Congmen playing role in making Congress-mukt Bharat?

Senior and dedicated Congressmen gathered at the residence of an old party leader. They expressed concern that some Congressmen are playing major role in PM Modi's call to make Bharat Congress mukt. Party leaders like Shashi Tharoor and Janardan Dwivedi have praised PM Modi openly, not only sending a wrong message to party but encouraging other disgruntled leaders. This is not a healthy situation. These loyal leaders also expressed concern why party high command is mum.

BEML celebrates Republic Day with Swachh Bharat campaign (UPDATED)
BEML celebrated Republic Day at its HQ and Production Units situated at Bengaluru, Kolar Gold Fields, Mysuru and Palakkad (Kerala) with patriotic fervour. At its HQ in Bangalore, CMD, P Dwarakanath unfurled the National Flag and addressed the Executives and Employees gathered in large number impressing upon all to continue with dedicated work in their fields that ultimately contributes to the development of the Nation and also called for enhanced efforts towards innovations in the production activities of the Company not only to attain self-reliance but also to promote 'Make in India,' in all sense of reality. As a part of Republic Day Celebrations, 'Swachh Bharat' Campaign was also taken up by organising a cleaning programme of the surroundings of BEML Soudha, the headquarters of the Company. A large number of Employees and Executives have joined the programme led by BEML CMD, P Dwarakanath and Director (Finance) Pradeep Swaminathan.

Bad reopening of assessment: a safe source of bribe for income tax authorities:

If income has escaped assessment, an income tax authority can reopen the case, after recording reasons for doing so, that the income chargeable to tax has escaped assessment. Such reason must be duly recorded in writing and such written satisfaction is the sole basis to confer jurisdiction on the IT authority. If the reasons are not properly recorded, whole case fails in appeal.

Some IT authorities willfully does not record such reasons properly and levies tax. The Assessee ultimately wins on the ground of bad reopening. In the process IT Authority can easily and safely earn the bribe.

Presently there is no audit of reasons recorded nor there is any vigilance action for unsatisfactory recording of reasons for reopening.

Whole department is silent on this issue and the scam is going on regularly. Thousands of assessments get quashed in appeal every year on the ground that reopening is not valid. An empty formality is done for taxing the assessee, which ultimately is to result in zero tax for income tax department and unnecessarily flooding High Courts with writ petition.

Will the CBDT look into this and will CAG start auditing reasons recorded by AO and raise objections for flimsy reasons recorded. Will vigilance wing be active on this front.
Thousands of lakhs of rupees extra revenue can be collected if this scam is checked.

Property details in relation to a court case

The Applicant sought information regarding the details of the properties of her estranged husband as per records of the bank. The PIO denied the information under Section 8 (1) (d) of the RTI Act on the ground that it pertained to a third party. The applicant submitted that she needs the details of the properties of her estranged husband to get a share in the same for herself and her child. The CIC referred to the Supreme Court judgment in Girish Ramchandra Deshpande vs. Central Information Commissioner and Ors. [Special Leave Petition (Civil) No. 27734 of 2012] and held that the information sought by the Applicant is exempted from disclosure under Section 8 (1) (j) of the RTI Act.

Comments

Just because a public servant is in litigation with someone in the course of a private dispute, the personal information cannot be provided to establish the truth of allegations. Such disclosure cannot be said to be in "public interest" as the litigation is a private one.
