IRS-IT officers up in arms
The officers belonging to Indian Revenue Service of Income Tax have
decided to pin black badges as a mark of protest against the illegal,
whimsical, unfair and biased decisions taken in matters of Human Resource
Management and targeted transfer and postings as a tool of punishment
and harassment at various levels as well as undue interference in operational
matters of executing the Income Tax Ac-1961. In an emergency General
Body meeting held recently, the Indian Revenue Service (IRS) Association,
the members expressed concern over the general delay in promotions of
all batches and particularly the situation of 1981 batch, 83 batch,
left over of 87 batch and 88 batch and 94 batch. It was reiterated in
this emergency meeting that the Department of Revenue should strictly
work as per the Government of India's allocation of Business Rules 1961.
The views of the TARC on the subject should be implemented expeditiously,
which in its first report in 2014 in Para III has stated as under: "According
to the Government of India Rules, the role of the DoR is restricted
only to dealing with matters concerning the CBDT or CBEC. However, it
has no powers to exercise any supervision or control over CBDT or CBEC
or any of its attached offices. Similarly, the DoR has no power to administer
direct or indirect tax and its functions in respect of these acts are
restricted to replying to questions thereof to the Parliament. The DoR
has also no role in the administration of the Indian Revenue Service,
Income Tax or Customs and central excise. The power to issue instructions
to the I-T authorities rests statutorily with the CBDT, and, in the
case of indirect taxes, with the CBEC. Instances have come to the notice
of members where the authority exercised by the DoR is not in consonance
with the GoI, Allocation of Business Rules, 1961 and hence is devoid
of any legal baking. The undue interferences in the operational matters
of executing the Income Tax Act, 1961 has been strongly condemned by
the members of the Association. Unfair and whimsical actions by DoR
Affecting the morale of the service in matters of Human Resource Management
of the Department especially targeted transfer and postings as a tool
of punishment and harassment at various levels has been unequivocally
condemned by the members.
CBI disposes 3586 corruption cases in four years
Central Bureau of Investigation (CBI) claims to have disposed off 3586
cases of corruption out of total 3970 registered from 2013 to June 2016.

JNPT gears up to put its customers at Ease
(UPDATED)
Jawaharlal Nehru Port Trust (JNPT), India's No. 1 Container port that
handles half of container cargo of the country, has effectively implemented
various 'Ease of Doing Business initiatives' as guided by Ministry of
Shipping, Government of India. Addressing media on this occasion, Anil
Diggikar, Chairman, JNPT said, "During recent years, JNPT has taken
a number of initiatives for faster and economical operations that has
helped in reduction of cost, time and documents and thus making it easier
for the clients and partners to do business with us." Port has
started inter-terminal movement of tractor trailers (TTs) and also incentivized
the movement of containers from and to CFS by rail. These two initiatives
have taken a lot of pressure off the road. Another major step has been
the commencement of direct port delivery (DPD) from the terminal for
ACP clients. The transaction time and money is saved by avoiding the
earlier format of taking containers to the CFS and clearing it from
there. JNPT port has allotted additional area to the private terminals
to facilitate more DPD volumes. There is significant increase in the
number of containers cleared after removing the minimum volume criteria
for availing DPD facility. In pursuance of port initiatives, the shipping
lines have switched over to e-delivery orders in place of manual orders
which has now made container deliveries quick and hassle-free. Last
month the port has implemented logistics data bank tagging of containers,
first of its kind facility in India that will help importers and exporters
track their goods in transit through logistics data bank service. To
further streamline the traffic, port is in process of installing CCTV
cameras on port roads to provide live feed to trade for better business
planning. Neeraj Bansal, Dy Chairman, JNPT added "For bringing
more transparency in the operations of logistic chain we are sharing
all the relevant information about the Port and other stakeholders with
the trade and in the process empowering trade in making the right business
decisions.

It is some quipped in the corridors of power that what you know is immaterial
but whom you know is most important. Hope this adage will be reversed
in the present governmental setup. People in IOFS who actually work
very silently are not known leave alone the appreciation aspect.

It will be disastrous to appoint any outsider as Chairman, Railway Board.
This idea should be abandoned in the larger interest of the Nation.

Officers of railways are far better than others in terms of delivery
It is very amusing that Ministry of Railways has constituted a panel
for selection of Chairman Railway Board. It means that the Railways
do not have faith in the officers who have served it for decades. The
officers of the railways are far better in terms of delivery than any
one from other services. See them when the there is an accident. The
most senior officer - DRM monitoring the relief operation from the site
of accident rather than from the air-conditioned offices. As the things
are moving , the day is not far when there will a panel to select Army
Chief or Chief Justice of India from outside.

Will an IAS understand tax ?
Will an IAS know what is tax, which incomes are exempt, what are income
accrual and expenses incurred. Will he know what is the importance of
judicial decisions and how to harmonise a decision with the provisions
of Income tax Act. Still IAS is Secretary heading Revenue of GoI.

CBI's power to arrest needs to be looked into
As observed by special Judge Arvind Kumar in Rajendra Kumar's case,
CBI's power to arrest needs to be looked into. Most of the cases handled
by CBI relate to public servant and are based on files/documents .They
seize all documents related to the case while conducting PE. Further,
the concerned official(s) are still in service and they are not going
to run away. So there is no need to arrest them . DoP&T which controls
CBI should issue clear orders on CBI's power to arrest and also make
their officials accountable for registering cases on flimsy grounds.

Who is the Nodal Agency to implement educational concession
for SC/ST students?
Appellant submitted a copy of UGC circular dated 19.08.2009 vide
which all the universities receiving grant-in-aid were asked to
provide reservations to SC/ST students & sought information
about its implementation The CIC observed that the UGC is passing
the buck to Ministry of Human Resource Development (HRD) and MHRD
was saying that information is not available. The CIC directed
the UGC wing of MHRD and UGC to collect the information from the
universities / deemed universities about implementation of extended
reservation and concession to SC/ST students in Self financing
courses offered by the respective institutions & provide it.
A show cause notice was issued to the PIO of HRD to show-cause
why maximum penalty should not be imposed for non-furnishing of
complete and correct information to the appellant.
Comments
It is sometimes seen that some organisations issue circulars without
providing for a means for its monitoring its implementation. It
makes little sense for an organisation to issue a circular if
its implementation cannot be monitored.
