What is difference between old and new politician ?
There was a discussion about difference between old politician and the
new breed of politicians. There was a consensus that the old politicians
had a sense of appreciation but the new breed of politicians lack this
quality.
When High Command is strong ?
Comment of a veteran politician is significant- No Chief Minister is
comfortable when the party high command is strong and powerful. In BJP
these days no CM is comfortable and in Congress all the CMs are really
comfortable .
Corruption and Madhya Pradesh
After the Sangh -BJP manthan, in which some present and ex ministers
levelled all bureaucrats from top to bottom as highly corrupt , it is
learnt in the whispering corridors that those ex and present ministers
might face allegations with proof and action on pending corruption charges
from bureaucrats. One of them is facing serious charge in a judicial
inquiry already.. Bureaucrats have decided to take advantage of the
new whistleblower act and launch direct complaints against ministers
to PM Narendra Modi directly. One Department Secretary in a meeting
of contractors has already openly told that he is aware of a Mumbai
based contractor who is telephoning other contractors on behalf of a
powerful MP minister that they should not participate in about hundred
cr tender since he has already tied it up with the minister. Departmental
Secretary told contractors to participate without fear in e-tendering.

Will Acting CJ be full-time CJ in Calcutta High Court ?
Grapevine has it that Acting Chief Justice of the Calcutta High Court
Justice Girish Chandra Gupta is being elevated as Chief Justice in the
same HC. Justice Gupta has been Acting Chief Justice of the Calcutta
High Court after the appointment of Chief Justice Manjula Chellur as
CJ of Bombay HC on August 11.This appointment will pave way in a few
other High Courts.

Attitude of current generation of officers
I had the opportunity of viewing the Prime Minister's interaction with
the Secretaries to GoI and Chief Secretaries of States/UTs held on 24.08.2016.
What I found the most frustrating is the flattery and stooge attitude
of the current generation of officers. PM made fun of project taken
up by the Railways in Punjab, HP and J&K for laying of track in
the year 1981 but till date has not been completed. The concerned official
of the Railways said 'hum jaldi kar lenge'. What is surprising is that
he allowed himself and his organisation to be laughed upon. He should
have informed that as to how the project is getting delayed. The conditions
are very difficult, the help of Italian were sought & they had failed
and that the line being constructed had return on investments. This
line was taken up only for political reasons. There was need to construct
of Broad gauge line between Bangalore to Chamrajnagar as the return
on investment was meager. There was already a meter gauge line between
Mysore to Chamrajnagar and it could have served the purpose in terms
of return on investment. This line was also being constructed because
of political reasons. These people can travel at a faster rate on an
Expressway for commuting 160 kilometers as compared to a passenger train.
The proposal for having triple line between Delhi to Chennai also dates
back to the 1980s. Can anybody ask for delays for this?. Time &
again and on umpteen times, the Works Directorate and the Finance Directorate
of the Railway had asked for fresh justification of the project from
the Traffic Directorate and impotent officers could not arrive to a
proper conclusion. Kudos to Suresh Prabhu, the Railway Minister. He
should also ensure that all the uneconomic lines ad dead lines of the
Railways are dismantled at the earliest and money generated on account
of it should be utilized elsewhere. As regards the issue of Railway
acquiring land based on some Section of the Indian Railway Act, the
Chairman, Railway Board should have pointed out the hurdles which the
courts create by giving 'stay orders'. I agree with the views of the
Chief Secretary, State Government of Uttar Pradesh that space &
technology should be used for monitoring of the implementation of the
projects. Also at the conceiving stage of projects, there should be
separate clause of 'Risk Management' in order to be prepared with solutions
to problems, which may arise in future.

Typical bureaucratic working of MoD
It is a fact that NFU upgradation of more than 80 IDSE officers of MES
with 23-26 years of Group A service are waiting for Non Functional Upgradation
to the SAG Grade, due w.e.f. April 2016. The DPC is shuttling up and
down at various levels for the last nine months. Peers of these officers
in other Group A Engineering Services have already picked up functional
promotion to SAG grade long back but these officers do not know whom
to approach as MoD is one such ministry where even Jt Secy is not easily
accessible. RM is requested to intervene please.
IDSE officer
Parity among the IAS and the central services ?
Not only that no effort is being made to bring about some parity among
the IAS and the central services, once accepted two year gap has now
become almost a ten-year chasm.1999 batch of IAS has been empanelled
and quickly posted too as Joint Secretaries while the names of even
1990 batch of some services like Railways have not been taken up for
empanelment. Dossiers of officers from 1990 to 1994 batches have been
lying with DoPT for the last one year. There appears to be no urgency
to deal with them. Why when the same urgency was shown for 1999 batch
of the IAS. Things are going from bad to worse causing lot of frustration
among the officers. What to talk of empanelment in some services the
cadre authorities have also shown lack of sensitivity in even giving
SAG to the officers with more than 20 years of service. For example
in the IRS (C &CE) Officers of even 1993 batch have not been given
SAG.I wonder what their Board is doing? or is it they are hamstrung
by Department Of Revenue headed by an IAS officer ? How can the Government
expect the officers to give their best when they are treated in this
manner.

Delay in clearance of Medical bills
A pensioner had submitted medical bills for reimbursement, which
were kept pending by the respondent authority, for a long time.
Hence, he sought information on the status of the same through
the RTI application. The appellant submitted that he is the life
member/beneficiary of the DGHS (Delhi Government Health Scheme)
and as per the circular issued by them on 1.4.1997, he is entitled
for 100% reimbursement of his medical bills. But the respondent
authority has not taken cognizance of the same and he was made
to wait for receiving the reimbursement for a long time. The respondent
authority submitted that all his medical bills were settled and
he has been paid all the medical dues in February, 2015. They
also explained that the delay is due to the fact that the case
of the appellant is the first of its kind, as he has retired from
an aided school and as per the rules, the aided is required to
bear 5% of the reimbursement and rest of the 95% will be borne
by the Department of Education. But this rule is applicable only
for serving employees of the aided schools. In this case, the
appellant had retired and the bills are submitted after his retirement.
Even the circular issued by the DGHS, which is being referred
by the appellant, is not clear in the case of pensioners who had
retired from aided schools. The CIC noted that the appellant is
76 year old senior citizen. The CIC directed the Rakesh Khadgam
Senior Accounts Officer (deemed PIO) to show cause why maximum
penalty should not be imposed on him for the delay in furnishing
the information to the appellant.
Comments
This case depicts that the RTI Act, 2005 has not only emerged
as a tool for obtaining information, but also for enforcing the
rights.
