MMS: I think economy is not moving in tandem with improvement in GDP... BOP... on intolerance ... why does Modi not consult Rahul ji .....he's full of ideas ... why this intolerance towards including him in the decision making ... Modi should go to meet him often...

M: Rahul... Sir you need a reality check.... and I'm being polite ..others would advice a different kind of check up... there has been no serious discussion on GST..
MMS: .Hold a few dinners and working lunches for Sonia and Rahul ...the perception going out being ..this Government is trying it's best to make them agree..give Sonia ji the credit ...name the GST ...Gandhis Super Tax ... you know how Congress works ... Modi has to develop a rapport with Sonia ji and Rahul ji.... they have issues they'd like to discuss ...after all Politics is give and take ...politics is the art of negotiating ...

Social Justice and Jungle Raj ? A far cry or Aranyarodan ?

A school boy's head is reportedly drilled with an electric drill and he is thrown to the ground in an elite Private School hostel in Bihar; a girl is shot dead in broad daylight in the city while leaving her hotel in an auto-rickshaw and a prominent political leader of some standing is gunned down by AK-47 wielding assassins in Patna, capital of Bihar. It is the same Bihar where elections to the assembly had taken place only two months ago and the main issue was: jungle Raj or good governance? The champions of the Social Justice club of India stitched an alliance or mahagathbandan of Janata Dal (United) of Nitish Kumar & Sharad Yadav and KC Tyagi, Rashtriya Janata Dal of Lalu Yadav (currently at large on bail) and Congress Party of Sonia & Rahul Gandhi. Many more incidents of attacks or murders of Highways Engineers, Doctors and jewelers, kidnappings of businessmen for ransom and rapes have been reported from Bihar and it is alleged that the Jungle Raj of Lalu Yadav has returned to Bihar. The Chief Minister, Nitish Kumar, has admitted that the deteriorating law & order situation in Bihar is a cause for concern. In a meeting with police brass the CM directed them to act tough and control crime. It was contemptuously ridiculed by the mafia in no time when they shot dead another prominent political leader in Bihar. It is not as if Bihar alone makes the headlines. West Bengal, UP, Delhi, Maharashtra, Tamil Nadu, Telangana, Kerala and almost every state contributes to the headlines. Only a few days back a General Manager of a big company was hacked to death in a busy market place in Chennai in broad daylight while walking to his car after buying medicines from the Pharmacist's shop. Several such acts of impunity had been reported from Tamil Nadu regularly, including political murders & policemen murders. Rapes and killing of innocent children in celebrity firings in public places in UP are regularly reported. Gang rapes and murders and assaults on children as young as 2 years also get reported from various places in the country. The national capital has become a safe haven for criminals from not only various states of India but also neighbouring countries. Law & Order stand compromised as all branches of civil & police administration have come under domination of the politicians, who treat themselves above the law, calling themselves "people's representatives". They are not satisfied to be called the MP or the MLA as the case may be, but people's representative. They not only threaten police officers, engineers, doctors, professors, nurses, school teachers, civil administrators, lower ranks in civil or police administration, but abuse them publicly and also beat them. They can't be categorized as the Social Justice Activists. They are criminals, thriving on vote bank politics, distorted version of Indian democracy, money & muscle power, siege of all elected chambers of democracy, a grouping of like-minded politicians, carving out territories for exploitation amongst themselves, a fragile justice system which suffers from a jurisprudence alien to the Indian realities in a language equally alien leading to delays amounting to denial of justice. The courts go on only interpreting words and expressions in the text of the law ad nauseam from the trial court to the District Court to the High Court to the Supreme Court to the President in some cases. Social justice in these circumstances has been reduced to the monopoly of the entrenched centres of power in a few hands, resulting in unlawful concentration of all means of delivery of social justice to the target groups including their livelihood & income, education & health, security of their person & property. Crying for social justice is a far cry in the jungle- only aranyarodan.

Will vested interests allow NAMO to work ?


Modi Governments National Litigation Policy is welcome move. But will vested interests allow NAMO to work and bring in reforms. This is doubtful. Modiji is on right track but there are very big hurdles on the way. Bureaucracy is biggest hurdle. Central Administrative Tribunal Judgments are of poor quality. The administrative judges have poor knowledge and treating judgments like file disposing. It is taking years for cases to be decided. Just like files kept in cold storage till some one approaches for bargaining. Tribunal becoming like those dusty sarkari daftars with tired yawning Babus who light up and become alert only when offered bribe.

