I usually have my daily 11 am Coffee fix at a Coffee Shop near my Office. Whenever I'm alone there's a Political Blogger who uses the Coffee Shop as his 'Office' , and he comes and sits down at my table for a chat. Today I'm alone and he joins me and we get chatting.
Blogger: Now the Opposition is raising a hue and cry on the COAS appointment… Sir any decision that this Government takes the Opposition pounces on the Government… Congress very conveniently forgets what it did when it was in power…
Me: Yes I've noted this…. like did Congress Governments go by seniority when it appointed COASs….
B: Sir the other day I was talking to a retired senior Army Officer and he said Congress needs to check out what it did…..to make its choice the COAS Congress even gave an extension in service to the Lt. General of its choice so that he could get over the 'residual service' requirement!!!
M: The Government has this time chosen Merit…. of course seniority was a criteria too … otherwise how could they shortlist the three Generals in contention for the Post of COAS….
B: And if seniority is so dear to Congress …why doesn't it practice it in its own Party hierarchy ….how did Sonia leapfrog to be the President of Congress and Chairman of NAC… and how did RJP has collected ahul become the VP….
M: Ha ha …. it is a Sole Proprietorship …. an Autocracy running a so called Democratic Party in a Democracy !!
B: Coming back to COAS appointment …. what is wrong with Merit being the final criteria…. first use Seniority to decide on the Shortlist and then apply Merit… and now AAP with its penchant to mislead and lie has stepped in…. someone in its IT Cell has tweeted that General Rawat's grandfather was an MP from BJP… General Rawat was born in 1957…..his Father was born in 1925 …… his Grandfather was born in 1885 …BJP came into being in 1980…. see the ludicrousness!! And I have checked out lists prior to 80 …even Jan Sangh MPs…. and his name does not appear….and believe me Sir, AAPians will gulp this down without checking the truth…
M: Sometimes I think Kejri and gang take their followers to be absolutely gullible …
B: What is your take on EC saying all donations above 2000 to Political Parties should be documented….
M: As we know in Indian Elections Black Money plays a humongous role … so I think it's a correct demand!!!
B: Government will agree and then see the twist the Opposition will give this decision…. they just finished twisting …. Political Donations of 500 and 1000 and made it look BJP has mandated that Political Parties are above 'the law' ….. Jaitley clarified …. all Old Currency deposits will have to substantiated with Donor Documentation and IT will investigate where required!!! Post Nov 8 even for Political Parties Donations 500 and 1000 are illegal tender ..
M: And the joke is now Delhites are demanding proof of Kejri's degree … the general perception …..educated people talk sense!!!!
B: And Rahul keeps labeling Modi Government as Suit Boot ki Sarkaar…. somebody needs to tell him… its during this Government's tenure that the Suit Boot lot are working overtime to retire their huge debt...examples …Jindal Steel… Essar…. GVK….DLF…. GMR…. JP Group…Tata….Lanco…Videocon etc …..
M: And what's Rahul's Family's penchant for 'Read my Lips'… even his Jeejaji said this……
B: Maybe it's Jeeja ji who is coaching him… and if I may say …doing a pathetic job…. the other day an old Congi friend dropped by and I asked him about the perception about Rahul in the Party…. and on the condition of anonymity …he said…. dooba deh ga…. he's usually oblivious about what is going on and has to be updated by his Think Tank prior to stepping out… that's why he avoids Questions… makes his Statement and vamooses….
M: I note today the Queues outside Banks and ATMs are down….
B: Yes I noted it too… an ATM next to my home which never dispensed any cash post November 8 has started giving cash…. and Sir the Nay Sayers are trying to show as if Modi Government wants the Nation totally Cashless!
M: Fact is Government would be satisfied if from the present 2% the usage rises to 15-20%!
B: Now let us see what lies the Opposition says after Modi's next decision or statement …

"Misplaced generosity"

Though an admirer of PM Modi, his single move in the wake of demonetization, has shocked and saddened me. Let me come straight to the point. Political parties can now deposit any amount of cash held / collected prior to November 8, 2016. The scrutiny IT benchmark of 2.5 lakhs does not apply to them as it does to normal citizens. Discriminatory, partisan, iniquitous and biased towards the political class. Bad in Law. All political parties, across the spectrum, have benefited from this diabolic initiative. Have the politicians turned into black money launderers? The benefits that had accrued from the historic demonetization will be largely neutralized by this single ill-advised act. This is like putting the best foot backward. No loophole but a blackhole of corruption. All politicians have same DNA. At least, so it seems.

Grievance of a railway pass holder

A retired Master Craftsman claimed that despite being eligible for first class pass, the Railways had not been honouring several clauses related to the journey performed by a pass holder. He sought Information regarding rules relating to privilege passes issued to railway employees. The Commission observed that under the provisions of the RTI Act, 2005, only such information as is available and existing and held by the public authority or is under control of the public authority can be provided. The PIO is not supposed to create information that is not a part of the record. He is also not required to interpret information or furnish replies to hypothetical questions. Similarly, redressal of grievance, reasons for non-compliance of rules /contesting the actions of the respondent public authority are outside the purview of the Act. Further, the CIC observed that the appeal relates to the grievance of the retired employee regarding utilization of railway passes and lack of awareness and sensitization of the work force dealing with such matters. This aspect needs to be re-examined by the competent authority to provide relief and succour to the affected retired employees in an objective and transparent manner.

Comments

Even though the redressal of grievance is outside the purview of the RTI Act, it has been frequently used to obtain some relief. The Information Commission has been sympathetic to injustice metered through a system which is not objective or opaque.
