlooked in the current debate on your esteemed channel
is that fresh air is never brought in by Secretaries to the Government,
who are bound to be bureaucratic. Fresh air is brought in by the political
executive, as contemplated in the Constitution of India. As everyone
is aware, e.g. the Finance Ministers of the country have been outstanding
men of affairs, to mention a few from the recent past, from P Chidambaram
to Pranab Mukherjee to Arun Jaitley. They are all exceptionally intelligent,
learned, well experienced in public affairs and sound leaders. They
are supposed to guide the decision making and they do. In our democracy,
the role of Secretaries in bringing in new ideas etc is extremely limited.
To attribute more to the Secretaries than they deserve would be doing
a disservice to our democracy.

Development in CPMF
In the din of Affairs a la Indrani, OROP and now the elections in Bihar,
the media seems to have lost sight of one major development in r/o the
Central Para Military Forces. The High Court of Delhi in its Landmark
judgment in S S Guleria and other vs. UOI and others and 6 other related
Writs has ruled that the Officers Cadres of all these CPMF are organized
services like any other Group A service of the Govt of India. This will
go a long way in enhancing the morale of these gallant officers who
are faced with war like situation every day be it on the borders or
in internal security while countering militants and extremists.
These officers were so far neither getting the benefit of promotion
because all promotions in CPMF are vacancy based and the pyramid is
so steep that very few can hope to reach beyond the rank of Commandant
i.e. SSP in civil Police or Col in Army. Moreover these officers were
also faced with early retirement because the retirement age for the
CPMF is 57 years up to the rank of Commandant. Thirdly, these officers
were also not getting the benefit of non functional upgradation of pay
because they are not recognized as Organized Service/ Cadre. Now armed
with the court order that the Govt is ignoring its own orders/instructions
which recognize thee cadres as organized service since 1986, these officers
are hopeful that their treatment as third class citizens by Govt will
end and they will soon be extended the benefits long due to them.

Non-performing latecomers beware
Govt of India is proposing strict action for non performing late comers
to the extent that they could be out of job. What about the performance
of ministers. For appointing chairman NBA the post is vacant for one
and half year and interview has been taken in may2015 but they could
not order in four and half month ,is it the performance. For such an
important issue like biodiversity conservation which is closely link
with climate change and development of our country govt of India is
not bothered. MoEF ministry is not serious and its performance is in
question.PMO is kept in dark and it seems that ministers and bureaucrats
are not afraid of PM now and they started functioning like before just
like in congress regime.

Recovery from a deceased employee
The Appellant's husband was the Manager of a Branch of a Bank.
After he passed away, the bank recovered some money from the amounts
due to him on the ground that he had been involved in some frauds.
The Appellant sought information regarding the action taken by
the bank to recover some amount from the dues of her late husband
and related issues. The information about the deposits of third
parties in respect of which recoveries were made from the her
husband's dues, action taken against third party employees and
an inspection report of the bank was denied under Section 8 (1)
(e) and (j) of the RTI Act. The CIC noted that no departmental
enquiry was initiated against the deceased officer as he had already
expired when the fraud was detected. Had he been alive, he would
have got some of the information, in the course of an enquiry
that would have been conducted against him. The CIC held that
since his dues, which would have come to the Appellant as his
widow, have been adjusted against the amounts, allegedly misappropriated
by him, the Appellant should at least be given the information
about the basis on which the above action was taken. The CIC directed
the PIO to provide a certified copy of the notings / report(s)
of the bank leading to the recoveries from the dues applying severability
under Section 10 of the RTI Act.
Comments
Whenever any action is taken against an individual, an opportunity
of hearing should be provided to him. Unilateral action where
any benefit is denied to an individual or his dependent, is likely
to be challenged in a court of law.
