Debate - Future of AAP after internal bickerings
?
Aam Aadmi Party's (AAP's) recent mammoth victory in Delhi was a super-landslide
(the winning party securing 90 percent or more seats). Even the Congress
which had the natural advantage of leading the freedom struggle successfully
and had stalwarts like Mahatma Gandhi, Jawaharlal Nehru and Indira Gandhi
could never achieve it in any general election despite dominating the
political scene in the country post independence. The rise of the Aam
Aadmi Party indicated that people once again saw politics as an act
of faith and hope but given the bickerings among its leaders in too

A hilarious example of what bureaucracy can do.
A Team comprising of a Writer, a Director, a Producer, etc applied to
the Government of India for financial assistance with the script to
produce a Movie on Mahabharata.
All of them committed suicide later and the reason will be very obvious
once you have read the reply from Govt.

Ref: Film story submitted by you, regarding financing of films by Government
of India , Your letter dt. ............ . ......... .
The undersigned is directed to refer the above letter and state that
the Government has examined your proposal for financing a film called
''Mahabharat' . The Very High Level Committee constituted for this purpose
has been in consultation with the Human Rights Commission, National
Commission for Women and Labour Commission, in addition to various Ministries
and State Governments and have formed definitive opinions about the
script. Their observations are as below:
1. In the script submitted by you it is shown that there were two sets
of cousins, namely, the Kauravas, numbering one hundred, and the Pandavas,
numbering five. The Ministry of Health and Family Welfare has pointed
out that these numbers are high, well above the norm prescribed for
families by them It is brought to your kind attention that when the
Government is spending huge amounts for promoting family planning, this
will send wrong signals to the public. Therefore, it is recommended
that there may be only three Kauravas and one Pandava.
2. The Ministry of Parliamentary Affairs has raised an issue whether
it is suitable to depict kings and emperors in this democratic age.
Therefore, it is suggested that the Kauravas may be depicted as Honourable
Members of Parliament (Lok Sabha) and the Pandava maybe depicted as
Honourable Member of Parliament (Rajya Sabha). The ending of the film
shows the victory of the said Pandavas over the said Kauravas. The ending
may be suitably modified so that neither of the Honourable Members of
Parliament are shown as being inferior to the other.
3. The Ministry of Science and Technology has observed that the manner
of birth of Kauravas is suggestive of human cloning, a technology banned
in India . This may be changed to normal birth.
4. The National Commission for Women has objected that the father of
Pandavas, one Sri Pandu is depicted as bigamous, and also there is only
one wife for the Pandavas in common. Therefore suitable changes maybe
made in the said script so that the said Sri Pandu is not depicted as
bigamous. However, with the reduction in number of Pandavas as suggested
above, the issue of polyandry can be addressed without further trouble.
5. The Commission for the Physically Challenged has observed that the
portrayal of the visually impaired character 'Dhritharastra' is derogatory.
Therefore the said character may not be shown as visually impaired.
6. The Department of Women and Child Development have highlighted that
the public disrobing of one female character called 'Draupadi' is objectionable
and derogatory to women in general. Further the Home Ministry anticipates
that depiction of such scenes may create law and order problem and at
the same time invite strong protests from the different women forums.
Such scenes may also invite penal action under SITA (Suppression of
Immoral Traffic Act), therefore they may be avoided and deleted from
the film.
7. It is felt that showing the Pandava and the Kauravas as gamblers
will be anti-social and counter-productive as it might encourage gambling.
Therefore, the said Pandava and Kauravas may be shown to have engaged
in horse racing. (Hon. Supreme Court has held horse racing not to be
gambling)
8. The Pandavas are shown as working in the King Virat's employment
without receiving any salary. According to the Human Rights Commission,
this amounts to bonded labour and may attract provisions of The Bonded
Labour System (Abolition) Act, 1976. This may be corrected at once.
9. In the ensuing war, one character by name Sri Abhimanyu has been
shown as fighting. The National Labour Commission has observed that,
war being a hazardous industry, and the said character being 16 years
old, this depiction will be construed as a case of child labour. Also
there is no record of his being paid any compensation. This may also
be deemed to be violatory of the provisions of The Child Labour (Prohibition
and Regulation) Act, 1986 and Minimum Wages Act, 1948. Such references
in the film may be removed.
10. The character 'Sri Krishna' has been depicted as wearing a peacock
feather. The peacock is our National Bird and wearing dresses made from
peacock feather is an offence under the Wild Life Protection Act, 1972.
This may not be depicted.
11. Smt Maneka Gandhi has raised very serious objection for using any
elephants or horses in war scenes, since there is every scope for mistreatment
and injury to the said animals. The provisions of the Prevention of
Cruelty to Animals Act, 1890 and Prevention of Cruelty to Animals (Amendment)
Act, 1960 would be applicable in the instant case. Suitable changes
may be made in the script to address the objections raised.
12. In pursuance of the Memorandum of Ministry of Finance regarding
austerity measures, it is informed that in the battle field sequences,
only ten soldiers may be allowed for each side. Also, all the characters
may be shown to have obtained a valid licence under the Arms Act, 1959
as well as the Indian Arms Act, 1878.You are therefore requested to
modify the script along the lines indicated above and resubmit it to
the undersigned at the earliest for reconsideration.

