Bureaucrats acting as per whims


Bureaucracy under NDA rule is functioning as per its whims and fancies with absolutely no control of their ministers. PM at the inception of the Government has emboldened these bureaucrats which have led to high -handedness by them. They are not performing well which will not go down with history.

Pay Commission is like any other re-commendatory body which the Government sets up. Not all recommendations are accepted by the Government. Sometimes recommendations are made without going into practicality of the situation. The CSS and CSSS are two different services as is evident from the CSMOP. There is no point in cribbing

Attendance system

The bio metric attendance system in government offices would having real meaning only if Secretaries also mark their attendance daily basis, in all fairness. Why are Secretaries excluding from marking their attendance? Why is attendance of all Secretaries not reviewed by Cabinet Secretary regularly? If the leader is not follow prescribed rules, but comes yawning to office at 11 am ,what is the use of this whole system of attendance? Is someone listening please?

DoPT's high handedness

Arguments and counter arguments between two cadres viz stenographers and clerks. This rift has been intentionally created by DoPT. Keeping in view the general principle envisaging multi-skilling and de-layering for the entire Government, the 6th Central Pay Commission had recommended that ".......the Secretariat and Stenographers cadre would stand merged" and ".......once, merger takes place, a uniform designation in any case will attach to these posts." The 6th CPC had also recommended that all future recruitment to CSS/CSSS/non-participating Ministries, will be made as Executive Assistants. These Executive Assistants will discharge the functions presently being carried by Assistants as well as PAs and thus, there will be a single unified cadre. Besides this, the 6th CPC had also recommended that for the present incumbents of these cadres, Administrative Ministries concerned may evolve a procedure for their job enlargement/enrichment, retraining and re-deployment. The holistic nature of the 6th CPC Report was amply clarified in para 11.10 of its report, which stated "all the recommendations to be treated as an organic whole and as partial implementation will bring in several anomalies and inconsistencies." All these recommendations of the 6th Pay Commission had been accepted by the Cabinet as a package, notified by Ministry of Finance vide its Resolution No.1/1/2008-IC dated 29th August, 2008.
However, DoPT misled various authorities in GoI including PMO by hiding these recommendations time and again. DoPT did not even bother to be honour the Cabinet decision, neither it went back to Cabinet for reconsideration!!! This has led to several cases in CAT which DoPT is handling/prolonging. Obviously, if a PSO [equivalent to Director] is made to work of a Steno D [equivalent to UDC] is clearly a wastage of tax-payers money. Is it the austerity that GoI is enforcing ? Will the PMO listen or act ? Any reaction from any corner?

Information regarding complaint of corruption

Appellant sought information with respect to his Complaint about the corruption against Sub Registrar which was denied under section 8 (1)(h) of the RTI Act. The CIC noted the submission of the PIO that enquiry is being conducted in DC's office is not supported by any document. The PIO was not in a position to say as to what is the charge sheet and the stage of enquiry. The CIC observed that the PIO has just made a claim that enquiry is going on and sought exemption u/s 8(1) (h) of the RTI Act without furnishing any supplementary information. The CIC drew an inference that in the absence of any information or record or file saying that enquiry is in existence when there is no enquiry going on, the PIO has simply dodged the response to the appellant. The CIC directed the PIO to furnish point wise information to the Appellant and issued show cause to the PIO why penalty u/s 20(1) should not be imposed upon him for rejecting the RTI application using section 8(1) (h) and not showing any record to say that enquiry is going on.

Comments

The case show the ignorance of the officials in dealing with the applications filed under the RTI Act. For rejecting any application u/s 8 (1)(h), the PIO should explain how the disclosure can impede the process of investigation.
