In front of me,the person standing wearing a Kurta Payjama seems pretty relaxed and the person standing behind me in Casual Jeans and T'Shirt seems to be in another World plugged into his Mobile via earphones… must be listening to Music. Suddenly there is commotion and I see Rahul Baba with his Security breezing past the queue.

Someone behind shouts: Arre kaha ja raha hai!!!!

KPPIF: I know he's pointing to the rich ….. he means to say …do you see any Millionaire or Billionaire here!!!!
Person in Casual Jeans: Useless Gandhi (Rahul) come to change Useless Gandhis {name for 500 and 1000 Notes} …. (as he is loud there is guffawing all around)!!
KPPIF: See frankly the decision is going to inconvenience but it's a damn good decision….
Me: But now I am sure Kejriwal and Congress will say Modi forewarned the Party and some Industrialists about this demonetization!!
PINCJ: Crap…. believe me if this news had leaked to anyone outside the decision-making circle there would have been no 100 Rupee Notes in the market!!! Was BJP or Akali Dal asking for Donations only in 100 Notes!!!
KPPIF: Arre I personally feel some Election War Chests have taken a humongous hit….. and now Leaders of these Parties will demand a roll back and for this, they will conjure up stories…. like India's Growth will take a big hit!!!
Me: Max 6 month hic-up ….. some sectors and sectors allied with the directly affected sectors will face cash shortages for 6 months ….Real Estate and Allied Sectors…. Second Hand Car Market etc….. Entertainment …. Tourism....Vice !!!
PINCJ: Leave the Industrialists … any news about Kejriwal, Pawar, Mulayam , Mamtha standing in a queue to change old notes!!! Rahul is doing it for a Photo Op!!!!
Me: Banks should be gung-ho….. coffers will overflow…. Interest rates could come down! I think RBI will have to step in to keep Interest Rates conducive …remember it's this Sector that has saved India every time in a Global downturn… Savings!!!
KPPIF: Black Economy is about 20% of our GDP…. now it's to be seen how much of this is wiped out… last time there was Demonetization in 1978 …. 80% of the Notes of Rs 1000, 5000 and 10,000 were wiped out!!! I think Government is going to get a huge windfall!!!!
PINCJ: Then we know who was targeted and the majboori why these Notes got wiped out!!! My estimate is Value of Notes wiped out will be 7-8% of GDP !!!!
Me: Now the success of this scheme depends on how fast the Government is able to convert our Economy into a Plastic Economy…. the Real Estate sector will take some time to mend… what best the Government can do is keep an eagle's eye on Real Estate Deals….here RERA can be instrumental!!! By the way …. I'm a semi-retired Businessman… what about you guys!!
KPPIF: I'm the VP of a Multinational…. today was my day off…tomorrow my wife will be in queue!!! She's already stocked up on Sun Block etc!!!
PINJC: I own a Printing House…. tomorrow my wife too will be in queue with many of her Kitty friends…. I think they are having their Kitty standing in a queue!!!

What is Cadre Strength of ITS in DoT?

The Absorption Cell and Finance wing of DoT determined the ITS posts in DoT as 463 without having regard to Lien and ITS Recruitment Rules, 1992. This was concurred by Additional Secretary (T). With this, an attempt was made by DoT to terminate Lien of all ITS officers in BSNL, MTNL and on deputation except 463 ITS posts in DoT. This itself is against the FR 14-A(a) and principles laid down by DoPT vide its OM No: 28020/1/2010/Estt.(C) dated 26th Dec 2013 wherein it was stated that -

"A Government servant's lien on a post may in no circumstances be terminated even with his consent if the result will be to leave him without a lien upon a permanent post. Unless his lien is transferred, a Government servant holding substantively a permanent post retains lien on that post."

In OA 794/2014 filed before Hon'ble CAT, Hyderabad, DoT argued that the ITS posts have been transferred to BSNL and MTNL and as such, those posts are not counted towards the Cadre Strength of ITS. After hearing the DoT contentions and analyzing the Rule position on Lien, the Hon'ble CAT held as under :

"After giving our anxious consideration to the facts of the case, we are of the view that having regard to our findings on Issue No.1, we declare the contention of the respondents that the ITS posts were transferred to BSNL and MTNL is not a correct legal proposition and the respondents do not have any right to transfer the ITS posts to BSNL and MTNL without altering / amending the ITS Recruitment Rules."

