?
Aam Aadmi Party's (AAP's) recent mammoth victory in Delhi was a super-landslide
(the winning party securing 90 percent or more seats). Even the Congress
which had the natural advantage of leading the freedom struggle successfully
and had stalwarts like Mahatma Gandhi, Jawaharlal Nehru and Indira Gandhi
could never achieve it in any general election despite dominating the
political scene in the country post independence. The rise of the Aam
Aadmi Party indicated that people once again saw politics as an act
of faith and hope but given the bickerings among its leaders in too
a short span, the question that now arises is that What is the future
of AAP ?

day, Yogendra Yadav is most seasoned and matured leader of his team.

Absence of Modi from India !
Rahul Gandhi's much criticised sabbatical from politics pales to insignificance
compared to the absence of PM, Modi from India most of the time due
to his frequent foreign jaunts. Perhaps he wants to redeem his credibility
after being dubbed almost an international pariah due to Gujarath riots.
His too centralised one man oriented functioning is affecting the administration
badly. Senior bureaucratic Postings are so secretive nobody other than
Modi knows any thing. Till now Government could not find a replacement
for the CabSec, a UPA nominee. Important posts like CIC,CVC, Chairman,
Competition Commission etc are all awaiting posting for several months.
While he is trying to get a Nehruvian halo around him, his Foreign Minister
is looking crestfallen seeing her job being usurped by PM. Modi seems
to forget that it is the disgusting sight of Manmohan-Sonia duo and
their corruption that mainly brought BJP to power and not his charisma
alone. If he thinks otherwise, he is not knowing that sand is slowly
sifting away under his feet like what happened in Delhi elections.

Wrong PAN Number
This painful story or a fact experienced by an Indian Citizen who is
paying Rs. 8 Lakh Income tax yearly to the Indian Government but a problem
which was faced by him has not been resolved till date since 2010-2011.
The problem was, the employer of this individual had mentioned wrong
PAN No while depositing/ deducting the Income Tax in the Year 2010-2011
which was not the fault of this Income Tax payee. In lieu of that IT
Department had issued a showcase Notice to this Individual "since
you have not paid the full applicable IT Return Why can't IT Department
panelize you with Rs.10, 000/-or get it sorted out within a month.
So, this Individual started looking for the solution through employer
office & IT Department concerned wing. It was the wrong PAN NO mentioned
in the TDS certificate. Individual represented the IT Department by
saying that since ,it is the employer who is at sources deducting the
Income Tax please penalize them because I have provided every correct
details with supporting documents to the employers. It was at Government
level found correct and at National Level digitalization had rectified
this problem of manipulation done by many of the Indian employer. Individual
was ensured by the IT department, will do the necessary and your demand
Notice will be withdrawn.
Happily the Individual is paying the IT and continuing with his Job.
Last Year when his C.A told him that you are paying more than justified
IT to the department because your employer is not deducting correct
IT /TDS as per your investment declaration etc. so the Individual decided
to go with his C.A and told him to file the return which may attract
refund and adjactly, it happened with a communication received from
IT department saying that your refund is going to be adjusted against
the Demand Notice of Year 2010-2011 with Interest. Therefore, you can
contact your Assessing Officer IT Department immediately and within
a month time you get it rectified otherwise your refund will be forfeited
against the demand Notice.
Now, the Individual was infix what to do? First, he approached his
C.A who in return told him that he can't help since the matter pertains
to your employer and there, you have to get it rectified by including
the amount in TDS Certificate of the Year 2010-2011. Fortunately, employer
office staff handling IT Return was effective, he initiated the matter
with local IT Department and it was resolved by induction / inclusion
of the less Amount which was later on rectified by IT Department Ghaziabad
office also.
Individual reached to the Assessing officer shown him the details which
was found correct by him over their Department Website the Individual
told him to pass-on the information to CPC Bangalore so that my refund
can be process A.O told him it has been done.
Many month have passed, the Individual is calling on the toll-free
no. of CPC Bangalore & in response told to please contact your A.O,
whenever Individual contacted A.O. he said that we have done everything,
matter is over from this place you better contact CPC Bangalore. Individual
is running to pillar to post in last one year but all in vein.
This is going on for month, leave aside about the refund, the Individual
has several times requested over Toll-free No CPC ,Bangalore don't pay
me refund but at least confirm me that necessary rectification has been
done so in future ,the Individual can't be held responsible for non
-payment etc.
A genuine Income tax payee in India is being harassed for a fault which
was not committed by him but agony continues.
Solely, Indian bureaucracy is responsible for this. They are having
lavish salary parks etc on A/c of exchequers fund. Surprisingly, bureaucracy
has understood how to become politician. Now very easy to grab more
power, but what will happen to this great Nation. It is very uncertain.
You where aware of corruption where give & take was occurring, but
this corruption which is invisible can ruin the Nation.
Writer: pray to the almighty that please bless us with wisdom &
ethics so that our future generation can have at least good life to
thank us.

Innovative mechanism can improve functioning of CGHS
Yes, some innovative mechanism can surely improve functioning of CGHS.
There have also been isolated good examples of CGHS functioning. More
monitoring and surprise checks should help in its overall functioning.
Ministry should provide additional resources and more autonomy to CMOs
as a beginning. To achieve efficiency and avoid unnecessary ques etc
in CGHS, the working of CGHS system needs organizational management,
a social and accountability audit of this system. Even with the present
strength of doctors/staff, things can improve to a large extent.

Real problem with Judiciary
The real problem with the judiciary is that the District level Courts
are manned by Provincial Judicial Service officers and not an All India
Service. With a substantial portion of such recruits joining the High
Court, the quality of the judiciary cannot be very high. The lack of
merit can only be addressed by an All India Judicial Service. There
is another problem. The new CrPC of 1973 destroyed the Executive Magistracy
and left it bereft of any power at all. This is the real reason for
the breakdown of law and order and administration all over India. It
is high time to revisit the old CrPC and see if the changes made by
Indira Gandhi thereto in 1973 have led to the desired results? One may
argue that the Supreme Court is doing good work, but the very reason
why it has to step in in all matters related to administration is the
withering away of administration due to the 1973 CrPC amendment.

Copies of correspondence regarding bank
loan
The Appellant and her husband availed a housing loan and a case
was filed by them in the Consumer Court regarding charging of
excessive interest on the loan account. The Appellant sought copies
of two letters exchanged between the zonal office and a branch
of the bank. Respondents submitted that housing loan was granted
to the Appellant for purchase of land and construction of house
thereon, but construction was not carried out and the account
has become NPA. The Respondents further submitted that copies
of the letters sought by the Appellant were not provided as it
is their internal correspondence and held in a fiduciary capacity.
The CIC held that the correspondence pertains to the loan account
of the Appellant and is not held by the Respondents in a fiduciary
capacity. Disagreeing with the denial of information under section
8(1)(e) of the RTI Act, the CIC directed the PIO to provide the
copies of the two letters sought by the appellant free of cost.
Comments
If there was any part of the correspondence
which was of commercial interest to the bank, perhaps a claim
could have been made for exemption from disclosure for that particular
part of letter under section 8 (1) (d) of the RTI Act.
