Tapan Ray is likely to be appointed new Secretary Information and Broadcasting

Ray is presently Secretary Corporate Affairs. Infact, Ray was given

Be-sieged Administration
Even before Behbal Kalan firing after cases of desecration of Sri Guru
Granth Sahib, running over of and molesting of a lady, killing her ,and
others by the staff of the prominent transport company, stripping of
a dalit schoolgirl and murder of the 88 years old Mata Chand Kaur of
Dera Bhaini Sahib ,the state had witnessed, murder of police official
saving the honour of his daughter, thrashing of police officers by political
goons, thrashing of police officials by their colleagues ,cold blooded
murder of two brothers in Ludhiana, police encounter of a prisoner at
Amritsar, and still suffering regular snatchings ,robberies and, forgeries
of Arms licences, besides the carving out of the empires of land mafia,
sand gravel mafia, and drug mafia etc. The government off and on gives
statistics proclaiming its better law and order than the other states,
yet in public perception the maintenance of law and order here has been
dismal.
This is happening in the state, which was considered number 1 in governance
till mid 1960s Its efficient police force used to be deployed in other
states for maintenance of law and order, when the police of those states
failed. In May 1973,when the worst police agitation in the country ,after
partition was resorted to by the Provincial Armed Constabulary of Uttar
Pradesh, Punjab's ,then IG legendary Ashwani Kumar IP, was specially
chosen by the then PM Indira Gandhi to quell it and he did his assigned
job. However, in March 1978,when the present CM Parkash Singh Badal
was CM, the state police also revolted and launched agitation. This
was followed by the Baisakhi shooting and killing of sikhs, and Nirankari's
involvement in it, in April, and later incidents for more than 15 years
took its toll on the state affairs and police remained in the forefront
fighting terror. The politicians and the leaders needed protection,
so role of the police became prominent. It was largely felt that only
by controlling police the state can be run. This has been happening
in varying degrees till the police stations and the jurisdiction of
a DSP were made coterminous with the Assembly Constituencies. The Halqa
incharges of such areas have virtually become the real rulers. The cadre
controlling authority i.e. Government of India ,of IPS officers, have
perhaps ,never seriously taken up with the state government to post
only, IPS officers as SSPs, since these are cadre posts. Not only the
police ,but the entire administration seems to have become senile and
doctored and programmed to act in a particular manner.
It is the right time for the government to realize that law and order
is the first requirement of any civilization. People are not concerned
with development, but more with their safety and security. Time is running
out. The administration must be calibrated to perform its constitutional
duties.

Copies of documents held after the completion of retention
period
The appellant filed the RTI application seeking attested copies
of external examination question papers of B. Arch. for a certain
period, some answer sheets etc. The Respondent informed that according
to rules of the University, the students are supposed to apply
for copies of answer sheets, within 15 days from the date of declaration
of the result. As per the University's retention policy, answer
sheets are retained for three months, from the date of declaration
of result. But, if the student fails to apply within the prescribed
period of 15 days, the answer sheets cannot be given to the student,
though the same are held by the public authority upto three months.
The CIC ruled that the above retention policy of the University
is not a correct practice. If they have retained the answer sheets,
even after the prescribed retention period for any reason, they
cannot deny if it is not destroyed as on the date of RTI application
Comments
No public authority can impose additional restrictions over and
above those prescribed under Section 8 of the RTI Act to deny
any information to the applicant. A Public Authority is expected
to make its own record retention policy and provide information
to any RTI applicant as per the same as long as the records are
not weeded out. If the records have been retained even after the
prescribed retention period, copies of the same cannot be denied
if it is not destroyed as on the date of RTI application. Further,
a Public Authority is required to hold the records, if an RTI
application is pending before the authorities.