Tribunals were set up to cut short delay


Reading about the discussion on CAT, I am provoked to add my experience on the subject.( incidentally as Joint Secretary Establishment I had to work hard on Central Administrative Bill before its introduction in the Parliament) One of the grounds for setting up these tribunals was to cut short the delay in the finalisation of cases as also free the high Courts from the burden of hearing administrative cases.Tribunals have failed to meet the first objective.The second objective has been thwarted by the Apex Court itself by maintaining in a case that the inherent power of High Courts to hear appeals against the judgement of CATS cannot be taken away.The result is that the Department has the tendency to file a Writ Petition in the High Court against most of the judgments which are in favour of the employees.First the CAT takes years to decide a case because of too many cases before it or the Respondents manage to get too many postponements on one pretext or the other.Finally if the employee wins there is a Writ petition filed by the Government in the High Court.Once there the case gets lost and by the time it is decided the employee may retire.My observation is based on a typical case I oversaw of the Seniority of Group A officers Of the Railways whose UPSC merit based seniority was changed years after their training was over on the basis of a forgotten, full of flaws and incomplete letter in a most clandestine manner without giving the officers any chance to explain their case.Full Bench of CAT pronounced the judgement after six years in favour of the officers on number of petitions filed by them terming the action of Ministry Of Railways as ,malafide and unethical.Railways filed a Writ petition in the High Court.17 years on and scores date postponements the hearing was over over in December 14.the judgment was reserved.Almost a year after the same was delivered in November 15.By this time it seems the Bench had forgotten the facts as they agreed with the Petitioners ie the Ministry Of Railways on something the respondents had never challenged and brushed away the points raised by the full bench judgement of CAT in favour of Officers.The affected officers are a bewildered lot.Going in appeal to the Supreme court will mean time and money which they cannot afford and they are not sure the judgment will come before they retire.So there they are where they were when they went to CAT against the manipulation of their seniority.I really think the Central Administrative Tribunals should be abolished.

No preparations for national litigation policy


Department of revenue simply has refused to make preparations for national litigation policy. They say the policy is only for revenue matters and not for service matters. This attitude is going to delay the implementation of the policy. Unless the P. M. gives them a dressing down again, they are not going to improve.

Malfunctioning of CAT


Of views of viewers in your cols. about the malfunctioning of the CATs and the instances can be multiplied manifold. I understand that in the high courts, there is some machinery available in the form of judge(admin) to whom one can report cases of misconduct of a judge in judicial matter, while there is none in the CAT set up as I was myself a victim. As the high court exercises writ jurisdiction over the CAT,it would be reasonable to extend the jurisdiction of judge(admn) over the CATs so as to provide a redressal system to the aggrieved in the interest of equity and Fair Play.

There is a hue & cry regarding similarly placed individuals should be treated alike in Service matters. Some time back there was a comment about "LEFT OVER BATCH" in IRS (IT) about promotees in excess of DRs are not given equal benefit of same batch concept, which is is not prevalent in any other service which results in avoidable litigation. Let DoPT/ CBDT look into this (non)issue.

Seeking copy of Caste Certificate of an officer

Appellant sought a copy of Schedule Tribe (ST) certificate of a particular officer under the RTI Act, on the basis of an assumption that it might be fake. The PIO replied that SC certificate was not enclosed to the service book of the officer. The Central Information Commission (CIC) asked the appellant whether the appellant is having any basis to his suspicion about the ST certificate and about his interest in seeking these details, but the appellant could not convince the CIC. The CIC observed that the appellant had been heard earlier by it in several appeals. The CIC commented that the appellant is a cantankerous misuser of RTI and does not deserve any sympathy or information, as there is no public interest. The appellant is wrecking vengeance against the authority and officers for taking stern action against his misconduct. The CIC admonished him for misuse of RTI. The CIC ruled that the Public Authority can reject his RTI applications about inquiry and inquiry officers as that would impede the entire process of inquiry.

Comments

There is no specific provision in the RTI Act regarding rejection of an application for alleged misuse of the RTI Act. However, the CIC has repeatedly come to the aid of the PIOs in cases of harassment by repeated filing of applications.