Yogendra and Prashant should have excercised restraint in attacking
Kejriwal
The latest bickering in the AAP is not surprising. When a political
party takes shape from socio-political movements such teething problems
are bound to happen because of the aspirational clashes between various
internal forces. AAP fought and won Delhi Elections keeping Arvind Kejriwal
at the forefront. Now attacking him after massive electoral win is totally
uncalled for. Yogendra Yadav and Prashant Bhushan should have excercised
some restraint in attacking him directly. AAP experiment has been hailed
as a unique feature of Indian Democracy and it has reinforced the faith
in the strength of common man in bringing change in the political system.
The media also ought to play a more responsible role in this affair.
After all we must give at least 5 years to Arvind Kejriwal to deliver
in Delhi. Only after that we can form some opinion about him.

'Lakshman Rekha' for serving IAS officers
Of late, some IAS officers are seen and heard criticising the government
that they serve. They unhesitatingly participate in debates in television
media making critical remarks about the ministers and policies and methods
of the government. One wonders what is the 'Lakshman Rekha' for these
serving IAS officers who really sound like rebels. Obviously, Ashok
Khemka who has become well known by frequently defying the government,
getting transferred and getting huge publicity whenever such transfers
occur and readily giving his views in media and answering questions
from journalists, has raised questions as to what would be the rights
and responsibilities of an IAS officer and whether the service rule
permit such rebellious methods. Khemka has got away with such approach
so far, possibly due to the friendly media that support him all the
time even without ascertaining the facts and a government that is unwilling
to put its foot down, fearing the media and the so called public opinion.
The fact is that an IAS officer has to obey the orders of the ministers
who are voted to power by the people. If he is given an illegal order
or an order in which he has no agreement, he is entitled to request
the minister to give the order in writing. If the minister would give
the order in writing, he has no alternative other than obeying the order,
even if he would not agree ; after recording his dissenting note on
the file. Moreover, IAS officer has the responsibility to ensure smooth
functioning of the government apparatus by not adopting an approach
of confrontation and friction with the minister, by having a "holier
than thou" attitude. People know the happenings in the government
only through media. While Khemka may have his stand, the ministers too
may have the stand and every time Khemka accuses the ministers , the
ministers refute such accusations. For the public, there is no real
way to know who is right and who is wrong. In any case, it is absolutely
irresponsible and unbecoming of serving IAS officer to give media interviews
, criticising the government. The right course open to him is to go
to the administrative tribunal, which looks into the issues concerning
the IAS officers and give it's decisions. Khemka and some of his similar
friends are creating unhealthy precedent which will inevitably weaken
the administrative structure and create a new unhealthy practice and
set bad example to the juniors. Khemka and his friends should keep in
mind that his juniors may also show similar attitude towards them, due
to any right or wrong reasons, learning from them.