The order of the Hon'ble CAT, Hyderabad as above is in consonance with FR 11 and FR 14-B which needs to be read together in such situations.

After determination of this figure, Cabinet Note on Deployment was prepared by Absorption Cell wherein it was stated that the ITS posts in DoT are 463 only. During the Committee of Secretaries meeting held on 29-10-2012, the Cabinet Note prepared by Absorption Cell was discussed. The para 4 of the said meeting minutes reveals that -

"Secretary, DoP&T while broadly agreeing to the proposal and stating that the comments of the department will be sent to DoT soon, mentioned that there has to be clarity on the concept of decadrement of posts of ITS in DoT. The posts against which ITS officers have been posted in BSNL / MTNL cannot be added to the ITS cadre strength in DoT. BSNL/MTNL will have to create their own posts and build up their own cadre. Secretary, DoT clarified that of the total ITS Cadre posts of 8335 as on 01.01.2008, the number of working ITS officers as on date is 1857, and hence, the proposal for proforma decadrement of 6478 (8335-1857=6478) posts from ITS cadre... ... Secretary, DoP&T clarified that for all practical purposes, sanctioned strength of ITS cadre should be based on the number of posts created in Government i.e. DoT and should not include the posts in BSNL/MTNL."

Since it was already clarified by Secretary, DoP&T that the sanctioned strength of ITS cadre should be based on the number of posts in DoT, no specific approval was obtained from Cabinet for determination of ITS Cadre Strength as 463. This fixation of ITS cadre strength as 463 fell for consideration in OA 794/2014 filed in the Hon'ble CAT, Hyderabad after examining the ITS Recruitment Rules held as under :

"In our view, the action of the DoT in determining the ITS cadre strength as 463 is without jurisdiction and not as per the procedure laid down in the rules on the subject. The action of DoT, in our opinion, is arbitrary. We do not hesitate to hold the determination of ITS cadre strength as 463 by DoT as bad in law. This issue is decided in favour of the applicant."

All the above facts are known to DoT. In fact, DoT has calculated vacancies for the year 2012-13 for HAG and SAG as 20 and 60 respectively due to retirement / resignation / death / chain vacancy, etc., For other years 2013-14, 2014-15, 2015-16 and 2016-17 also, vacancies have occurred due to above reasons. In such a case, DoT should have conducted DPC for these vacancies for promotion to HAG / SAG / JAG grades of ITS Group 'A'. Without doing this, the DPC is linked to the Cadre Review. If DoT does not want to include BSNL / MTNL posts as part of ITS Cadre, then it is for the Government to look for alternatives in other Departments / Ministries / State Governments / Autonomous Bodies, etc., to look for the posts with similar functions like ITS and encadre them to ITS Group 'A' as was done for Indian Economic Service.

As on dated the ITS of 1988 batch are still JAG. ITS of 2003 batch have not got JAG promotion they are granted JAG NFU.

Information Commission to examine the public interest in each case of second appeal

Vide multiple RTI Applications, the appellant sought different information from the EFL Univeristy, Hyderabad. The CIC examined whether the details about appointment of standing counsel and expenditure incurred can be shared under RTI with the appellant? Another issue related was whether legal opinion rendered by the standing counsel to the University should be considered as given under 'fiduciary capacity' and hence be denied. The CIC referred to the Section 126 of the Indian Evidence Act, 1872 and the section 91 of CrPC apart from various Court judgments. It was observed that Section 22 of RTI Act which accords overriding effect to RTI over all other statutes cannot be totally brushed aside, and it has to be read in addition to provisos in Section 8 of RTI Act. The CIC noted that the appellant and his wife is having a right to seek legal remedy in a court of law, which is an issue of public interest. The CIC ruled that the copy of note file of the EFL University containing order issued by the Vice Chancellor to obtain pointwise legal opinion from the advocate is a privileged communication between university and its legal counsel. The CIC held that the University is under an obligation to disclose on his own entire information about the process of appointments as per the DoPT Office Memorandum dated 30th June 2015. The CIC directed the Public Authority to intimate the basis of appointing a lawyer in RTI proceedings, along with expenditure involved along with the copy of opinion given by the standing counsel after severing exempted information.

Comments

This order of the CIC sheds light on what is Public Interest and the role of the Information Commission in such cases. The CIC has categorically ruled that it is the duty of Information Commission to examine the public interest in each case of second appeal. Further, it has been held that a right to seek legal remedy in a court of law is an issue of public interest.
