LN: And with every step he's lost Votes…. Public misses the good old days of UPA…. when there were no shocks!!
RN: I think India should be indebted that it got a Gutsy Leader like Modi ….. who has placed the Country first!!!! Had he been in the mold of Congress he'd have not taken any tough decisions ...
Me: And then don't forget his slogan… na khaaoo ga na khaane doonga ….now via his actions its…. na chori karta hoo na karne doonga!!!
LN: But the timing is atrocious …. it is the festival and marriage season……
M: Well if you see the progression of the anti Black Money game plan …. he gave every opportunity to Indians to go White….. with a game plan in place he had to go step by step…. and now very soon with two State elections coming up the Code of Conduct would come into effect and then the next step which is demonitization could not have been taken!!
LN: Property Prices will crash!!!!
Me: The Jury is still out on this…. the 70:30 formula prevalent in Real Estate will take time to cure…. actually there has already been some curing ….Flats that White Collar lot buy now are usually 100% by Cheque Payment …. these purchases are usually financed!!!!
LN: They say Modi aims to make India a Plastic Economy …. this is going to lead to huge overspending by Indians …. Cards are swiped because the heart holds sway…. not the brain!!
RN: We are not like 'the Goras'…. we plan for tomorrow …. we save……. Indians basically are not a pay-cheque away from Bankruptcy like Goras are ….. our habit to save holds our heads above water even when we face a temporary hic-up in our Salaries!!!
RN: But how would this Government get Indians to start using Debit Cards ...
Me: All they have to do is make it mandatory for Mobile Companies to accept payments only via Cards ....no cash....would be good for Security too! !
LN: By the way have you noted how Americans are reacting to Trump's election!!!
Me: I think Americans were following what transpired post Modi's election…. I'm sure soon there will be an Award Wapsi by Oscar Winners!!!
RN: And there too you have a totally biased Media…. the Media there had declared Hillary the winner before the election!!!
Me: Why we had one of our Journos do the same …..
LN: Coming back to Black Money…..now what will be Modi's next shock!!!!
Me: Could be to make NPA…. Non Performing Assets start performing in the Economy…. no…no …. he will not declare war on your lockers….. but he'll think of some way to make Indians stop their craze for storing Gold!!!!
LN: (calling his wife on the phone) Janoo …. tomorrow we are going to empty out our Lockers!!!! And remind me we need to get a Big Safe … round the clock Security of the House….. Guard Dogs…..
Me: I think … all we need to get is a new mindset!!!!

MoCA holds stakeholders' conference

Ministry of Civil Aviation (MoCA) has held stakeholders' conference/pre-bidding meeting on November 11, 2016 at India Habitat Centre, Lodhi Road, New Delhi. Regional Connectivity Scheme -UDAN has been launched by P Ashok Gajapathi Raju, Minister of Civil Aviation on 21stOct, 2016 and the final RCS is available on MOCA web site (please visit web site;http://www. civilaviation.gov.in click view all "In Focus"). Objective of RCS is to facilitate/ stimulate regional air connectivity by making it affordable. Regional air connectivity is envisaged under RCS by supporting the Selected Airline Operator(s) through concessions by Central Government, concerned State Government(s) & airport operators to reduce the cost of airline operation on RCS routes and financial (viability gap funding i.e. VGF) support to meet the gap, if any, between cost of airline operation and expected revenue on such routes. A selected airline operator will be identified to operate on RCS route or network, on the basis of evaluation of initial proposal(s) and counter proposal(s) for VGF, received from airline operators who are having valid Air Operator Permit issued by DGCA. Presentation on RCS-UDAN was made by Jayant Sinha, Minister of State for Civil Aviation and R N Choubey, Secretary, Civil Aviation. " Donald Trump's victory - Implications on India"

Let me come straight to the point. Donald Trump is an anti-outsourcing person. This could jeopardise the fate BPOs in India. A hard core businessman, a top realtor, figuring in world's super-rich category, he has invested in building two business centres , one each in Mumbai and Pune. He could infuse foreign capital for infrastructure development and create jobs in India.
In international relations, India may have high expectations from Donald.
There is a distinct possibility of emergence of a new regional Axis consisting of the US, Russia and India to counter China's influence and its terror ally Pakistan. India should facilitate the formation of such an alliance. The US under Trump would surely review its Pakistan policy as part of his commitment to fight terror.

Information Commission to examine the public interest in each case of second appeal

Vide multiple RTI Applications, the appellant sought different information from the EFL Univeristy, Hyderabad. The CIC examined whether the details about appointment of standing counsel and expenditure incurred can be shared under RTI with the appellant? Another issue related was whether legal opinion rendered by the standing counsel to the University should be considered as given under 'fiduciary capacity' and hence be denied. The CIC referred to the Section 126 of the Indian Evidence Act, 1872 and the section 91 of CrPC apart from various Court judgments. It was observed that Section 22 of RTI Act which accords overriding effect to RTI over all other statutes cannot be totally brushed aside, and it has to be read in addition to provisos in Section 8 of RTI Act. The CIC noted that the appellant and his wife is having a right to seek legal remedy in a court of law, which is an issue of public interest. The CIC ruled that the copy of note file of the EFL University containing order issued by the Vice Chancellor to obtain pointwise legal opinion from the advocate is a privileged communication between university and its legal counsel. The CIC held that the University is under an obligation to disclose on his own entire information about the process of appointments as per the DoPT Office Memorandum dated 30th June 2015. The CIC directed the Public Authority to intimate the basis of appointing a lawyer in RTI proceedings, along with expenditure involved along with the copy of opinion given by the standing counsel after severing exempted information.

Comments

This order of the CIC sheds light on what is Public Interest and the role of the Information Commission in such cases. The CIC has categorically ruled that it is the duty of Information Commission to examine the public interest in each case of second appeal. Further, it has been held that a right to seek legal remedy in a court of law is an issue of public interest.
