Very disturbing situation!

It is estimated that 99% of indian wealth is controlled by 1% of population.1.25 billion population, 40 millions file income tax returns and 90% are salaried persons i.e.only 10% are non-salaried people. Little over 48000 having taxable income more than 1 crore. No visible efforts to widen tax networks by non-salaried people. Number of scams have been surfaced in Govt., public sectors and also in private sectors but no where responsibilities have been fixed. Banks have written-off more than 1 lakh crore in last 10 years but without fixing the accountability to bank officers. They enjoy all perks and benefits at the Govt. cost. Present case going against Mallya not paying 9000 crores. Every one is pointing fingers but no body is talking why Banks have given loan without doing risk analysis. No doubt this money has flown out from Banks but Banks are doing the same things in different form. They are not performing well and Govt. is supporting through Bank bonds or budgetary support of 24000 crores from Govt. WHY? If kingfisher could not do well then how Air India is surviving which is suffering loss last several years and Govt. is pumping money without any hitch which is also tax payers money. Air India even running loss gives bonus to their employees. No one can ask the question why? RBI has reduced the rapo rates number of times but banks have not passed completely to consumers. RBI is unable to question Banks but supports in the from of bank bonds, restructuring of loan etc. The interest rates in small savings schemes of post offices have been reduced. These post offices are basically serving rural areas and have some social responsibilities so there has to be different interest rates in comparison to banks. Banks have large presence in urban and different role to play. Post offices are survived due to these saving schemes as telegraph services have been stopped due to technical advancement in telecommunications. There is fear that if interest rates are further reduced, post offices will loose business as customers will move to banks for differentiated services. Govt. has to think very seriously before further reducing interest rates in small saving schemes of post offices. Govt. has taken good step asking Assets and Liabilities from people earning more than Rs.50 Lakhs. At least Govt. has fixed a threshold to channelise their energy, time and man power in this direction. They should not bother for ITRs below Rs. 50 lakhs. Govt.is looking transaction being made thru banks, financial institutes etc but not considering the money flowing in cash whcih is real generation of un-accounted money. Why do not demonetise 500 and 1000 Rs. notes to reduce black money generation. Let no transaction in cash more than Rs. 20000. This may be good step.

Hasmukh Adhia is a great officer. He will tame the wayward Income tax and Customs Excise and their inspector raj. Whenever anyone goes to these offices, no one listens. Either they are on strike, or the inspectors make you wait outside their rooms for eternity.

It would be a pity if Hasmukh Adhia were to go to Gujarat as Chief Secretary. He has just started showing results in customer friendly administration in CBEC and CBDT where the Superintendents and the Income tax officers harass everybody. The senior officers from the IRS cannot even control these lumpen elements.

Copies of documents held after the completion of retention period

The appellant filed the RTI application seeking attested copies of external examination question papers of B. Arch. for a certain period, some answer sheets etc. The Respondent informed that according to rules of the University, the students are supposed to apply for copies of answer sheets, within 15 days from the date of declaration of the result. As per the University's retention policy, answer sheets are retained for three months, from the date of declaration of result. But, if the student fails to apply within the prescribed period of 15 days, the answer sheets cannot be given to the student, though the same are held by the public authority upto three months. The CIC ruled that the above retention policy of the University is not a correct practice. If they have retained the answer sheets, even after the prescribed retention period for any reason, they cannot deny if it is not destroyed as on the date of RTI application

Comments

No public authority can impose additional restrictions over and above those prescribed under Section 8 of the RTI Act to deny any information to the applicant. A Public Authority is expected to make its own record retention policy and provide information to any RTI applicant as per the same as long as the records are not weeded out. If the records have been retained even after the prescribed retention period, copies of the same cannot be denied if it is not destroyed as on the date of RTI application. Further, a Public Authority is required to hold the records, if an RTI application is pending before the authorities.