Removal of corruption, a farce
This country is a great votary of corruption and all glib talks about
its removal are just glib talks only. In one of the states when the
police headquarters wanted to finish with an illegal scheme of out of
turn promotions, all his fellow officers have started to bring back
the system after his departure.

Devastation of AAP
The April 14 will be the start of devastation of AAP. It will manage
to rule Delhi with maximum mismanagement for a year or so .It will get
fed up with various legal cases. This is not because of AAP or its rebellion
but due to vested interest.

Misuse of power in AERA
UPA government had established Airports Economic Regulatory Authority
of India [AERA] in 2009 to accommodate its well-wishers. But wish of
the government could not be fulfilled for want of one reason or the
other. Opportunists [in terms of employees] from Airports Authority
of India [AAI] grabbed this opportunity with both hands and got entry
into this Authority by way of providing their services on loan basis
for initial six months. Since then, AERA has become Airports Employees
Recruitment Agency. No deputation posts are being filled up in this
authority so that AAI employees could continue here and fulfil their
vested interests. The story does not end here. They are openly misusing
their power by using official letter heads of the authority under their
signatures and even attestation stamps have also been provided to them
whereas they are neither gazetted officer or class-I officer. Is it
not gross violation of Rules? This is all going on under the nose of
Chairman, AERA. So much so, despite their transfer to other stations,
they are still continuing here and hence defying transfer order issued
by competent authority. May I request higher authorities in Ministry
of Civil Aviation/Chairman, AERA and Airports Authority of India to
look into this mess and take strong action against the errant officials?

The retire age of executives belong to certain region retires at the
age of 65 years by age affidavits. After retirement they will join as
directors of other PSU and again milking the cow or getting extensions
as advisors and posted in metro. Here the pay scale is same for E6,E7&E8
grades and ignored DPE OM 7(12)/2009-DPE(WC) dated 24-12-2012. 70% of
executives posted in corporate have not worked in plants shop floor
nor seen shop floor, but gets fast track promotions and making policies.
Here departments are created in metros and enjoying tax payer's money.
Here the promotions, transfers and recruitment has a price Tag. If an
executive related to political stalwart, things will be simple. For
sincere, honest and qualified is a night mare. They don't even get promotion
even after 11 years against nomenclature of 4 years. If you are TA/PA
of top executive's promotions is just like a cake walk. Vigilance is
puppet. For outside world it is just a show bazzy. Here the punishments
are very peculiar. The HRD is human destruction department. Show me
the man I will show the rule. Will the PM look into this Mysterious
Mahartna PSU

PM's advice to Secretaries is futile
PM's advice to Secretaries is just a show off and futile. Politicians
know that bureaucrats are divided i.e., IAS V/s IPS, Central services
etc .They exploit this weakness and all senior bureaucrats become pliable
and take decision dictated by their political boss .This can be minimised
if there is greater transparency in government functioning particularly
in senior appointments.

Copies of correspondence regarding bank
loan
The Appellant and her husband availed a housing loan and a case
was filed by them in the Consumer Court regarding charging of
excessive interest on the loan account. The Appellant sought copies
of two letters exchanged between the zonal office and a branch
of the bank. Respondents submitted that housing loan was granted
to the Appellant for purchase of land and construction of house
thereon, but construction was not carried out and the account
has become NPA. The Respondents further submitted that copies
of the letters sought by the Appellant were not provided as it
is their internal correspondence and held in a fiduciary capacity.
The CIC held that the correspondence pertains to the loan account
of the Appellant and is not held by the Respondents in a fiduciary
capacity. Disagreeing with the denial of information under section
8(1)(e) of the RTI Act, the CIC directed the PIO to provide the
copies of the two letters sought by the appellant free of cost.
Comments
If there was any part of the correspondence
which was of commercial interest to the bank, perhaps a claim
could have been made for exemption from disclosure for that particular
part of letter under section 8 (1) (d) of the RTI Act.
