Radhakrishan is absolutely correct that instead of reimbursement of newspaper, telephone and other sort of bills, the same can be given in salary as allowance thereby saving of lot of time and paper in the Ministries.

PIL -Only solution

The 2nd Administrative Reforms Commission had recommended that delegation of authority (both the administrative & financial) in every organisation needs to be reviewed, revised and prominently displayed both on papers and on the websites. No official should shy away from executing his authority & responsibility. This execution of the authority by the officials should feature as an item of assessment of an officer's performance in the ACR/APAR.The culture of marking of file by the junior to his superior by writing 'may kindly see' should end. This was accepted by the Government and conveyed to all stakeholders for taking action. It was felt that this step to a great extent will remove the policy paralysis which has gripped the government in recent times. All the Government Departments both at the Central and State level had to take action in the matter. But for the vested interest this decision till date has not been implemented in true spirit. Government will not do anything. A PIL is the only solution.

This has reference to the order dated 10.06.2015 issued by the Ministry of Statistics and Programme Implementation wherein Dr. Bimal Roy, Director, Indian Statistical Institute has been divested of his administrative and financial power without any investigation or enquiry. He has not been given a chance to explain the so called charges of indiscipline or irregularities and simply on the whims of Dr. Arun Shourie, Chairman, ISI Council the action has been taken by the Ministry and by putting unverified charges on the website of MoS & PI the image of a noble scientist like Dr. Bimal Roy has been tarnished. His contribution in ISI has been known to one and all. Modi Government has more enemies within than outside. Where is transparency and rule of law in the case? MoS & PI has earned the distinction of one Ministry under Modi Jee which has been indulged in vendetta only.

The Appellant had a marital dispute with his wife, who worked in the bank as an officer. He had been filing a number of RTI applications, repeatedly seeking information on various issues related to the said bank officer. The Appellant sought the copies of educational certificates of the bank officer claiming that the qualification of his wife has been mentioned as B.Sc, while she did not study science beyond class 10. The PIO denied the same under section 8 (1) (j) of the RTI Act claiming that it was personal information. The CIC referred to the observation of the Apex Court in the Central Board of Secondary Education & Anr. Vs. Aditya Bandopadhyay & Ors."…… if on the request of the employer or official superior or the head of a department, an employee furnishes his personal details and information, to be retained in confidence, the employer, the official superior or departmental head is expected to hold such personal information in confidence as a fiduciary, to be made use of or disclosed only if the employee's conduct or acts are found to be prejudicial to the employer."The CIC upheld the rejection of request for information.

Comments

Many government officials face applications seeking their details of loans taken, marital status, PAN number, income tax details, copies of form 16, details of movable and immovable assets and details of gifts etc. Such harassment of honest officials is not the objective of the RTI Act.
