Young IAS officer no more, prayer meeting on June 8
2006 batch IAS officer of Uttarakhand cadre Akshat Gupta has passed
away in Delhi due to cardiac arrest. 39 year old Akshat is survived
by his 2005 batch IPS wife Ridhim Agrawal and two children. His elder
sister, Rakhi Gupta Bhandari, is a Joint Secretary in Union Home Ministry,
while his brother-in-law Rahul Bhandari is Resident Commissioner, Punjab
Government, in Delhi. His elder sister Roli Agrawal is 1992 batch IRS
officer married to Subodh Agrawal 1988 batch IAS officer of Rajasthan
cadre. His third sister is married to 1995 batch IAS officer of MT cadre
Ashutosh Jindal, Joint Secretary - Commerce. IFS Madhav Chandra and
1982 batch IAS officer of MP cadre Raghav Chandra are his maternal uncles.

"No place for dictator in India"
India being the largest, vibrant democracy, there is no place for dictators.No
leader can be put in the category of Hitler, Mussolini, Idi Amin, Gaddafi
, Saddam Hussain or even the present day Kim Jong of North Korea.
Of the ten political celebrities enumerated in WIC, I would focus on
PM Modi and Ms Sonia Gandhi. The rest exhibit specific personality traits
that give the misleading impression of being dictators. Sample these.
Kejriwal( confrontationist,); Mamta Banerjee ( mercurial, impulsive
); Vasundhra Raje ( arrogance of power );Nitish Kumar( loud mouth of
jungle raj) ; Jayalalithaa( Obdurate, calculative); Naveen Patnaik (
ruling Orissa without knowing the mother tongue but, thanks to a weak
Opposition ) K Chandrasekhar Rao (opportunistic ) and Mehbooba Mufti
(politically shrewd, bound by the Constitution of J&K ). Having
said that, let us now analyse PM Modi and Ms Sonia Gandhi.
PM Modi is a leader. He has not come to just sit silently and sign
on dotted line like his illustrious predecessor. Decision-making was
out-sourced under UPA. Former PM Dr Manmohan Singh was " hired"
to formalise decisions taken by extra-Constitutional persons on extraneous
considerations. Modi may not be considered as highly qualified as his
illustrious predecessor. But, he, surely, has an independent mindset
to get the work done . His body language exhibits his disciplined approach
and impatience, not dictatorial temperament. But, such an attitude will
do more good to the country than bad. To push developmental reforms,
a strong leader like Modi, is needed who will not bow before anyone
within the party or opposition. Contrast this with the mild-mannered
Dr Manmohan Singh, whose reticence led to UPA's serial scams. Corruption
can be attributed to a weak Prime Minister.
On the flip side, Sonia Gandhi had been the worst autocrat that we
had during ten years of misgovernance under UPA. She was the de facto
PM. Dr Manmohan Singh, the spineless and pliable, was planted as de
jure PM. By backseat driving, Sonia Gandhi misused all powers- political,
financial and administrative, with zero accountability. Dr Pranab Mukherjee's
claim to Prime Minister ship was ignored due to his independent mindset.

Will new criteria lay down parameters ?
Hope the new criteria lays down parameters which are verifiable from
factual documents and not on individuals opinion .It is suggested that
the new criteria should be posted on the website of DOP@T for the benefit
of officers.

Empanelment criteria changed in GoI
Empanelment criteria changed in GoI (WIC 6.6.16): Yes JS Empanelment
process in GOI needs to be drastically changed. Presently, the criteria
suits only IAS officers at the cost of 36 non-ias organised Class-1
services, including professional services of Doctors, engineers, Law,
CAs etc. See the trick. Very few IAS come at Director level on deputation
to GOI, hence the process of empanelment of Director does not exist.
Officer of any service can apply to DOPT and get retained for posting,
without waiting for their senior batches to apply for deputation. There
is no process of 'empanelment' at Director level. But since, lot of
IAS officers apply for Joint Secretary level postings in GOI, hence
they have prepared a 'biased' criteria of empanelment for themselves,
which make non-ias officers ineligible. The rules in DOPT have been
made BY ias, FOR ias. The tricky rules of biased eligibility criteria
for JS 'empanelment' are:
1. All senior batches should have been empanelled as JS in GoI. (Reason
- IAS officers seek deputation to GoI on a regular basis, every year,
hence their cadre controlling authority i.e. rule-making DoPT itself,
ensures their empanelment as JS with an unfailing regularity, every
year. Officers of remaining 36 non-ias services do not enjoy this privilege
and blessing of DoPT, hence they are out of race for being posted as
Joint Secretary to Govt of India. In one non-ias service, officers of
even 1971 batch have not been empanelled as JS, till date. Hence junior
batches possessing minimum eligibility of 17 years of service are not
eligible for being empanelled as JS.)
2. Officers should be drawing grade pay of Rs.10,000 in PB-4 in their
cadre. (Reason: IAS knows that theirs is the only cadre who gets regular
time-bound promotions in States. Although, other 36 non-IAS services
fall under the category of organised services, but their officers are
not given time-bound promotions. Hence, they get delayed because of
this and become ineligible for being empanelled as Joint Secretary.
Again, IAS gets the artificially created edge.)
3. Officers should have completed 17 years of regular service as Class-1
officer. (This clause is ok and is necessary).
Suggested Modified Procedure for appointment to Joint Secretary Level
posts in GoI:
1. Empanelment process should be abolished completely, as in case of
Director level postings in GOI. There is no empanelment process for
Director level posts in GOI. An Officer has to simply apply to DOPT,
even if his senior is not applying, and is given posting. He need not
wait for his seniors to apply first.
2. There should be no bar, as in case of Director, that all senior batches
should have been empanelled or applied for posting as Joint Secretary.
In the existing system, cases of all senior batches, say from 1971 and
onwards, have to be processed including data feeding of their 10 years
ACRs, who may ultimately not be willing to leave their cadre post and
proceed on deputation. Why should the time be wasted in processing of
cases of unwilling officers for JS, at the cost of delay of willing
junior officers?
3. The eligibility criteria for JS should be: (a)Any officer who is
in PB-4 band (Director level, Grade Pay Rs. 8700) AND (b) has completed
17 years service in Group-A, should be eligible to apply. This shall
make majority officers of 36 non-ias officers eligible for JS posting
in GoI. It may be noted that both the Director and JS belong to the
same pay-band PB4.
Only the present PM Narendra Modi has the courage to defy biased norms
and bring change drastically for the betterment of 36 non-IAS organised
services, including Govt Doctors, Engineers, Scientists, Law experts,
Accountants etc. Jai Hind.

Why do All India Officer have cadre ?
When most of the officers are on deputation, then what is their contribution
for the respective state. There is a need to have reform in these services
to make officers more accountable.

DGQA needs to be wound up
If there is one institution that needs to be wound up in a liberal economic
and industrial set up, that is DGQA. Every Defence industry should have
its in house quality assurance division and products should be purchased
on self certification. What about the Defence equipment that is imported.

The Appellant had asked for certain information about a bank account.
Before the CIC, he claimed that the PIO had not responded to the
appellant within the time frame prescribed under the RTI Act.
The CIC observed that the PIO had sent a point-wise response to
the appellant within the stipulated period and directed the PIO
to provide proof of dispatch to the appellant.
Comments
A PIO should not only provide the information to an applicant,
but should also keep a record of the same lest a charge of not
following the time limit is made against him. In case of failure
to provide the proof of timely dispatch of information, penalty
might be imposed on the PIO.
