Chairman DERC - who ?


The selection of Chairman DERC is a toss up between a retiring Secretary, Govt. of India and a Chief Commissioner of Income Tax. The CM Delhi seems keen on the Income tax officer for obvious reasons. Meanwhile LG, Delhi, who is to approve the final appointment; had not even approved, reportedly, the constitution of the Selection Committee. Where does that leave the legality of the full process? Eventually it seems that the Delhi Govt will be run by High Court and not the LG or the AAP.

No law of land in MOS&PI.

Any one can noticed that in last fortnight, member of Indian Statistical Service (ISS) and Subordinate Statistical Service (SSS) are being transferred frequently from one place to another place in throughout the country in the absence of structured transfer policy. As per various instructions of DOP&T, transfer policy is mandatory for all cadre controlling authority. These transfers can be challenged before the Court and culprits can be punished.

The concept of Rule of Law is that the state is governed, not by the ruler or the nominated representatives of the people but by the law. The Constitution of India intended for India to be a country governed by the rule of law. It provides that the constitution shall be the supreme power in the land and the legislative and the executive derive their authority from the constitution.

Govt should take steps


The Government jobs provide a very meagre percentage of jobs in the country i.e. in between 1 to 2 percent. Reducing of retirement age and providing of reservation is no panacea to all the ills of jobs in the country. More and more industries and service sector will have to come in the country to provide jobs. People will also have to be self-employed. The youngsters running away to the cities for jobs leaving behind their farms should be told to go back in their nuclear families wherein they will be looked after properly. In order to make their agriculture business viable Government will have to step in by providing water, proper seeds & fertilizers, mechanized farming facilities, better roads and air-conditioned, transport arrangement and storing facilities.

UPSC appointments should also be transparent !


Not just PESB, even UPSC appointments should be transparent, no doubt about it. At least this new government has taken initiative to have better people on PSU boards, look at Air India which is now turned profitable with consistent years of loss but just because a able person was brought in as CMD.

Where were you people when all wrong appointments happened during previous government ? Every PSU selection had a price tag (Yes Price Tag) during previous panel of PESB ? Both Suyas and Shashank want changes overnight. How is it possible in a system that is corrupt for years ? Be patient, give time, things will certainly improve in bringing transparency and accountability.

Seeking copy of Caste Certificate of an officer

Appellant sought a copy of Schedule Tribe (ST) certificate of a particular officer under the RTI Act, on the basis of an assumption that it might be fake. The PIO replied that SC certificate was not enclosed to the service book of the officer. The Central Information Commission (CIC) asked the appellant whether the appellant is having any basis to his suspicion about the ST certificate and about his interest in seeking these details, but the appellant could not convince the CIC. The CIC observed that the appellant had been heard earlier by it in several appeals. The CIC commented that the appellant is a cantankerous misuser of RTI and does not deserve any sympathy or information, as there is no public interest. The appellant is wrecking vengeance against the authority and officers for taking stern action against his misconduct. The CIC admonished him for misuse of RTI. The CIC ruled that the Public Authority can reject his RTI applications about inquiry and inquiry officers as that would impede the entire process of inquiry.

Comments

There is no specific provision in the RTI Act regarding rejection of an application for alleged misuse of the RTI Act. However, the CIC has repeatedly come to the aid of the PIOs in cases of harassment by repeated filing of applications.
