I'm back in Shimla and this time my Respected Friend and I decide to meet at a Tibetan Eatery situated between the Mall and Lower Bazar. Over Soups and Momos we get chatting.
Me: All of a sudden Jamai Raja is getting active …he just tweeted about the Fuel Hike …and now on the latest Order by RBI…..
Respected Friend: He's either doing it in proxy for his Wife…. or could be he's got info the going is getting tough ....legally …. and so he's upping the ante so that at an opportune moment he can say ….he's being targeted for his Anti Government stance….
M: What about this latest RBI Order…
RF: See it's a habit with us Indians to wait for the last moment…. why do you think many Utility Bills have two amounts and dates … one amount which is lesser if dues are paid by a certain date and another amount which is higher if the Bill is paid at the last moment!!! There is bound to be a rush in the last week…. and some Quack CA's must have advised their Clients to deposit Cash in installments and/or at the fag end…. their logic…. the larger the deposit the higher are the chances of the IT getting interested…..and early birds will be the worms!!! And the requirement that two Bank Officials will ratify Deposit/s made again or again and again is to make the Banks accountable ...
M: But again now there is a doubt in minds of the Public…. whatever we deposit now…no questions will be asked…
RF: No questions will be asked when deposits are made… due investigation will be done by IT later…. this stands!! If you ask me it's because this Government has its ears to the ground that is why 53 modifications have come post the Demonetization announcement!!!
M: I think RBI has adequate Currency ready and once the date for deposit of Old Currency Notes expires the Cash will be infused and position will be near normal…. I think the estimated Locked Up Notes level will not be Remonetized ….about 20%...
RF. Yes….. and its hearty to note the Government intends to get electoral reforms…
M: Yes some time back Modi had said there should be a Debate in Parliament on this issue …. but Opposition has not allowed Parliament to function on one pretext or the other….
RF: No State Funding …. rather make the Funding transparent. No Donations should be exempt from transparency…. otherwise what they do with 20,000 and below donations they will do with 2000 and below donations…only multiply the faceless donors!!!!
M: I hear in Chandigarh MC Poll BJP + AD has done exceptionally well…
RF: I get two Chandigarh City Papers with the main Newspapers…..I felt yesterday itself BJP + AD were sweeping the Poll….. a senior local Congress leader…some Chabra fellow… had complained that BJP+AD had used unfair means…. whereas a BJP Leader… some Tandon…. claimed outright victory for BJP…. Leaders tend to do hedging when they know they are on a sticky wicket….
M: And they come to know of this while electioneering….
RF: And this result is also a pointer to the Punjab situation…..though AAP and Congress would say MC elections are fought on local issues…. but Demonetization was such a huge issue that no way was this Chandigarh MC election on local issues….and this goes for other elections post demonisation. .
M: I think now Modi should turn his attention to the Judicial delays…
RF: Yes like it takes months for summons to be delivered…. in fact in many cases the Defender attends Court after Court's Ex Parte threat!!!! And then Lawyers take dates and extend the Case ….. Judges say if things are hurried there are chances of miscarriage of Justice….
M: Yes...... I was surprised when a very senior Lawyer in a conversation with me complained about the long queues outside Banks post Demonetization …. what about the 'line of cases' in Courts….
RF: It will need a collective correction by Government , Judiciary, Lawyers and Litigants….. ( we settle the Tab and get ready to move out)….so now you are going to request for a joke…. well now some matrimonial ads will use Bhajiya Seller as profession of the Boy….

Grievance of a railway pass holder

A retired Master Craftsman claimed that despite being eligible for first class pass, the Railways had not been honouring several clauses related to the journey performed by a pass holder. He sought Information regarding rules relating to privilege passes issued to railway employees. The Commission observed that under the provisions of the RTI Act, 2005, only such information as is available and existing and held by the public authority or is under control of the public authority can be provided. The PIO is not supposed to create information that is not a part of the record. He is also not required to interpret information or furnish replies to hypothetical questions. Similarly, redressal of grievance, reasons for non-compliance of rules /contesting the actions of the respondent public authority are outside the purview of the Act. Further, the CIC observed that the appeal relates to the grievance of the retired employee regarding utilization of railway passes and lack of awareness and sensitization of the work force dealing with such matters. This aspect needs to be re-examined by the competent authority to provide relief and succour to the affected retired employees in an objective and transparent manner.

Comments

Even though the redressal of grievance is outside the purview of the RTI Act, it has been frequently used to obtain some relief. The Information Commission has been sympathetic to injustice metered through a system which is not objective or opaque.
