the way yesterday I was at a Dhaba and like others was watching the
News on the TV.... Rahul was demanding that Modi reveal the list which
allegedly Swiss Banks have handed over to India ...

Demonetisation - The Longest Referendum
Legions have ranged against Prime Minister Narendra Modi for demonetisation.
The public has supported the scheme wholeheartedly. Demonetisation has
dealt the deadliest blow to the prevailing climate of corruption in
the country. Opposing demonetisation amounts to holding out an assurance
to the corrupt of future protection if they help the Congress led opposition
capture power once again. Ironically it has turned out to be the longest
Referendum in the history of democracy getting overwhelming public support
making 282 into 382+ in terms of value. When the overpowering desire
is to rule, the mind of the opponents can make heaven of hell and hell
of heaven.

Fun of demonetisation
The real pain or shall I say the fun of demonetisation was felt when
we left home for Pondicherry for our usual one month sojourn away from
Delhi cold. Taking the taxi from Noida to Terminal 3 from where we were
to take the jet Airways flight to Chennai we had to shell out 800 rupees
for the taxi as there was no card swipe arrangement with the taxi wallah.
Landing at Chennai we took a pre-paid taxi to Pondicherry which charged
us Rs.3300 plus 180 all paid in cash again. After settling down in the
Guest house we went in the evening to our favourite place close by to
have dinner. Here too there was no POS machine. So the payment has to
be made in cash. With limited cash collected from our four weekly trips
to the bank and nearly 5000 gone on the first day we became alert as
ATM use of SBI bank as we were doing during our trips in previous years
for any amount could not be accessible now with limited cash and crowds
here too. So from next day(Today is our fourth day)we plan our food
outings in a better way. We go to the places for eating or other requirements
where card swipe machines are available. Counting cash has really become
a serious concern even at our age and in retirement when access to one's
own savings is restricted due to cash crunch. But instead of bemoaning,
I and my husband are getting quite a fun out of it. No more trips to
our popular bookshops where picking up books that caught our fancy was
a compulsive habit. Maybe the ones having card swipe machine will fill
our days with reading. Otherwise walk on the beach and just counting
the tides of Ocean(incidentally we are staying near the seashore)from
the balcony of our first floor room is pleasure enough.

Grievance of a railway pass holder
A retired Master Craftsman claimed that despite being eligible
for first class pass, the Railways had not been honouring several
clauses related to the journey performed by a pass holder. He
sought Information regarding rules relating to privilege passes
issued to railway employees. The Commission observed that under
the provisions of the RTI Act, 2005, only such information as
is available and existing and held by the public authority or
is under control of the public authority can be provided. The
PIO is not supposed to create information that is not a part of
the record. He is also not required to interpret information or
furnish replies to hypothetical questions. Similarly, redressal
of grievance, reasons for non-compliance of rules /contesting
the actions of the respondent public authority are outside the
purview of the Act. Further, the CIC observed that the appeal
relates to the grievance of the retired employee regarding utilization
of railway passes and lack of awareness and sensitization of the
work force dealing with such matters. This aspect needs to be
re-examined by the competent authority to provide relief and succour
to the affected retired employees in an objective and transparent
manner.
Comments
Even though the redressal of grievance is outside the purview
of the RTI Act, it has been frequently used to obtain some relief.
The Information Commission has been sympathetic to injustice metered
through a system which is not objective or opaque.
