India is lucky to have Modi as PM


The country is indeed lucky to haver a P.M. like Modi. He is travelled abroad extensively to improve our relations with the different power blocs. Now he must devote more time to the national problems in all fronts. He should do his bit to improve governance and see that the govt. policies are being promptly and properly implemented. Firm action is also needed against loudmouthed politicians who create law and order problems. Agriculture and industrial growth needs to be given a boost as the Chinese downslide has badly mauled Indian economy.

No statesman leader, fault lies with us


I agree that we have not been able to produce a Statesman/Leader who could command respect of the entire country .The fault lies with us ,the people of the country .Majority of the people still consider Politicians as" Masters " and become subservient to their whims .Otherwise one can not explain how a politician in jail contests in election and wins ! Even in cities why people invite a Politician to be a chief guest for a function ? What is needed is a change in thinking of people which can be done by NGOs or other civil societies through constant campaigning .Further people should boycott politicians unless they make drastic change in electoral laws to ban charge sheeted persons to contest election, small regional parties to contest Lok Sabha elections etc.

DATE WITH RTI

Action taken on sexual harassment complaint

Copy of enquiry report and action taken report on appellant's complaint pertaining to sexual harassment to his wife at work place was sought. The respondent informed that the information sought could not be provided under the provisions of Section 8(1)(h) of the RTI Act as the disclosure of information at that point of time would impede the process of investigation. Subsequently, the SBI informed that an inquiry by the Internal Committee constituted under Sexual Harassment Committee was conducted and the Committee's report and the findings of the Committee had already been communicated to the wife of the appellant. They further added that as per Section 16 of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 the contents of the complaint made, the identity and addresses of the aggrieved woman, respondent and witnesses, any information relating to conciliation and inquiry proceedings, recommendations of the Internal Committee or the Local Committee and the action taken by the employer or the District Officer under the provisions of this Act, shall not be communicated to the public and media in any manner. Further, the appellant has no locus standi to file complaint on behalf of his wife. The CIC accepted the submissions of the respondents. However, the PIO was directed to pass a speaking order on appellant's RTI application.

Comments

In the cases of sexual harassment, the Supreme Court guidelines issued under the Vishakha case have to be followed. The CIC has preferred not to issue a notice to the third party under section 11 and has upheld the denial of information.
