OUR PRIME MINISTER
So much of discussion about PM every day on whispers shows our concern
for the governance. Our PM is absolutely well meaning, none can doubt
his integrity, total leadership quality & to lead from the front,
yet no results on the ground compels one to pause and think. His coterie
is small and does not seem to muster courage against his stubborn personality
that some how fixed best and most able legal brain into economy instead
of an economist. This is so relevant to one and all and the harsh reality
of economy and price rise is before everyone. Similar is the situation
in HRD and at one or two more places. Still there is time if some of
his close well wisher could muster courage to discuss with him the harsh
realities.

Fall in Revenue collection - normal phenomenon
The financial wizards would agree that revenue will not always rise
only, it will definitely fall keeping in view the poor market sentiments
and poor governance.In the year 2000-2001 the collection from the stamp
duty and registration fee was about 400 crores. In the year 2011-12
the collection was 3090 crores. In the 10 years the increase was more
than 700% in spite of phenomenal exemptions to the mega projects. It
is note- worthy that before the year 1986, the collection from the stamp
duty and registration fee was never given any serious consideration
and the stamp duty was leviable on the consideration money as mentioned
in the registration deeds. After the recommendations of the Chandra
committee the government brought about amendment in section 47A of the
Indian Stamp Act to make the stamp duty leviable on the market value
of the property or consideration amount whichever was more. The era
of fear of impounding of documents started as the law remained obscure
on the term market value and fixation of market rates of the different
categories of lands. After the year 2000,with the introduction of computerization,
the land rates calculations were better categorized and monitored to
bring about substantial increase of revenue for about 10 years propped
up by the influx of investors from India and abroad. The property market
saw unprecedented boom and the value of even rural properties also zoomed.
However the loopholes were never properly plugged and evasion also prospered.
In the meeting at state level when officers were asked as to what was
their estimate about the evasion of stamp duty. At that time the total
revenue from this head was about 600 crores. Most of the officers gave
their estimates varying from Rs 1 crore to Rs 10 crores. However one
officer opined that the evasion was not less than Rs 2000 crores. The
officer stood his ground with reasons in spite of shabby stares from
many.
The increase in the collector rates for many years in spite of the fact
that these were fixed substantially lower than the actual market rates
with some instances where collector rates were fixed higher than the
prevalent market rates, have made it difficult for the people to show
the enormous white money. Otherwise the income tax people would not
leave the parties. Although stamp duty rates have been lowered in the
recent past ,yet this relief has been neutralized by levy of social
security and infrastructure cesses. The levy of stamp duty of first
2%and then 0,5% on power of attorneys, complicated legislation of regularization
of unauthorized colonies and hassles of NOCs, almost complete abstinence
of NRIs from investing in the state, no investment from outside investors,
enhancement of registration fee from 25000 maximum to Rs 2 lacs maximum,
minimum being 1%, are some of the dampening of market factors. .There
is trend amongst the NRIs that not only they have stopped purchasing
property in the state, they have started selling their assets here ,but
were not finding the buyers ,who can adequately pay the price.The rates
of property have come down substantially across the state as the circulation
of money has stopped. However, the government have also taken positive
and praise-worthy step of complete exemption of stamp duty, cesses and
registration fee ,if the property is to be devolved on the blood relations
through registration deed.
The government must decrease the rates of stamp duty, cesses and registration
fee in case of conveyance etc in urban property to 6% and in case of
rural property to 4% and also bring down the rates of gift, exchange
and mortgage etc correspondingly. The collector rates must be reduced
by 30% across the state. The legislation of regularization of illegal
colonies must be made completely hassle -free. The collections may come
down initially, but ultimately better compliance would enhance the revenue.
This is a very small bargain to revive the property market and enhance
the revenue. However the confidence of the NRI population and outside
investors shall have also to be revived, which seems to be a far cry
in the current scenario. Let the government take a realistic view to
bring smile on people' and its own face.

JNU' happening shameful
What happened at JNU the other day is shameful. Who was at the back
of this antinational show must be apprehended. Hero-worshipping a terrorist
and raising slogans against the country and threatening continuous 'jung'
(War) against the Indian State are all acts of sedition and should not
be left unpunished. It was also not proper on the part of one news channel
with a loud-mouthed anchor to call such elements to his debate on the
subject.It was giving them a platform for publicising their obnoxious
views.One of the invitee was ,as a matter of fact, the loudest anti-India
slogan shouter and he was thus given an opportunity to voice his hatred
for the country on the TV Channel. I also wonder whether one of the
opposition leader who has started considering himself wiser than the
Prime minister( going by his habit of pointing out one or the other
'flaw'of our Prime minister)would now make a beeline for JNU to support
such elements as these days he is on students-wooing spree.

Seeking copy of Caste Certificate of an officer
Appellant sought a copy of Schedule Tribe (ST) certificate of
a particular officer under the RTI Act, on the basis of an assumption
that it might be fake. The PIO replied that SC certificate was
not enclosed to the service book of the officer. The Central Information
Commission (CIC) asked the appellant whether the appellant is
having any basis to his suspicion about the ST certificate and
about his interest in seeking these details, but the appellant
could not convince the CIC. The CIC observed that the appellant
had been heard earlier by it in several appeals. The CIC commented
that the appellant is a cantankerous misuser of RTI and does not
deserve any sympathy or information, as there is no public interest.
The appellant is wrecking vengeance against the authority and
officers for taking stern action against his misconduct. The CIC
admonished him for misuse of RTI. The CIC ruled that the Public
Authority can reject his RTI applications about inquiry and inquiry
officers as that would impede the entire process of inquiry.
Comments
There is no specific provision in the RTI Act regarding rejection
of an application for alleged misuse of the RTI Act. However,
the CIC has repeatedly come to the aid of the PIOs in cases of
harassment by repeated filing of applications.
