Another surgery of corruption
It is in circulation that the government was seriously thinking of bringing in legislation to amend Prevention of corruption Act to make bribe-giver also guilty of corruption and thus liable to be proceeded against under this Act..The governments in the states and Centre have been off and on taking some steps to tell public that they were not sleeping over the malady of corruption and doing almost nothing beyond that.The Institutions of Chief Vigilance Commissioner,Lokpal,Lokayukat,Ombudsmen in various organisations,CBI,vigilance and anti corruption police,have been functioning for long ,but the spectre of corruption ,often dubbed as universal problem,haunts ,at least,90%of Indian population.In Bihar,the anti-corruption law was forcefully implemented and the properties acquired with ill-gotten money were confiscated by the government,but in spite of that the disease continued to weaken the morale of the society.In 1997,in Punjab ,law was passed that whosoever would inform about the corruption by any government functionary, would be given reward of rupees 25000.The scheme worked successfully for about three months and thereafter on the insistence of the politicians ,the government relented and lukewarm implementation killed the potent initiative. The proposed amendment of the anti-corruption law to hold the private person guilty if he gives the bribe, has the potential to murder all the anti-corruption measures taken by the government so far.Nobody would then come forward to inform the government about the demand of the bribe by the government functionaries because of the fear of law.This will amount to giving protection to the corrupt functionaries as they will never inform the authorities that they had received any bribe. Only the harassed citizen can reveal the corrupt demand by a functionary.The government ,very often tries to bring legislation just to hoodwink the gullible public and to buy time.It seldom thinks of effectively implementing the existing law by strengthening its machinery and improving its monitoring and securing convictions.It is better if such decorative but futile rather retrograde steps are avoided.

British period of slavery!

This is for those who thinik that the civil service as it exists today, is a reflection of british period of slavery! Then how will it help by having other services being made secretary! We should then do away with the system of examination altogether, and let political leaders choose anybody from the market , they want! That would be fully democratic! Or like the academia today , where in the name of autonomy, a Director, and HOD of a department can pick anyone and make him a professor, subject to his/her having minimum qualification! Would that suit all our friends!

Action for not writing the APAR

The appellant sought information about the writing of APAR and specifically sought to know about the applicable Rule for deterrent/punitive action on the Reporting and Counter signing officer(s) if they do not fill the APAR of officers working under them in time and keep the APAR's pending for several years despite reminders from the Headquarters. The CIC observed that it is the internal matter of the organization to review and reform the personnel policy for the welfare of the employees in a most efficient and transparent manner. The dissatisfaction in the work force adversely impacts the morale of the employees and consequent inefficiencies. The CIC advice the Air India to review its grievance redressal mechanism in personnel matters to ensure the transparency in accordance with the spirit of the Act. The public authority was also directed to provide the necessary information as sought by the appellant within a period of 15 days.

Comments


The APAR is a record of the assessment of the work done by an individual. When specific time limits have been prescribed for the reporting and reviewing, there appears little reason for not following the prescribed time limit. All officers must adhere to the time schedule prescribed for the writing / review of the APAR.
