Believe it or not, the number of name droppers and power brokers in Delhi circles have reduced drastically under Modi regime.

Post the R.K. Jain Vs. Union of India & Ors [1993] INSC 297 (14 May 1993), by convention , the President of CESTAT9the CEGAT), the Chief Justice of India was asked to nominate the person for appointment as President of the Tribunal. Thus 3 successive Presidents were Retired Chief Justices f High Court and subsequently Retired Judges. The Supreme Court had also directed that: "It is also expedient to have a sitting or retired senior Judge or retired Chief Justice of a High Court to be the President. The rules need amendment immediately. A report on the actions taken in this behalf be submitted to this court."
The Finance Ministry in a brazen disregard for the past convention is again transgressing into domain of the Chief Justice of India by appointing a Committee to select President of CESTAT. Hitherto, Members of CESTAT were selected by such a Committee, never the President.

Finally suspense is over ,Gurdeep Singh, Managing Director, Gujarat State Electricity Corporation, has been appointed as Chairman-cum-Managing Director, National Thermal Power Corporation Limited (NTPC) for a period of five years.

CMD, NTPC unlikely to be an IAS officer ?
All indications available say that no IAS officer is likely to be appointed new CMD of NTPC. The appointment is expected to be made in December.

Aman Singh was the choice but he was considered more important for Chhattisgarh !

On merit, considering his outstanding performance in interaction with SCSC and impeccable and impressive track record in Chhattisgarh, Aman Singh was the favourite for the post of CMD NTPC till last minute. Gurdeep Singh was lucky as after a lot of deleberations and political consultations at the highest level, it was decided that Aman Singh's services are needed more in Chhattisgarh because a state is more politically important that a PSU. This was also a reason for delay in decision as consultation needed time. Hence, it is said Gurdeep Singh was a last minute beneficiary.

FM always smiling in the company of billionaire businessmen

Not a day passes without seeing the photos of our FM smiling in the company of billionaire businessmen. The news about his exhortations to the businessmen in institutions like FCCI and CII are every day news. In his last budget he has lessened the tax burden on companies while giving no solace to the middle class tax payers. Inspite of Government's daily claim of reducing inflation, prices of every commodity from toamato to urad dal to gas have all gone up up. Inspite of the lowering of world crude prices around 20$, a barrel(earlier it has gone up to 120$ and above),government has done nothing to reduce the price of petroleum products especially that of diesel on which depends the cost of transportation of agricultural commodities and prices of many items like rice and vegetables. People suspect this to help one business house who own the biggest refinery in the country and who are raking in billions as profit. Chinese goods from nails and screw drivers to TVs are flooding the market resulting in the closure of many small scale industries. People feel this is evidently to help people from Gujrath who are reportedly the main import agents for Chinese goods. Also Marwadis and Gujrathis who strated as pawn shop owners in cities like Bangalore three years ago are now opening Malls, all without paying any taxes while tax sleuths are after middle class tax payers.

The trail of illegally hoarded foreign black money appears to have reached no where, with Modi going by Jaitley's wrong advice of taking the tax evasion route route much against the advise of noted lawyers like Ram Jathmalani. Here also people suspect that it is to help people from Gujrath who are reported to be the main culprits. So also are the corruption cases like CWG, Tetra, Helicopter, HDW and others which Modi cleverly used in the last elections. The gap between billionaire businessmen, some of whom Modi takes with him during his foreign jaunts to help them have direct access to the countries' leaders and our middle class is increasing by leaps and bounds. Many including pensionless retirees, middleclass NRI returnees and others who depend on FD interests for their survival are in deep trouble with FD interests going downfrom 10.5% to 8% and lesser in the future.

Modi's FM appears to be unsympathetic to the middle class. Nobody need be surprised if Modi and BJP get a royal kick from the voters in the next elections and bring back the corrupt Congress.

Litigation policy only for revenue matters not for personnnel?


An office memorandum doing the rounds of all the Govt offices regarding new National Litigation Policy of the Govt of India as per which cases pending in courts and tribunals are to be compiled for a decision of government for withdrawal of the same. It is surprising that the list being prepared in CBDT is not being prepared in respect of personnel matters which directly affect the morale of employees. The govt should clarify to the CBDT that the list should included all types of litigations pending in courts.

Action taken on sexual harassment complaint

Copy of enquiry report and action taken report on appellant's complaint pertaining to sexual harassment to his wife at work place was sought. The respondent informed that the information sought could not be provided under the provisions of Section 8(1)(h) of the RTI Act as the disclosure of information at that point of time would impede the process of investigation. Subsequently, the SBI informed that an inquiry by the Internal Committee constituted under Sexual Harassment Committee was conducted and the Committee's report and the findings of the Committee had already been communicated to the wife of the appellant. They further added that as per Section 16 of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 the contents of the complaint made, the identity and addresses of the aggrieved woman, respondent and witnesses, any information relating to conciliation and inquiry proceedings, recommendations of the Internal Committee or the Local Committee and the action taken by the employer or the District Officer under the provisions of this Act, shall not be communicated to the public and media in any manner. Further, the appellant has no locus standi to file complaint on behalf of his wife. The CIC accepted the submissions of the respondents. However, the PIO was directed to pass a speaking order on appellant's RTI application.

Comments

In the cases of sexual harassment, the Supreme Court guidelines issued under the Vishakha case have to be followed. The CIC has preferred not to issue a notice to the third party under section 11 and has upheld the denial of information.
