AIS officials have not changed
Despite very high moral ground govt. at the Center, the AIS officials
have not changed their tracks. The one such instance is that one of
the Officer of the UT cadre who has been appointed JS in MHA has brought
in more than 7 offcials as his personal staff from Delhi Police despite
the fact that regular officials are available with the Ministry. What
is the motive of bringing these officials who have been with him for
over the years. This is one incident there are innumerable instances
where these Delhi Police officials are working. On the one side DP cries
for shortage of staff and these are the way of man management. This
practice needs to be stopped and these people should be manning Delhi
instead of serving to individuals. Unfortunately this is happening under
the nose of Home Minister. This practice needs to be checked in otherwise
there is no end to it.

result of recommendations of 2nd Administrative Reforms Commission.

No opportunity to express views on respondent's arguments
I also know of such a case in CAT Mumbai. The applicant was heard in
June 2014 and the respondent in October 2014.The applicant was not given
an opportunity to offer his views on respondent's arguments, and the
judgment peonounced. Even though the UPSC had stated that proper procedure
was not followed, the judges concluded that it had been followed. Even
the matter was heard after four years of pleadings were completed.Member
Admns in the CAT are not upto the mark. That is why the same needs to
be abolished.

Recommendations of PESB
the recommendation of certain candidates who has dubious track record
by PESB shows that there is no transparency. PESB should publish the
track record/profile of candidates along with recommendation criteria
in the web. PMO should look into it and all PESB recommendations since
October 2015 should be cancelled and get it investigated and make PESB
selection transparent.

It has stirred up a hornet's nest
What ever one may term Justice Karnan's judgement and stay order of
SC Collegium's transfer orders, it has stirred up a hornet's nest. Many
may feel it as the result of SC's involvement in administrative functions
like transfers and appointment of judges. After all transferring and
appointing judges is not a judicial function and can be questioned in
the High Courts.

Seeking copy of Caste Certificate of an officer
Appellant sought a copy of Schedule Tribe (ST) certificate of
a particular officer under the RTI Act, on the basis of an assumption
that it might be fake. The PIO replied that SC certificate was
not enclosed to the service book of the officer. The Central Information
Commission (CIC) asked the appellant whether the appellant is
having any basis to his suspicion about the ST certificate and
about his interest in seeking these details, but the appellant
could not convince the CIC. The CIC observed that the appellant
had been heard earlier by it in several appeals. The CIC commented
that the appellant is a cantankerous misuser of RTI and does not
deserve any sympathy or information, as there is no public interest.
The appellant is wrecking vengeance against the authority and
officers for taking stern action against his misconduct. The CIC
admonished him for misuse of RTI. The CIC ruled that the Public
Authority can reject his RTI applications about inquiry and inquiry
officers as that would impede the entire process of inquiry.
Comments
There is no specific provision in the RTI Act regarding rejection
of an application for alleged misuse of the RTI Act. However,
the CIC has repeatedly come to the aid of the PIOs in cases of
harassment by repeated filing of applications.
