Govt. not clear what to do with information

It is good step taken by the CBDT asking the information in ITRs about the Assets and Liabilities of people having income above 50 lakhs but Govt. is not clear what to do with information. It should not be used to harass the tax payers. There are two big challenges before the Govt. First to widen the tax net and second ITRs are filed correctly. In both fronts Govt. has failed. Only 3% people are filing returns. It is shame on us. Leave the salaried class apart as they do not have option except to pay tax correctly. In case of professional it is rather very difficult to find out the correct income irrespective whatever the Govt. does. Govt. is helpless in widening the tax net as most of man power, energy and time is wasted in "Chillar Work" of small and medium tax payers like finding the interest is included in income, MF purchases of 50000/- or in similar activities. Govt. should not waste time and resources for the salaried people earning up to 20 lakhs. CPC can take care directly. Use the machinery for better work. CBDT is revising every two years Form 15H which is submitted for no deduction of TDS for FD of Sr. Citizens etc. Follow a simpler method. Why people are avoiding tax or not paying tax. This is to be analysed whether our system needs some radical changes or more tax friendly environment is needed. FM should work on these lines instead of seeking more information from the people who are already paying tax. Govt. could not compile the data of the people having cars costing more than 20 lakhs, staying in 5 star hotels, making foreign trips, buying jewelries etc. then do the data mining and find out people not filing returns. Why Panama Paper leak? The Form were Saral and now became Kathin.

Disgruntled in government

These disgruntled in the Government are mainly the lazy and who are posted in non-lucrative jobs. These people detest working in electronic environment. While dealing with cases they also do not bother to see the Allocation of Business Rules of Ministries/Departments/Offices/ Departments and blindly work. Any work in the government can be made an interesting one.

Courts don't matter for common man


When they were in full strength also ,cases were pending for years, with less strength also it is same . Even if AP High Court is closed down, it does not matter for common man.

Wheel of justice revolves full circle after 25 years


The court has convicted and sentenced 47 policemen to life imprisonment and also fined them according to their ranks, in Pilibhit fake encounter case, which took place 12 July,1991.It may be one of the rare cases, where CBI has diligently pursued the case of fake encounter of 11 innocent Sikhs, even contradicting the findings of the KN Singh commission, to bring to book the murderers in uniform, after quarter of a century. The innocent lives lost cannot be brought back, but the severest punishment of hanging to the guilty could have assuage the bruised psyches to an extent. Though compensation of rupees 14 lacs has been awarded by the court to the next of kin of the victims, the amount is very inadequate. The bereaved families must be adequately monetarily compensated by the government over and above whatever has been awarded by the court, besides providing them other means of respectable living like jobs and houses.If some policemen got presidential awards for this dastardly and diabolical act ,these should be publically got back. At the time of the incident , Kalyan Singh of the BJP` was the chief minister of Uttaar Pradesh. The court has observed that some senior officers have been left out by the investigation agency. The government must take a call and get the matter investigated further to catch up with the perpetrators of this heinous crime. However all such cases across the nation must be listed for monitoring and early decision.

DATE WITH RTI

Copies of documents held after the completion of retention period

The appellant filed the RTI application seeking attested copies of external examination question papers of B. Arch. for a certain period, some answer sheets etc. The Respondent informed that according to rules of the University, the students are supposed to apply for copies of answer sheets, within 15 days from the date of declaration of the result. As per the University's retention policy, answer sheets are retained for three months, from the date of declaration of result. But, if the student fails to apply within the prescribed period of 15 days, the answer sheets cannot be given to the student, though the same are held by the public authority upto three months. The CIC ruled that the above retention policy of the University is not a correct practice. If they have retained the answer sheets, even after the prescribed retention period for any reason, they cannot deny if it is not destroyed as on the date of RTI application

Comments

No public authority can impose additional restrictions over and above those prescribed under Section 8 of the RTI Act to deny any information to the applicant. A Public Authority is expected to make its own record retention policy and provide information to any RTI applicant as per the same as long as the records are not weeded out. If the records have been retained even after the prescribed retention period, copies of the same cannot be denied if it is not destroyed as on the date of RTI application. Further, a Public Authority is required to hold the records, if an RTI application is pending before the authorities.
