Is functioning of bureaucracy better under the present NDA rule
or was it better in the UPA regime?

Bureaucratic performance depends on political leadership. Take UPA's
misrule. The bureaucracy lost its self-confidence combined with lack
of initiative in decision -making. All decisions taken by the extra
- Constitutional authority led to serial scams. Failure to fall in line
and fear of anti-graft agencies kept the bureaucracy from taking important
calls. Bureaucrat while assisting political masters are with in their
rights to object illegal or unconstitutional orders. This attitude was
missing in UPA- appointed bureaucrats who were rewarded with coveted
postings and post-retirement assignments. Worse, with a gutless PM,
the domineering ministers owing direct allegiance to the Congress supremo
emasculated the bureaucracy. Now, consider the present dispensation.UPA-appointed
bureaucrats, good at boundary management, succeeded in retaining prized
postings. Position worsened with Modi ji's blind reliance on a coterie
of smart bureaucrats. Inability to repatriate black money and punish
serial scamsters of UPA-II , controlling corruption and inflation, despite
poll promises, can be listed as NDA's failures. The Modi sarkar is different
from Congress-led sarkar in that while,UPA ministers were foreign educated
and arrogant; several BJP ministers are equally arrogant despite being
uneducated. Bureaucrat's quick adaptability and pliability to incoming
govt. continues unabated for getting plum postings, extensions and re-employment
as consultants. Simply put, meritocracy, as always, is replaced by mediocracy
and sycophancy. The silent majority of quiet performers remains un-heard
and neglected. The bureaucratic mindsets do not necessarily change with
change of governments.

No time for Kejriwal
Is Arvind Kejriwal losing an opportunity to serve Delhi in the various
tussles that he is engaged in? As the chief of a a new party, Arvind
Kejriwal will have many political challenges, both from within (Yogendra
Yadav, Prashant Bhushan) and outside (other political parties etc).
In his place, any other person would also have had to contend with the
same. Point to note is, despite all circumstances, in today's political
landscape, one has to perform, or perish. To perform, Arvind Kejriwal
has to stay focussed on governance and gain experience therein. Frittering
time away on petty politicking will not help him, in the long run. If
he fails, a good leader in the making will be lost.

The Appellant had a marital dispute with his wife, who worked
in the bank as an officer. He had been filing a number of RTI
applications, repeatedly seeking information on various issues
related to the said bank officer. The Appellant sought the copies
of educational certificates of the bank officer claiming that
the qualification of his wife has been mentioned as B.Sc, while
she did not study science beyond class 10. The PIO denied the
same under section 8 (1) (j) of the RTI Act claiming that it was
personal information. The CIC referred to the observation of the
Apex Court in the Central Board of Secondary Education & Anr.

department, an employee furnishes his personal details and information,
to be retained in confidence, the employer, the official superior
or departmental head is expected to hold such personal information
in confidence as a fiduciary, to be made use of or disclosed only
if the employee's conduct or acts are found to be prejudicial
to the employer."The CIC upheld the rejection of request
for information.
Comments
Many government officials face applications seeking their details
of loans taken, marital status, PAN number, income tax details,
copies of form 16, details of movable and immovable assets and
details of gifts etc. Such harassment of honest officials is not
the objective of the RTI Act.
