Is it the first step towards PM Modi's promise of Rs 15 lakh in each account ?

Prime Minister Narendra Modi, during the run up to the 2014 Lok Sabha election, while prominently highlighting the issue of black money had promised to bring it back and said that every citizen will receive Rs 15 lakh in his bank account. Is the demonetization of Rs. 500 and Rs. 1000 note a step towards the same ? .

Now be prepared to relinquish comforts

While demonetizing of Rs. 1000 and Rs.500 currency notes and problems caused thereafter to the common man was being discussed at a get-together, a bureaucrat said, "One should now be prepared to relinquish comforts which many people have been wrongly enjoying under the garb of freedom and democracy for the past several decades".

Million Dollar Question

Getting rid of Black money in one go is welcome by all. However million dollar opinion doing rounds in the corridors of power is that this government may be wiped off in upcoming elections by the tax terrorism that may follow if government does not tighten up loose ends in this area. Howsoever cautious government may be on this front but even one single wrong move by the tax authorities may undo all the good work done. The government especially has to take care to preventing harassment to farmers and middle class from the taxman at any cost. Farmers are the biggest lobby holding cash and will be depositing it in banks in the next 50 days. If the taxman act blind, the whole farmer lobby may take on the government in the same way it did on the land acquisition act. Second largest honest but disgruntled may be housewives who have accumulated secret savings in few lacks but would be harassed if they deposit it. And we know farmers, middle class and woman power in this country has always changed governments.

India going Plastic ...

Today my train buddies and me ..we decide to have high tea at a South Indian Eatery opposite the Churchgate Station. Over Dosas, Idlis and Coffees we get chatting ...

Anotony: I checked.... this place accepts Debit Cards ......
Amar: Bhai get used to paying via Plastic Money .... cash circulation will not be like it used to be !! India's going Plastic.......
Me: It's all part of a plan to make India go 'White'!! Plastic makes one accountable!!!
Antony: Kejriwal is questioning Modi ...he says Modi appearing in a Paytm ad shows that Card Companies are behind this demonetization!
Me: So this means Kejriwal is pro Airtel ....or there is huge money in Medicine and that's why Kejriwal is for Mohalla Clinics !! I think his Modi allergy and his penchant to become the PM are so much that he does not think and talk/tweet!!
Akbar: So this Government thinks all of us are tax Chors!!!!
Amar: With the wheat the chaff also gets ground ... you can't deny that India has a parallel Black Economy!! We are paying for ...'Rulers' being corrupt and overlooking some of the Prajas choris so that they don't create a hue and cry about the humongous choris done by the 'Rulers'!!!
Antony: It's so inconvenient standing in queue to deposit/ exchange old notes ……
Amar: Yaar our Faujis walk miles for the Nation..... our Freedom Fighters walked miles for our Freedom ..can't we stand in queue thinking ..its for my Nation!
Antony: I still do not understand why Government issued Rs 2000 notes....defies logic of fighting Black Money !!
Me: I think the Printing of 500 Notes started when Rajan was the RBI Guv.... Government then too was aware of the Counterfeiting and I understand 500 notes were printed!! 2000 printing because RBI felt there was need for a higher denomination Note ...Government shot down RBI Proposal for 5000 and 10000 Notes!!
Amar: But despite the knowledge that counterfeiting was harming India tremendously……. UPA .... specifically PC. .. did not do what Modi has done!! Maybe he lacked the guts to take such a decision!!! So they were planning to just phase out old 500 Notes and replace with New Notes...as attacking Black Money was not their objective!!
Me: Now a huge amount of Black Money has been reduced to waste paper!!!
Akbar: Arre the Rich and Powerful will find ways to convert their 500 and 1000 Notes!!!
Antony: Absolutely …. it's we the Commoners who will suffer!!
Me: The other way around … at the Bank Counter …Raja and Runk will be the same…. the scrutiny will start later by the IT Authorities…. the Honest will have no problems whatsoever because their 500 and 1000 Notes deposits will be borne out by their IT Returns…..
Amar: Yes the Government that took such a daring step has 'daring' methods in place to meet the goals of this daring step!!
Akbar: I hear that Officials were locked up on the day Modi made this announcement …
Me: Don't sensationalize …. for the Cabinet Meeting ...Ministers and Officials were asked not to carry Mobile Phones ..and after they were informed they stayed back till 9 pm... as Modi went to make the announcement!! This Government has again proved it does not 'leak' like UPA did!!!
Antony: I think this decision has made Modi very unpopular!!!
Me: I think the Honest Indian is very happy!!! You will see this play out soon!!! Yes Congress etc., can play the role of Naarad to the hilt and try to create problems… but like they say …yeh Public hai sabh jaanthi hai!!
Akbar: Trump's coming into White House spells doom for the World!!!
Antony: Why….. just because he's anti-Muslim!!!
Akbar: Arre you forget we have a considerable presence in US and Muslims are closely watching Trump!!!
Antony: But we Christians are in a clear majority!!!!
Amar: Buss karro….. you guys are fixated with majority...minority etc. I think Americans consider themselves as Americans First ...
Me: But this is for sure this US Election has sounded the Death Knell of Psephology!!!
Amar: Nathi …. Psephology's Motta Bhai -TRP che .... Mata-Vested Interests che and Baa (Grandmother)- 'The Raaj's' (winking) Philosophy che…..these will never let Psephology die in India....unless Baa goes!!!!

The people have spoken, Hillary is vanquished. Many so called liberals in India had intellectually opposed Trump just like many in America had disliked Modi. Proving these intellectuals wrong, Trump has emerged victorious. Trump is a businessman with little political experience. Especially in foreign affairs, he is considered by many to be a novice. Information Commission to examine the public interest in each case of second appeal

Vide multiple RTI Applications, the appellant sought different information from the EFL Univeristy, Hyderabad. The CIC examined whether the details about appointment of standing counsel and expenditure incurred can be shared under RTI with the appellant? Another issue related was whether legal opinion rendered by the standing counsel to the University should be considered as given under 'fiduciary capacity' and hence be denied. The CIC referred to the Section 126 of the Indian Evidence Act, 1872 and the section 91 of CrPC apart from various Court judgments. It was observed that Section 22 of RTI Act which accords overriding effect to RTI over all other statutes cannot be totally brushed aside, and it has to be read in addition to provisos in Section 8 of RTI Act. The CIC noted that the appellant and his wife is having a right to seek legal remedy in a court of law, which is an issue of public interest. The CIC ruled that the copy of note file of the EFL University containing order issued by the Vice Chancellor to obtain pointwise legal opinion from the advocate is a privileged communication between university and its legal counsel. The CIC held that the University is under an obligation to disclose on his own entire information about the process of appointments as per the DoPT Office Memorandum dated 30th June 2015. The CIC directed the Public Authority to intimate the basis of appointing a lawyer in RTI proceedings, along with expenditure involved along with the copy of opinion given by the standing counsel after severing exempted information.

Comments

This order of the CIC sheds light on what is Public Interest and the role of the Information Commission in such cases. The CIC has categorically ruled that it is the duty of Information Commission to examine the public interest in each case of second appeal. Further, it has been held that a right to seek legal remedy in a court of law is an issue of public interest.
